RE: Fill and Removal Permitting at 2828 Hayden Bridge Road
Dear Mike,
On May 31, 2002 the City sent you a letter identifying a violation of the Springfield
ordinances regarding the placement of fill in the floodplain of the McKenzie River within
Springfield's Urban Growth Boundary (UGB). You were advised to submit the proper
land drainage and alteration permits to the City by June 14th. On June 13th I met with
you to discuss the matter. You informed me that you had obtained permits for filling in
the floodplain from Lane County and provide me with copies of the permit. You also
stated that during the construction of"B" Street in Springfield in 1996 your property was
the recipient of fill removed from the construction site. You had visited City Hall to
obtain the proper fill permits and were informed by City staff that Lane County had
jurisdiction over such matters. Since Lane County issued permits to you for the filling of
the floodplain, you assumed that you were lawful and proceeded accordingly, and have
followed this course of action for subsequent fills.
In 1997 the City amended Article 27 FLOODPLAIN OVERLAY DISTRICT of the
Springfield Development Code to make specific reference to jurisdictions and penalties
for filling in the floodplain without permits. These amendments were in response to a
FEMA order to enforce the floodplain ordinance consistent with federal law or risk loss
of the federally insured flood plain program. Subsequently, the City's policies and
procedures in this regard have been more coordinated and vigilant.
While the City has had jurisdiction over filling in the floodplain within the UGB since
1987, many property owners are unaware of their responsibility to obtain permits from
the City for any land use arid building activity on their property. Please be advised that
any further filling on the portion of your property within the UGB will require permits
from the City before you can proceed. Otherwise, please consider this matter closed.

Dear Mr. and Mrs. Miller,
On Thursday, May 24, I was in the vicinity of a property you own at 2828 Hayden Bridge Road,
a 5 acre parcel located at Assessor's Map 1702 19 00 1200. At that time, I noted fill being
dumped in the southwest portion of the property, adjacent to Hayden Bridge Road. The site is
within Springfield's Urban Growth Boundary, and is within the jurisdiction of the City of
Springfield. A Land and Drainage Alteration Permit is required by the City for any site activity in
the flood plain and everywhere site alteration consists of fifty (50) cubic yards or more and/or if
. a drainageway is affected. The property where the fill is being dumped is in the floodplain,
FEMA Flood Plain Zone A; as mapped on map Panel 1153.
The permit you were issued by Lane County Land Management Division, File Number PA 01-
6264, Condition 14 states:
"This permit does not authorize any work that is not in compliance
with the underlying base zone or other local, state or federal
regulations pertaining to the operations authorized by this permit.
The permit holder is responsible for obtaining the necessary
approvals and permits before proceeding under this permit."
Permit Condition 15 states:
"A permit will be required from the City of Springfield for that
portion of the fill to be placed within the Urban Growth Boundary.
This does not authorize the placement of any fill within the City of
Springfield's jurisdiction."
Enclosed is the Land and Drainage Alteration Permit application form packet. Please note that
additional fees apply when permits are issued after land use activity occurs. Please take action
within 14 days of the date of this letter by submitting the completed application to the Planning
Division, Development Services Department office in City Hall, 225 Fifth Street in Springfield.
Front counter hours are 8:30-12, and 1-4:30 Monday- Friday. For additional information or
assistance, or if this letter is in err, please call me at 726-4608. If you fail to take action, it will
be necessary to forward this matter to City and County Code Enforcement officials.

cubic yards of fill within the 100 year flood hazard area as per Lane Code 16.244_
III. GENERAL INFORMA nON
A. Location and Site Description: Map: 17-02-19 Taxlot: 1100 & 1200
Zoning: E-40IFP/RCP Plot No.: 436
The site is located 2828 Hayden Bridge Road, The property is located within the 100
year tlood hazard area, in Zone "AE", as per Flood Insurance Rate Map (FIRM) Panel
#415591-41039CI153, effective June 2,1999. The Base Flood Elevation is 455.1' to
455.3' Mean Sea Level.
On May 24, 1996, a Floodplain Development Permit (P A 1402-96) was issued to place
approximately 16,852 cubic yards of fill. The applicant placed approximately 2/3
(11,900 cubic yards) of the requested fill amount. The permit expired on May 24, 1998.
On January 13, 1999, a Floodplain Development Permit (PA 98-5472) was issued to
place approximately 8,000 cubic yards offill. The permit expired on January 13,2001. ,
The permit would have brought the total amount of fill authorized to approximately
19,900 cubic yards. The new approval will allow a total of approximately 27,900 cubic
yards of fill to be placed on the property.
IV. DECISION
The Special Use Permit is approved with conditions as contained in Exhibit "A".

