HomeMy WebLinkAbout03/05/2007 Regular City of Springfield Regular Meeting MINUTES OF THE REGULAR MEETING OF THE SPRINGFIELD CITY COUNCIL HELD MONDAY, MARCH 5, 2007 The City of Springfield Council met in regular session in the Council Meeting Room, 225 Fifth Street, Springfield, Oregon, on Monday, March 5, 2007 at 7:08 p.m., with Mayor Leiken presiding. ATTENDANCE Present were Mayor Leiken and Councilors Lundberg, Wylie, Ballew, Ralston, Woodrow and Pishioneri. Also present were City Manager Gino Grimaldi, Interim Assistant City Manager Mike Harman, City Attorney Joe Leahy, City Recorder Amy Sowa and members of the staff. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Leiken. SPRINGFIELD UPBEAT 1. Recognition of John King for 35 Years of Service. City Manager Gino Grimaldi introduced John King and acknowledged his years of service to the City of Springfield in the Police Department. He thanked Mr. King's family for giving him the time to dedicate to the City. Mr. Grimaldi discussed Sergeant King's history with the Police Department and his accomplishments. He acknowledged the "Life Saving Award" ~eceived by Sergeant King at a recent Banquet for Sergeant King's role in talking a woman out of committing suicide. Mr. Grimaldi presented Sergeant King with a plaque. Sergeant King said he had never regretted his decision to become a Police officer. He appreciated his family and their support. He said his wife had encouraged him to apply to become a Police Officer when he was twenty-one years old and he had never regretted the decision. Mayor Leiken said he hoped Sergeant King stayed with the City long enough to work in the new Justice Center building. He said Springfield had one ofthe best law enforcement agencies in the state and he appreciated the work they did. I - AN ORDINANCE wrTHDRA WING CERTAIN REAL PROPERTY KNOWN AS BENSON, LOCATED IN SOUTHWEST SPRINGFIELD, SOUTH OF CENTENNIAL BOULEVARD, EAST OF ANDERSON LANE, NORTH OF KELLOGG ROAD INVOLVING APPROXIMATELY 2.10 ACRES IDENTIFIED AS TAX LOT 101 Tl7S R032 S33 MAP 11: HERETOFORE ANNEXED TO THE CITY OF SPRINGFIELD FROM THE RAINBOW WATER DISTRICT. (ORS 222.520) require that territory located in the Rainbow Water District, which is annexed to the City of Springfield, be withdrawn from that district to prevent double taxation. ORS requires withdrawal prior to March 31 st of each calendar year. The owner requested annexation in order to prepare for a subdivision. The subject property was annexed to the City of Springfield effective on February 1,2007. Once a year, the Council is asked to approve the withdrawal of all properties within the Rainbow Water District which were annexed during the past calendar year. This is done so that the properties are located only within the Springfield Utility Board's assessment area. Approval of . the withdrawal prevents the owner of the annexed property from being assessed by both Rainbow Water District and SUB. The requested action is a routine procedure which follows annexation and will have no fiscal impact on the City. . Approval of the withdrawal prevents the owner of the annexed property from being assessed by both Rainbow Water District and SUB. The requested action is a routine procedure which follows annexation and will have no fiscal impact on the City. Legal notice was published in the Register Guard as required by ORS 222.520 and notices were posted in five public places. ORDINANCE NO.4 - AN ORDINANCE WITHDRAWING CERTAIN REAL PROPERTY KNOWN AS WILSON/REYNOLDS, LOCATED IN NORTHERN SPRINGFIELD, NORTH OF LOMOND STREET, EAST OF LOCH DRIVE AND WEST OF 23RD STREET INVOLVING APPROXIMATELY 0.49 ACRES IDENTIFIED AS TAX LOTS 3400 AND 3500 T17S R03W S25 MAP 12: HERETOFORE ANNEXED TO THE CITY OF SPRINGFIELD FROM THE RAINBOW WATER DISTRICT. Approval of the withdrawal prevents the owner of the annexed property from being assessed by both Rainbow Water District and SUB. The requested action is a routine procedure which follows annexation and will have no fiscal impact on the City. Legal notice was published in the Register Guard as required by ORS 222.520 and notices were posted in five public places. A second reading and adoption is scheduled for the March 19,2007 consent calendar. Mr. Leahy noted that when the time came for Council to vote on these ordinances, that they vote for them separately. Mr. Leahy said they were currently on the assessed