"i~-,U 726-3753 Mr. David F. Haase State Realty 81 Centennial Loop Eugene, OR 97401 CERTIFIED LETTER Subject: Notice and Order to Abate Attractive Nuisance Relative to Tax Lot 8300, Reference 17 03 35 31 Dear Mr. Haase: As you know, the building(s) which formerly occupied what has become known as the Emporium site, more particularly described as Tax Lots 8300-8500, Lane County Assessor's Map Reference 17 03 35 31, in the City of Springfield, Oregon, was recently demolished. Whereas Lane County records indicate that you are cUr'rently the ohlner of a portion of the above described property, namely Tax Lot 8300, I must advise you that a large, open and unguarded excavation now exists where the building(s) once stood. Since the property in question lies near the center of Springfield's central business district and thus presents a definite health and safety hazard to area businesses, their patrons, and to the public at large, it is the City's opinion that the property currently constitutes an attractive nuisance as described in Chapter V, Article 1, of the Springfield Code" Therefore, please be advised that this is your notice and order to abate the afore- mentioned nuisance by the installation of fencing or other suitable safeguards that will prevent entry and injury. Abatement must be accomplished within ten (10) days of the date of service of this notice and order. Voluntary compliance is, of course, preferred; however, be advised that non-compliance may result in criminal charges being filed against you. As an alternative, the City may cause the nuisance to be abated and charge the cost thereof against the property. If you have any questions regarding this notice and order, promptly contact me at 726-3753.
