Notice and Order to Abate Attractive Nuisance Relative to
Tax Lots 8400-8500, Reference 17 03 35 31

Dear Mrs. Davis:
As you know, the building(s) which formerly occupied what has become known as
the Emporium site, more particularly described as Tax Lots 8300-8500, Lane
County Assessor's Map Reference 17 03 35 31, in the City of Springfield, Oregon,
was recently demolished.
Wherea's Lane County recol'ds indicate that you are currently the ownel' of a
portion ~f the above described property, namely Tax Lots 8400-8500, I must advise
you that a large, open and unguarded excavation now exists where the building(s)
once stood.
Since the property in question lies near the center of Springfield's central
business district and thus pl'esents a definite health and safety hazard to area
businesses, their patl'Ons, and to the public at lal'ge, it is the City's opinion
that the property currently constitutes an attractive nuisance as described in
Chapter V, Article 1, of the Springfield Code.
Therefore, please be advised that this is your notice and order to abate the afore-
mentioned nuisance by the installation of fencing or other suitable safeguards that
will prevent entry and injury. Abatement must be accomplished within ten (10) days
of the date of service of this notice and order. Voluntary compliance is, of
course, preferred; however, be advised that non-compliance may result in criminal
charges being filed against you. As an alternative, the City may cause the nuisance
to be abated and charge the cost thereof against the property.