CONDITIONS OF APPROVAL
FILL
WORK AUTHORIZED
I. This permit authorizes the placement of approximately 8,000 cubic yards of material
in the location on the approved plot plan for the purpose of clevating the property
closer to the street and existing house levels.
2. The development shall occur in the location shown on the approved plot plan. Any
substantial deviation from the approved location shall invalidate this approval.
3. A Building Permit is required for tbe construction of any structures on tbe
property.
THE FOLLOWING CONDITIONS MUST BE SATISFIED PRIOR TO ISSUANCE OF A
BUILDING PERMIT.
4. Structural fill placed prior to start of construction shall be designed by an Oregon
Registered Professional Engineer or architect: The design shall be submitted to the
Land Management Division prior to the issuance of the construction permit.
5. The top of the fill shall be at least 455.1' to 455.3' Mean Sea Level. The top of
the fill shall be shall be certified by an Oregon registered professional engineer. This
certification shall be submitted to the Land Management Division prior to the
issuance of a building permit to build on top of the fill.
ADDITIONAL DESIGN REQUIREMENTS
6. Fill slopes for granular material shall be no steeper than one vertical on one-half
horizontal. unless substantiating datajustifying steeper slopes is submitted to the
Building Official and approved.
7. The minimwn distance from any point of the building perimeter to the top of the fill
shall be 25 feet unless certification is provided by an Oregon registered professional
engineer that a lesser distance is sufficient to protect the structure against the erosion
and scouring of floodwaters.
8. No fill shall be placed within lOa feet of the ordinary high water ofa Class I Stream.

9. All vegetation removal shall comply with the Riparian Vegetation removal standards
of Lane Code 16.253.
10. Upon completion of the fill, the sides of the fill shall be planted with vegetation to
prevent scour.
11. Fill materials shall be free of waste or polluted materials.
THE FOLLOWING CONDITIONS MUST BE SATISFIED DURING THE
CONSTRUCTION PROCESS.
12. All structural fill shall be certified by a special inspection agency, or a certified
special inspection agen,<y or.a certified special inspectc:ll, that it meets the
compaction standards of the American Society for Testing and Materials. The
compaction standards are: 95 percent of the maximum density obtainable with the
Standard Proctor Test method, or 90 percent with the modified Proctor Test. [See
Attachment" I "]
GENERAL COHJJ~uONS
13. Tbe outer limits ofthe fill shall be marked and staked prior to any placement of
fill materials to avoid any fill placed witbin the fIoodway. No fill sball be placed
greater than 320 feet from Hayden Bridge Road, Contact Lane County Land
Management Division (John Petscb at 682-4518) once the floodway boundary
bas been staked on the property and prior to tbe placement of any additional fill
on tbe property. Tbis permit does not authorize the placement of any fill
bctween tbe floodway boundary and the McKenzie River.
14. This permit does not authorize any work that is not in compliance with the

operations authorized by this permit. The permit holder is responsible for obtaining
the necessary approvals and permits before proceeding under this permit.
IS. A permit will be required from tbe City of Springfield for that portion of the flll
to be placed within the Urban Growtb Boundary. This does not authorize the
placement of any fill within the City of Springfield's jurisdiction.
16. Violations of the terms and conditions of this permit are subject to administrative
and/or legal actions which may result in revocation of the permit or damages. The
permit holder is responsible for the activities of all contractors or other operators
involved in work done at the. site or under this permit.
17. A copy of the permit shall be available at the work site whenever operations
authorized by the permit are being conducted.

18. Employees of Lane County and all duly authorized representatives of the Director
shaU be permitted access to the project area at all reasonable times for the purpose of
inspecting work performed under this permit.
19. Lane County retains authority to temporarily halt or modifY the operations if it
should cause excessive turbidity or damage to natural drainages.
20. The Applicant shall notify Lane County Lane Management Division upon
completion of the fill project for a final inspection.
21. This approval shall expire two years from the date of final approval. This
approval can be renewed for one additional vear onIv by a letter submitted to
Lane County Land Management Division before tbe expiration date, provided
tbe flood plain regulations bave not cbanged.
