Andy and Carole further to discussions yesterday, please respond to these questions
1) TIlle Deed 9115745 (copy attached, refer Easement 15 on STP Sheet T1 4) Includes an "Immediate
termination" clause that we Intent to utilize From prevIous meetlngsldlscusslons we have verbal confirmation
from City that the Applicant's dedication of ROW on the plat (for St Joseph Place, eastward to Baldy View Lane)
meets the Intent of the clause Our pOSition IS that thiS deed Immediately terminates (without any need for a
"vacation process") upon the recording of the plat In thiS case, the road easement Will show up on the title report,
but Will not be shown on the plat (because as the plat records, It Will terminate) Please confirm that (I) you do
agree With thiS approach, (II) no separate "vacatIon process" needs to be Initiated now, (III) the Applicant's
Response Will adequately address thiS If It provides a cross-reference to the clause In thiS deed
2) Title Deed 7722531 (copy attached, refer Easement 3 on STP Sheet T1 2) Includes a 20-foot-wlde
Ingress/egress easement for the benefit of the City The dimenSions of thiS easement do not extend outSide of
LOT 2 of the subdivISion plat It IS not shown on the plat because the strategy was to have It vacatedlqultclalmed
prior to platting, but thiS has not been executed We understand thiS would need to go through a Type II ROW
Easement Vacation process (requires public notice - staff report - Director deCISion) We understand thiS could
take upwards of 60 to 75 days (120 allowed) Please confirm your agreement With thiS proposed strategy
. Show thiS easement on the plat, so It doesn't conflict With the title report,
. Initiate the Type II ROW Easement Vacation process Immediately (fee $1,205), concurrent With the
ongoing plat reView,
. Proceed With the plat If the plat records before the easement IS vacated, then Just Lot 2 Will be
encumbered, until that vacation IS completed If the vacation completes before the plat records, the
affected plat draWing sheet can be corrected to "scratch" the depicted easement
The reason I am urgently requesting thiS confirmation IS that we want to submit the reVised plat draWings (early
next week) to show that all other review comments have been addressed, however we seem to be In an endless
loop of small edits and corrections that are delaYing the greater plat review Your concurrence on these Items
would allow us to "hit the pnnt button" and get the next review set submitted
