ITEM TITLE: ICE TEMPORARY SERVICES AGREEMENT
ACTION
REQUESTED:
Approve/Disapprove the updated Immigration Customs and Enforcement
Temporary Detention Services Agreement.
ISSUE STATEMENT:
The City of Springfield currently has an agreement with the Immigration Customs
and Enforcement (ICE) to provide temporary detention services. The proposed
updated Statement of Work adds a requirement that ICE only lodge detainees at Springfield Municipal Jail who have current criminal activity or criminal history
that is identified in the attached Proposed Statement of Work.

DISCUSSION/
FINANCIAL IMPACT:
The City of Springfield has had an existing agreement for temporary confinement
of ICE detainees of up to 72 hours since 2012. The purpose of this agreement is to provide temporary confinement of detainees. The agreement consists of a federal
Order for Supplies or Services form and attached Scope of Work.
To provide perspective regarding the level of ICE usage of the Springfield Jail
facility, in calendar year 2017, 92 ICE detainees.
The line item updates to the Order for Supplies or Services form include updating
the date, removing out of date contact persons, updating the daily rate and removing the total amount of award because it is not applicable to this agreement as it is on a as needed basis. The daily rate reflects the total cost of housing a detainee and has
been adjusted over the years to reflect the costs of housing the detainees but not on the Order for Supplies or Services form until now.
The proposed Statement of Work adds a requirement that ICE detainees lodged at Springfield Municipal Jail must have current criminal activity or a criminal history
that adheres to requirements identified in the Proposed Statement of Work.
Springfield Municipal Jail would not be holding persons whose only violation of law is that they are persons of foreign citizenship present in the United States in
violation of federal immigration laws.

Purpose of Project:
To provide temporary detention services at the Springfield Municipal Jail (SMJ).
City of Springfield Responsibilities
Provide for the confinement of ICE detainees for a period of up to 72 hours.
Allow ICE detainees at the SMJ the opportunity to meet with their legal counsel or representatives as
identified on a properly executed form G-28, and with religious advisors.
Contact ICE when emergency medical transport becomes necessary.
Immediately notify ICE of any criminal conduct, or disciplinary issues of ICE detainees while lodged and
provide documentation of such events.
Immediately notify ICE of any illness or injury sustained by and ICE detainee while lodged.
Immediately notify ICE of escapes from custody.
Provide medical care for all ICE detainees consistent with applicable provisions of SMJ policy, local
state and federal laws and regulations.
ICE Responsibilities
Transport ICE detainees to and from SMJ and to all appointments.
Examine books, documents, papers and records of SMJ, which are directly pertinent to this SOW when
necessary for audits or inspections.
Notify the SMJ at least one hour prior to arrival when a lodging requirement is anticipated.
Provide ICE Form I-203 or alternative, and criminal history information when booking detainee in to
SMJ.
Notify SMJ at least one hour prior to arrival for book-out of ICE detainees.
Only lodge detainees with criminal activity or history that includes an aggravated felony as defined by 8
U.S.C. Section1101(a)(43), a state or federal felony crime or the following misdemeanor crimes: DUII,
assault, unlawful entry into a motor vehicle, possession of a burglary tool or theft device, menacing,
reckless endangerment, stalking, criminal mischief second degree, indecent exposure, sex abuse third
degree, eluding, misdemeanors involving domestic violence and misdemeanors involving weapons.
