Proposed Fee Resolution with Exhibit DISCUSSION/ FINANCIAL IMPACT: Under section 16.4.a of the City’s Franchise Ordinance, Sanipac can request supplemental rate adjustments when the cost of service is increased or decreased by governmental or environmental regulations. Starting in September of 2017 China initiated an import ban on a number of US solid waste products including multiple types of plastics, textiles and paper. This ban has resulted in increased operating costs for Sanipac. Sanipac has determined that these market conditions have resulted in increased monthly operating costs totaling $47,000 or 5.9%. As a result, Sanipac is requesting a supplemental rate increase of 5.9% effective January 1, 2018. Sanipac staff will be present at the work session to discuss their request and the recycling market conditions. BACKGROUND: In May 2017 Council approved a 2.1% CPI adjustment as well as a 0.81% rate adjustment associated with the new County requirement to haul all loads to Short Mountain. Since that time the market for commodity recycled materials has been impacted by China’s ban on American recyclables, resulting in increased processing and transportation costs for Sanipac. The Franchise Ordinance allows for more than one rate increase per year in cases when the cost of service increases due to governmental or environmental regulation. DISCUSSION: World Recycling Market: Starting in September of 2017 China initiated an import ban on a number of US solid waste products including multiple types of plastics, textiles and paper. Prior to this ban China was a primary export market for US recycled materials. Along with other solid waste haulers and sorting services in the northwest, Sanipac has had to respond by identifying alternative outlets for recycled materials. Sanipac has identified Garten (located in Salem) and West Rock (located in Portland) as new processing outlets for its recycled materials. Though it is unknown how long the current import ban will stay in effect it would appear that the US recycling market will continue operating in a state of instability for some time. Local and State Response to Changes to Waste Stream: Sanipac has taken short term efforts to adjust its processing methods in order to reduce the amount of contaminated material in its waste stream and divert some types of recyclable products that can be more easily marketed. These efforts are helping reduce the tonnage being sent to more expensive processing outlets but does not completely resolve the issue. The Oregon DEQ has granted a statewide waiver under the Opportunity to Recycle Act to wastehaulers who cannot divert recyclables from the waste stream and who must landfill the material as long as they apply for the waiver and report the amount of material that is landfilled. This exception is temporary and subject to market conditions. Rates: Sanipac is requesting a supplemental rate increase of 5.9% effective January 1, 2018. To arrive at this number Sanipac assumes the following in regards to the impact current market conditions have on their cost of operations. Prior to the import ban, Sanipac generated approximately $7.24/ton in revenue from the sale of recycled materials collected in Springfield. Under current conditions Sanipac estimates that it will incur additional transport costs estimated at $1.79/ton and a commodity material disposal cost of $73.60/ton resulting in a net change in market value per ton of $82.64. Based on current residential and commercial collection averages in Springfield this has resulted in roughly $47,000/month in added operating cost which is 5.9% of average monthly collection revenue. Attachment 1, Page 1 of 2 Council can also consider directing Sanipac to use the DEQ waiver and transport all curbside recycling to the county landfill and not perform any sorting or recycling of materials during the time period that the DEQ waiver exists. Sanipac estimates that the cost increase associated with this change is approximately 3% and will request a commensurate rate increase under this scenario. Sanipac notes that the infrastructure exists for curbside recycling and it is a community practice that the customers value. Customers have the choice now to dispose of all items in the trash bin and not recycle but most choose to recycle. The City is still required by state law under the Opportunity to Recycle Act to provide curbside recycling and it is a requirement of the franchise that Sanipac provide curbside recycling. If Council desires a change in service to send all recyclables collected curbside to the landfill Sanipac recommends a public education and outreach effort in order to be transparent about the change in practice and the temporary nature of it. Sanipac staff will be present at the worksession to provide more information and answer questions. Moving Forward: Council is scheduled to hold a public hearing on the rate increase at its December 4 regular session and can adopt a rate change after the public hearing. Sanipac plans to return to Council before July 2018 with its regular annual update and will brief Council on the market for recycled materials and efforts to adjust its waste stream. RECOMMENDED ACTION: Staff recommends approval of the requested supplemental rate increase of 5.9% in commercial and residential rates for all categories of waste collection as allowed by section 16.4.a and 16.4.b of the franchise agreement and maintaining curbside recycling programs. Attachment 1, Page 2 of 2 Attachment 2, Page 1 of 1 Attachment 3, Page 1 of 1 EXHIBIT A – SCHEDULE OF GARBAGE RATES Other Rates Solid Waste (SMC 4.408, Resolution _________)(1) Charges for the collection of garbage and refuse as established herein shall be payable monthly in advance. In the event that any person fails to pay the collector of garbage and refuse for the services rendered by the collector for a period of 45 days, then the collector may prepare a statement to that effect, and to the effect that he is terminating the service to such person and shall deliver a copy thereof to the City manager. The City shall thereupon have the burden of seeing to it that such person for whom the service is terminated disposes of his garbage in accordance with the terms of sections 4.400 to 4.430. The collector shall have no duty to commence serving such person again until the collector shall have been reimbursed for the delinquent payments. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1: The Garbage and Refuse rates as set forth in the "Master Schedule of Miscellaneous Fees and Charges, Rates, Permits, and Licenses" are amended as specified in the Schedule of Garbage Rates attached hereto as Exhibit A and incorporated by reference herein. Section 2: Except as specifically amended by this Resolution, the "Master Schedule of Miscellaneous Fees and Charges, Rates, Permits, and Licenses" shall remain unchanged and in full Attachment 5, Page 1 of 2 PAGE 2 of 2 force and effect. Section 3: Future Resolutions of the Common Council may be adopted to amend, add, or delete any rate, permit fee, license fee, or other fee or charge as may be necessary to compensate the City for providing the particular services set forth in the Master Schedule. Section 4: In the event any particular rate, permit fee, license fee, or other fee or charge set forth in the Master Schedule, Schedule of Garbage Rates, shall be held invalid by operation of law or any court of competent jurisdiction or the enforcement of any fee restrained by such court pending the final determination as to its validity, the remainder of the rates, permit fees, license fees, fees and charges specified in the Master Schedule, Schedule of Garbage Rates, Exhibit A, shall not be affected thereby and shall remain in full force and effect. Section 5: This Resolution will take effect on January 1, 2018.