roles for Rainbow Water District until July 1 when they would be transferred to the City. Mayor Leiken opened the public hearing for all four ordinances. No one appeared to speak. Mayor Leiken closed the public hearing. NO ACTION REQUESTED. FIRST READING ONLY. BUSINESS FROM THE AUDIENCE 1. . Curtiss Greer, 357 55th Street, Springfield, OR. Mr. Greer referred to a February 22, 2007 Springfield Beacon article in which he felt a City staff member had been dishonest. He said the idea of abiding by common law was gone. The article implied that the City was not involved financially in Glenwood and that was false. He felt this showed staff would lie to cover themselves and that caused citizens to distrust City staff. It also showed that the Council and management supported those types of statements. He said it was easy to be honest about issues and questioned why people needed to lie. He felt it was a reflection of what staff thought of the public at large. Sooner or later someone would step over the line and citizens would be waiting. ~ COUNCIL RESPONSE CORRESPONDENCE AND PETITIONS 1. Correspondence from Garry Federow, c/o J.R. BIDS ORDINANCES BUSINESS FROM THE CITY COUNCIL 1. 1. Committee Appointments a. Budget Committee Appointment. City of Springfield Council Regular Meeting Minutes March 5, 2007 Page 6 Budget Officer Bob Brew presented the staff report on this item. The Budget Committee has one vacancy in Ward 5; due to the December 31, 2006 term expiration of Budget Committee Member Daniel Bowie. Mr. Bowie has served two terms and is not eligible to reapply. The person appointed will serve a thre~ year term which will expire on December 31, 2009. No applications were received in response to the news releases dated October 4 and November 14, 2006. One application was received after the deadline of December 29, 2006 and was approved for acceptance by the Mayor, Council President and City Manager without" any further advertising. . The Council interviewed Ms. Diana Garcia during their work session earlier this evening. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. 2. Business from Council a. Committee Reports 1) Councilor Ballew reported that she was now chairman of the Finance and Taxation Committee for the League of Oregon Cities (LOC). She said the committee would be hearing testimony on Beaverton on Friday. If Council had issues they would like brought forward, let her know. 2) Councilor Ralston reported on the Housing Policy Board. He said the Board met today and discussed the mobile home issue. The Board would be forwarding ordinances to Springfield, Eugene and the County to pass. He felt the ordinance was superior to the bill going through the legislature now. Originally he was opposed to cities giving credit for SDC's, but in most cases there were no original SDC's or they were minimal. He felt that was a good answer, so he recommended the ordinance be forwarded. He said the $10,000 subsidy was going through the legislature. He noted his opposition regarding that issue. 3) Councilor Wylie said she attended the PSCC meeting and was appointed as Chairman of a committee with the Sheriff for a work plan for the year. They would look into assessment and treatment for inmates and how it could be done better with evidence based practices. 4) Mayor Leiken said he didn't get to Washington DC last week due to mechanical problems with the airline. Instead he went to the Day at the Capitol event in Salem. He talked to local" legislators regarding the bill being presented by the HomeBuilders Association (HBA) which may have benefit to the City of Springfield. He said there were good meetings set up regarding this bill. He also discussed SB400 and said it was. an important bill from the City's perspective. It was the collective bargaining bill. It looked like it could pass in the House, but could die in the Senate. The swing vote was Senator Morrisette. He spoke with the Senator and recommended the rest of the Council City of Springfield Council Regular Meeting Minutes March 5, 2007 . Page 7 call Senator Morrisette. Mayor Leiken planned on calling him again today and noted that the League of Oregon Cities (LOC) staff were encouraging contact with the Senator. Senator Morrisette could have another bill that would be beneficial to Springfield in the near future. The Mayor asked Council to encourage Senator Morrisette to oppose SB400.
