The applicant must submit this Pre-certification form so that the Development Services Director can determine that the proposed new construction, addition or expansion or change of use is a 'permitted use in the CI District. The Pre-certification process presumes that a Site Plan or Site Pian M'odification application will be required for the proposed development. T.he Pre-certification process must be completed prior to the submittal of a Site Plan or Site Plan Modification application. In the CI District, no land use application may be submitted until the Deveiopment Services Director approves the proposed use, 2, T~e Development Services Director will consider both the permitted uses specified in SDC Sections 21.040,21.050 and 21.060 and the Operational Performance Standards specified in SDC Sectio'n 21.015. These Sections and the Prohibited Use List, SDC Section 21.030, are attached for your convenience (pages A-F), . 3, After Pre-certification by the Development Services Director,this form will be kept on file in the Development Services Department to be used for continued compliance with the SDC Sections citied above. 4, If the Development Services Director does not approve the Pre-certification, the applicant may submit a written request asking the Director to determine if the proposed use is similar to a permitted use, 5, If the Development Services Director cannot make a determination that the proposed use is simiiar to a permitted use, the applicant may apply for a Formal Interpretation in accordance with SDC Article 4, The following questions are based upon the Operational Performance Standards specified in SDC. Reason for Denial' (if applicable): Page 3 'I . . '\ Proposed Use/Description .of Proposal: 7-10-2007 Grain Millers intends to utilize the facility for the manufacturing of specialty food grade fibers for wholesale packaging and distribution, The process involves secondary processing (as outlined in SDC reference 21.040 Primary Uses, Item 1), into finished food components for wholesale distribution. Processing includes thermal/mechanical processing, grinding, sifting and packaging of initially processed material, and converting the material into a specialized food product. All processing falls under light industrial processing descriptions and will comply with all necessary requirements within SDC Reference 21.015 Operationall'erformance Standards. Processing air filtration will be required to sit at the building exterior, but will comply with 21.015 Part (7a, b and f). All other equipment will be within the main building structure. The proposed processing does not fall within any of the listed prohibited uses within SDC 21.030, items 1-13. Operational Performance Standards 1. All proposed manufacturing operations will be entirely enclosed within the building, however air filtration (baghouse filter) must be on the building exterior for air displacement to the exterior of the building and to comply with Uniform fire codes, 2. The present building complies with SDC Section 21.120 and Grain Millers has no intention or need to modify the existing structure exterior, or add to the present structure. 3. Storage of raw materials will be within the building structure. Truck parking is located at the rear of the building at the loading dock area, however it is not Grain Millers intention to have trucks parked on the premises full time, but only during loading and unloading. 4, The proposed use is not intended to serve the public. 5. The proposed use does not include regular movement of heavy equipment onto or off the premises. 6, The proposed use is not listed under SDC Section 21.030. " . . <\ 7a. Grain Millers presently is permitted with LRAPA and has maintained full compliance with its permit requirements. Filtration equipment would be utilized to prevent particulate discharges at this location. 7b, The handling of grain dust is considered hazardous, Grain Millers has fully complied with product handling and manufacturing requirements under NFPA61 at its present location at 315 Madison street in Eugene. The same safety equipment and systems would be instaUed at this location in order to maintain compliance under NFPA61, and receive approval from the City Fire Marshal. 7c. There will be no external glare created at this location. 7d. The proposed use will not utilize hazardous materials which could impact groundwater quality, 7e. The proposed use will not produce hazardous waste, 7f. The proposed equipment does produce noise but will be in accordance with OAR 340- 035-0035, 7g. No radiation will be used at this site. 7h. Vibration is dealt with at equipment installation and will not be transferred outside the building.
