HomeMy WebLinkAboutItem 05 Resolution, Annexation of Future Right-of-Way in Glenwood for Franklin Blvd, First Phase AGENDA ITEM SUMMARY Meeting Date: 4/2/2018 Meeting Type: Regular Meeting Staff Contact/Dept.: Kristi Krueger DPW Staff Phone No: 541-726-1674/ 541-726-3784 Estimated Time: Consent Calendar S P R I N G F I E L D C I T Y C O U N C I L Council Goals: Maintain and Improve Infrastructure and Facilities ITEM TITLE: RESOLUTION: ANNEXATION OF FUTURE RIGHT-OF-WAY IN GLENWOOD FOR FRANKLIN BLVD; FIRST PHASE ACTION REQUESTED: The Council is requested to consider and adopt/not adopt the following resolution: A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY FOR FUTURE FRANKLIN BLVD RIGHT-OF-WAY TO THE CITY OF SPRINGFIELD PURSUANT TO SECTION 5.7 OF THE SPRINGFIELD DEVELOPMENT CODE. ISSUE STATEMENT: As part of the Franklin Boulevard project, the City of Springfield purchased various properties along Franklin Blvd. in order to complete the construction of Phase 1. Construction of Franklin Blvd. is nearing completion and the properties are ready to be annexed into the City of Springfield. After the properties are annexed into the City, they will be ready to have their dedication as public right-of-way completed. ATTACHMENTS: Attachment 1: Resolution Attachment 2: Maps of Annexation Areas DISCUSSION/ FINANCIAL IMPACT: Prior to construction of the Franklin Blvd. project, a jurisdictional transfer was completed from ODOT to the City of Springfield of the existing Franklin Blvd. The City also annexed Franklin Blvd. Additional properties were needed for the project and were all purchased by the end of 2017. The project construction began in April 2017 and is expected to be complete in early fall, if not earlier. The additional properties purchased for the project are now owned by the City of Springfield and together comprise 1.93 acres. The properties are now ready to be annexed and dedicated as right-of-way. Upon adopting the resolution, staff will prepare and submit a formal annexation application. Once the annexation is complete, staff will then prepare “Declaration of Dedication” documents for each City owned property which will state that the properties are “dedicated to the public for PUBLIC ROAD purposes”, have them executed by the City Manager, and duly record the declaration documents with Lane County Deeds and Records. Attachment 1, Page 1 of 1 CITY OF SPRINGFIELD, OREGON RESOLUTION NO. ___________ A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY FOR FUTURE FRANKLIN BLVD RIGHT-OF-WAY TO THE CITY OF SPRINGFIELD PURSUANT TO SECTION 5.7 OF THE SPRINGFIELD DEVELOPMENT CODE WHEREAS, the City Council is authorized by Section 5.7-125 of the Springfield Development Code to initiate annexation of contiguous property to the City Limits of Springfield, and; WHEREAS, the property to be annexed is publicly owned property, and; WHEREAS, the territory to be annexed is within the Springfield Urban Growth Boundary, and is contiguous to the City of Springfield and can be provided with a full range of key urban services including sanitary sewer, water, storm drainage, police and fire protection, electrical service and land use controls, street lights and paved streets, recreational facilities and library, and; WHEREAS, annexation procedures shall be initiated and followed in accordance with the public notice and hearing process, criteria of approval and ordinance adoption procedures contained in Springfield Development Code Section 5.7 – Annexations. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1: The Common Council of the City of Springfield does hereby announce its intention to conduct a public hearing to consider annexation of territory generally described as follows: City of Springfield owned property comprising of 1.93 acres on Franklin Blvd. between the bridges east of McVay Highway 225 (S. Franklin Blvd.) and Mississippi Boulevard. Said territory is generally depicted on Exhibit 1 attached hereto. Section 2: As part of the consideration of the annexation action, City Council directs staff to review the affected territory for any potential survey gaps and, if any exist, to close such gaps to create contiguous annexation territory. Section 3: The Common Council of the City of Springfield gives the authority to the City Manager to dedicate the properties to Right-of-Way after the properties have been annexed. Section 4: This Resolution will take effect upon adoption by the Council and approval by the Mayor.
