ACTION REQUESTED: Conduct a public hearing and adopt/not adopt the following resolution: A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD ADDING A FEE FOR A TYPE II ACCESSORY DWELLING UNIT TO THE MASTER SCHEDULE OF FEES AND CHARGES. ISSUE STATEMENT: On March 5, the City Council adopted Ordinance 6376 which amended the Springfield Development Code to make it easier to add accessory dwelling units. These amendments allowed accessory dwelling units in the Washburne Historic Overlay District when reviewed under a Type II process. The amendments also provided property owners an option to 1) meet alternative design standards and 2) determine availability of on-street parking based on a parking utilization study. In both of those instances, the code requires a Type II review process. Previously, all accessory dwelling units were reviewed under a Type I process, so no fee was established for a Type II process. ATTACHMENTS: ATT1 - Resolution DISCUSSION/ FINANCIAL IMPACT: The review of the accessory dwelling units under a Type II process will not be significantly different than that of a Type I process. Therefore staff proposes utilization of the same base fee which currently is $811.00 plus a 5% technology fee for a total of $851.55. However, with a Type II process, the City mails a notice to property owners and occupants within 300 feet of the property being reviewed and to the applicable neighborhood association. This notice provides a two-week long opportunity for written comment. Therefore, staff recommends inclusion of the postage fee for a Type II decision which is currently $174.00. Thus, the grand total would be $1025.55 to cover the mailing costs and a portion of staff time to review and process the application. Attachment 1, PAGE 1 of 2 CITY OF SPRINGFIELD, OREGON RESOLUTION NO. ___________ A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD ADDING A FEE FOR A TYPE II ACCESSORY DWELLING UNIT TO THE MASTER SCHEDULE OF FEES AND CHARGES. WHEREAS, the City has authority pursuant to Section 4 of the 2001 Springfield Charter to establish fees and charges based on costs for specific services rendered; WHEREAS, ORS 227.175(1) requires governing bodies to establish fees charged for processing permits at an amount no more than the actual or average cost of providing that service; WHEREAS, on March 5, 2018 the City has adopted Ordinance No. 6376 making it easier to site and construct accessory dwelling units in the City of Springfield; WHEREAS, accessory dwelling units are currently processed under a Springfield Development Code (SDC) Section 5.1-125 Type I procedure, but Ordinance No. 6376 allows for accessory dwelling units to be approved under a SDC Section 5.1-130 Type II procedure if it is located in the Washburne Historic Overlay District, the applicant chooses the alternative design standards track, or wants to determine the availability of on-street parking with a parking utilization study; WHEREAS, a SDC 5.1.130 Type II procedure requires the applicant to pay for mailed notice to the property owners and occupants within 300 feet of the property being reviewed and to the applicable neighborhood association; WHEREAS, other than the mailed notice and allowance for public comment, the review of an accessory dwelling reviewed under a Type I procedure is not significantly different than the one reviewed under a Type II procedure; WHEREAS, the Council desires to update the Master Schedule of Fees and Charges to reflect cost of the updated approval process for accessory dwelling units; and WHEREAS, the opportunity for public comment at a public hearing has been provided prior to the adoption of this Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1: The Master Schedule of Fees and Charges shall include a fee for an accessory dwelling unit reviewed under a SDC Section 5.1-130 Type II procedure that is the same as for an accessory dwelling unit reviewed under a SDC Section 5.1-125 Type I procedure, plus the postage fee for the mailed notice required under a Type II procedure which currently is $174.00.
