HomeMy WebLinkAbout11/06/2017 Regular City of Springfield Regular Meeting MINUTES OF THE REGULAR MEETING OF 1'HE SPRINGFIELD CITY COUNCIL HELD MONDAY.NOVEMBER 6,2017 The City of Springfield Council met in regular session in the Council Chambers,225 Fifth Street, Springfield, Oregon, on Monday,November 6, 2017 at 7 04 p.m , w ith Mayor Lundberg presiding. ATI ENDANCE Present were Mayor Lundberg and Councilors VanGordon, Wy lie, Moore. Stoehr, Woodrow and Pishionen. Also present were City Manager Gino Grimaldi, Assistant City Attorney Kristina Kraaz, City Recorder Amy Sowa and memhers of the staff PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Lundberg SPRINGFIELD UPBEAT CONSENT CALENDAR 1. Approval of Liquor License Application for Dickey's Barbecue Pit, Located at 3000 Gateway Street 4120, Springfield, OR b. Authorize the City Manager to Execute the Intergovernmental Agreement(IGA)with Springfield Public Schools(SPS)for the Construction and Maintenance of a Vegetated Swale on the Hamlin School Property c. Award the Subject Contract to Em ironmental Science Associates(ESA) in the Amount of $229,081 and Authorize the City Manager to Negotiate and Execute the Contract. Diane Combs, Springfield,OR Ms Combs said she and her husband moved to Springfield about a year ago. She asked if there was a possibility of getting cameras at the intersections, especially at Q Street and Pioneer Parkway, and Q Street and 191h Street So many people run the red light at these locations and it is very dangerous for drivers and pedestrians alike COUNCIL RESPONSE Mayor Lundberg said she lir es by the Safeway and is y ery familiar with that intersection She asked Chief Lewis to talk with Mr. and his. Combs about some options. Mr. Grimaldi said they could possibly consider some additional enforcement at that intersection Red light cameras have been discussed in the past, but did not receive Council support. Councilor VanGordon asked staff to also look at the timing of the lights for westbound traffic at that location as well as the visibility. CORRESPONDENCE AND PETITIONS BIDS ORDINANCES BUSINESS FROM THE CITY COUNCIL 1. Committee Appointments 2. Business from Council a. Committee Reports 1) Councilor Moore reminded everyone to vote on the current election. 2) Councilor VanGordon said he attended the HMIS Evaluation meeting,the data committee for the Poverty and Homelessness Board (PHB). An important point is that when Lane County writes grants to HUD about social services,data quality is going to become a more important piece They are trying to increase the accuracy of data that all service providers are capturing, even those that don't accept finds from the cities or Lane County. It would be good for all of them to keep that in mind when they are out in the community 3) Mayor Lundberg said part of downtown revitalization includes power washing the sidewalks, pulling weeds, etc. More than one church has offered to do that and she asked City of Springfield Council Regular Meeting Minutes November 6, 2017 Page 3 Council if they would like to pursue asking those churches to assist One of the churches who had offered was New Life Church and they have a big power washer. It may be that something can he done in the Spring. 4) Councilor Woodrow said it was a great Halloween at City Hall with a lot of kids and parents. 5) Councilor Moore said she appreciated all the advertising about the Veteran's Memorial event happening on November 10 She encouraged everyone to attend. The Mohawk Hawks are paying for food from the Hole in the Wall BBQ. b. Other Business BUSINESS FROM TIIL CITY MANAGER I. Springfield Museum Committee Formation Library Director Emily Day id introduced the new Museum Curator Megan Lather-Barron Upon moy ing the function of the Museum under the supervision of the Library,they hired an experienced, dedicated museum curator. Ms. Lallier-Barron comes with knowledge of our museum and served as interim director a few years ago and has also served on the Museum Board. They have been working with staff to look at how to collaborate on collections and programming, realizing that the Museum has a very unique mission. Because of that,they would like to have a specific Museum Committee that will support the work of the Museum. Ms Lallier-Barron said due to the dissolution of the Springfield Museum's Board of Directors when the Museum rejoined the city, the Library Advisory Board will now help guide policies of the Museum as part of the Library department, and the Library Foundation will include the Museum as part of its Library fundraising efforts. There is, however, a need for citizen input and support to guide the y ision of the Museum The Springfield Museum w ould like to form a committee to support the Springfield Museum Curator It NN ould be responsible for making recommendations for Museum exhibits and programs, assisting with implementation of exhibits and special events; assisting with community outreach and publicity. The Museum Committee would also work directly with the Museum Curator and Library Director to create a strategic plan for the Museum. The Committee would be responsible to the Library Board as a representatr e of the Springfield Museum Mayor Lundberg said she is going to appoint herself to this as the Council liaison. She is very excited about the Museum and the potential for the community Councilor VanGordon asked if they could extend the terms to three or four year, with staggered terms He asked if the Bylaws allow them to hay e staggered terms. After discussion, they decided to start with two 2-year terms and two 3-year terms,continuing with 3- year terms. IT WAS MOVED BY COUNCILOR VANGORDON WITH A SECOND BY COUNCILOR PISHIONERI TO APPROVE THE PROPOSED MUSEUM COMMITTEE CHARGE WITH City of Springfield Council Regular Meeting Minutes November 6.2017 Page 4 CHANGING THE TERMS TO THREE YEARS,WITH THE INITIAL APPOINTMENT FOR TWO MEMBERS TO SERVE A PARTIAL 2-YEAR TERM,AND TWO MEMBERS TO SERVE A FULL 3-YEAR TERM. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. Councilor Pishtonen asked if it was defined that the members live in a specific geographical area. It does not. Many other committees do not either IT WAS MOVED BY COUNCILOR VANGORDON WITH A SECOND BY COUNCILOR PISHIONERI TO APPROVE THE PROPOSED MUSEUM COMMITTEE BYLAWS.THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. 2. Presiding Judge Employment Contract Finance Director Bob Duey presented the staff report on this item The position of Presiding Judge came open after the retirement of the previous incumbent. After completing its interview process the Financial/Judician Committee unanimously recommended Ms Triem to the full Council for the position. Subsequent to an interview of Ms Triem by the full Council, staff was directed to prepare an employ ment contract for consideration. Ms. Triem is a graduate of the University of Idaho Law School, has served as a City Prosecutor, as an Assistant District Attorney and has been an Administrative Law Judge for the State of Oregon She is currently in private practice Ms. Treem has been shadow ing staff for the last couple of days to get familiar with court operations. Mr Duey has been working with Ms. Trim and the City Attorney's office on the contract and the rate of pay. It is a combination of what they have currently been paying the presiding judge and what they have been paying the pro-tem judges. They came up with a rate of$72 38/hour. Ms. Triem will he employed to work a 28-hour work week and initially be assigned to spend approximately 75%of the time with direct courtroom duties and 25%of the time on administration to review and design court programs and sen ices. Although reporting directly to the Council, Ms. Treem will be considered a non-union executive management employee of the City and will receive a benefit package that is in- line with that which would be provided to other non-union executive management employees As time goes on,Ms. Treem will spend more time on the bench and less time on administrative duties. The total cost of the judge packages prey iously was$235,000 a y ear. The new budget will be about $245,000 per year for an extra 8 hours per week. In doing that,they will be able to cut back on some pro-tern judge time The Finance/Judiciary Committee is scheduled to meet on November 20 to discuss Ms. Triem's work plan. Next w eek, she will shadow the existing pro-tem Judges to evaluate how they run the Courts. Councilor Wy lie said the whole process went exceedingly well. She gave credit to the staff and said she felt Councilor Pishioneri gave a lot of leadership to the Finance/Judiciary Committee. Councilor VanGordon asked when the first day Ms. Triem would be sitting on the bench Mr. Duey said she will likely shadow the pro-tem judges for two weeks before sitting on the bench. City of Springfield Council Regular Meeting Minutes November 0, 2_017 Pace 5 Councilor VanGordon said he is open to prov iding more time if needed, or having her spend time on the bench and then shadow. May or Lundberg said she wants to make sure ev ervone is comfortable with the wording regarding supervision by the judge versus Mr. Duey's role of the supervisor of the court employees. Councilor Pishioneri suggested changing the language so it was clear the judge would be responsible for the Municipal Court work product rather than personnel issues. After discussion, it was decided to adjust the language to make that more clear. Councilor Pishionen asked about the section on severamce pay, which was only one-day Assistant City Attorney Kristina Kraaz said she would check in with City Attorney Mary Bridget Smith to determine if there was a legal issue that would require something regarding severance pay or termination If not required,that section could he removed, however, if it would reduce the city's liability, Council would like to keep that section Councilor Pishioneri asked about fringe benefits Mr. Duey said paid time off(PTO) is pro-rated to the rate of a.7 employee. With Ms Triem's hours, she would be past the threshold for the same fully paid insurance as a non-union employee. Councilor Pishioneri asked if the time she will spend on the weekend to review probably cause affidavits would be part of the 28 hours He noted that could he done over the phone Mr. Duey said it would be part of her salary package. Councilor Pishioneri referred to the section about professional development and asked who would deem w hat is necessary or desirable for the job He asked if a proof process would be in place. Mr Ducy said he had asked Ms Triem to put together a training package Councilor Pishioneri asked about Exhibit A and if it would be refined further. Mr. Duey said it was drafted by Human Resources and is expected to be a completed contract. The Finance/Judiciary Committee will take this document and use it as a foundation for the work plan The work plan would also include something about establishing programs to reduce recidivism Mr. Grimaldi said this is Council employ ce, so they can direct them at any time or through their performance evaluation. Mayor Lundberg said she wants the full Council to see what is come up with in the work plan. Councilor Pishioneri said he would like to see inclusive reports including cases heard, cases adjudicated, cases resulting in incarceration, failure to appear(fta)rates.etc. Mr Duey said he w ill follow-up with Man'Bridget Smith regarding the severance pay and supervision and will make those changes before the contract is ready for the Mayor to sign City of Springfield Council Regular Meeting Minutes November 6, '_017 Page 6 IT WAS MOVED BY COUNCILOR VANGORDON WITH A SECOND BY COUNCILOR PISHIONERI TO AUTHORIZE THE MAYOR TO SIGN AN EMPLOYMENT CONTRACT THAT'S SUBSTANTIALLY THE SAME FORM WITH THE MINOR CORRECTIONS AS DISCUSSED WITH SUSAN TRIEM FOR THE POSITION OF MUNICIPAL COURT PRESIDING JUDGE.THE MOTION PASSED WITH A VOTE OF 6 FOR AND I)AGAINST.
