HomeMy WebLinkAbout09/05/2017 Regular City of Springfield Regular Meeting MINUTES OF THE REGULAR MEETING OF THE SPRINGFIELD CITY COUNCIL HELD TUESDAY, SEPTEMBER 5, 2017 The City of Springfield Council met in regular session in the Council Chambers, 225 Fifth Street, Springfield, Oregon, on Tuesday, September 5, 2017 at 7:00 p m.,with Ma}or Lundberg presiding ATTENDANCE Present were Mayor Lundberg and Councilors VanGordon. Wylie(by conference phone). Moore, Stoehr, and Pishioneri. Also present were City Manager Gino Grimaldi,City Attorney Mary Bridget Smith, City Recorder Amy Sowa and members of the staff. Councilor Woodrow was absent(excused). PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Lundberg. SPRINGFIELD UPBEAT 1. Mayors Recognition a. National Ballroom Dance Week Proclamation. Mayor Lundberg read from the proclamation and encouraged all citizens to support this observance Rich Robbins, President of the Eugene-Springfield USA Ballroom Dance Club, was present to accept the proclamation and say a few words Mr. Robbins provided some information about the club and the physical benefits of dancing. He thanked the Mayor for issuing the proclamation and for the opportunity to speak He introduced Pattie Ryan, founding member of the Dance Club and acknowledged her work in getting the club started and promoting the club. Ms. Ry an invited the Council to come and dance with the club anytime. ORDINANCE NO. 6371 —AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SPRINGFIELD AND WILLAMALANE PARK AND RECREATION DISTRICT:AND WITHDRAWING THE SAME TERRITORY FROM THE RAINBOW WATER DISTRICT. 5. Other Routine Matters a. Authorize the City Manager to Execute the Intergovernmental Agreement (IGA)for I luman Services with Lane County and the City of Eugene for the Allocation of General Funds in 2017-18. Speakers may not yield their time to others 1. ADA Self-Evaluation and Transition Plan Risk Manager,Tom Mugleston presented the staff report on this item. The City Council held a work session on June 12, 2017 to provide input on the City's draft Americans with Disabilities Act Self- Evaluation elfEvaluation and Transition Plan and to pros ide staff with feedback regarding the public outreach strategy for soliciting public comment on the plan. Following the work session,the draft was posted to the City's website and made available for public comment through August 21. City statT held four open house events on August 14 and August 16 to solicit in-person feedback. Comments were received in writing from the Lane Independent Lis ing Alliance: no other public comment was submitted. The draft ADA Self-Evaluation and Transition Plan has been re\iced to reflect the comments recei\ed and the Council's input during the June 12 work session. City staff now recommends that the Council hold a public hearing on the final draft of the Americans with Disabilities Act Self-Evaluation and Transition Plan If approved by Council follow ing the public hearing,the final ADA Self-Evaluation and Transition Plan will be posted to the City's website for at least the next three N ears There is no financial impact to City to adopt the ADA Self-Evaluation and Transition Plan document: funding mechanisms for necessary ADA improvements are further discussed within the Transition Plan document Councilor VanGordon said he was pleased to see the level of input from Lane Independent Living Alliance, and commended staff for including the suggested changes in the document Mayor Lundberg opened the public hearing. THE MOTION PASSED WITH A VOTE OF 5 FOR AND 0 AGAINST(1 ABSENT—WOODROW). 2 Vacation of Undeveloped Public Road Right-of-Was ORDINANCE NO. 2—AN ORDINANCE VACATING A 25-FOOT WIDE BY 299 91-FOOT LONG PORTION OF UNDEVELOPED PUBLIC ROAD RIGHT-OF-WAY LYING TO THE EAS I'OF 2ND STREET BETWEEN '0' AND STREETS. RESOLD LION NO. 2017-25 —A RESOLUTION OF THE COUNCIL OF THE CITY OF SPRINGFIELD TO WAIVE THE ASSESSMENT OF SPECIAL BENEFIT FOR VACATION OF A 25-FOOT WIDE BY 299.91-FOOT LONG SEGMENT OF UNDEVELOPED PUBLIC ROAD RIGHT-OF-WAY EXTENDING EASTWARD FROM 2ND STREET BETWEEN 'Q' AND STREETS Senior Planner Andy Limbird presented the staff report on this item. A property owner has initiated the vacation action in accordance with Section 3.200 of the Springfield Municipal Code and Section 5.2-120 of the City's Development Code. The 25-foot wide segment of public road right-of-way is vacant and undeveloped,extending eastward from 2nd Street a distance of just under 300 feet. The segment of undeveloped public road right-of-way dead-ends at an existing multi-family residential complex Therefore, a through-connection is not viable at its current location. The subject right-of-way vacation is requested to facilitate dey elopment of a multi-family residential complex on the adjoining property. The developer is proposing to extend 3`d Street from its current terminus southward to a 90" bend and then westward to an intersection with 2nd Street. The proposed east-west segment of public street between 22nd and 3`d Street would replace the connects qty function and also render the subject right-of-was surplus to the needs of the City. Mr. Limbird displayed a map showing the proposed street w ith the possible development. In accordance with Section 3 204(1)of the Springfield Municipal Code, disposition of public right-of- way requires that the applicant pay an assessment of special benefit for the value of the vacation area that inures to the benefiting property Section 3.204(31 states that the City Council may waive the requirement for an assessment of special benefit if the vacation is deemed to be in the public interest. If the City Council determines that waiver of the assessment of special benefit is warranted for this acation request, staff recommends commemorating that action through adoption of a Resolution. Because the developer will be dedicating and developing a 40-foot wide right-of-way for a public street through the property, staff recommends vacating the existing 25-foot wide road right-of-way as it will no longer serve as a potential east-west connection within the neighborhood The area proposed to he vacated is smaller than the area that the deN eloper proposes to dedicate as new right-of-way. As such,the net effect of the vacation would be to relocate the existing right-of-way to the developer's proposed new location, not to increase the net area available for the proposed residential development. Staff therefore recommends that the City Council waive the assessment of special benefit for this N acation because the vacation will not result in any net benefit to the subject property Councilor Pishionen asked about the normal special assessment benefit. Mr. Limbird said that was correct Councilor Moore asked about the requirements for the del,eloper in terms of the streets and sidewalks Mr. Limbird said the developer would put in all of the streets, sidewalks, stormwater features, and street lighting Councilor Stoehr asked if the area behind the storage facility was avant. Mr. Limbird said that was correct. Mayor Lundberg opened the public hearing. I. Rick Satre. Springfield, OR. Mr. Satre spoke on behalf of the applicant. Staff did a great job highlighting the applicants request He noted that the replacement right-of-way would be dedicated in concert with this action. He thanked the Council for their support Mayor Lundberg closed the public hearing. NO ACTION REQUESTED ON THE ORDINANCE. FIRST READING ONLY. BIDS ORDINANCES BUSINESS FROM THE CITY COUNCIL I Committee Appointments 2 Business from Council City of Springfield Council Regular Meeting Minutes September 5,2017 Page 5 a. Committee Reports 1) Councilor Moore said she attended the Lane Transit District(LTD) Strategic Planning Committee meeting. Ile West 11th extension opening event is scheduled for September 16 from 100-3:OOpm at Walmart. LTD presented a number of great points regarding the benefits of the project such as bicycle and pedestrian improvements, including two bicycle/pedestrian bridges which are being used a lot. There are many other safety items that were added. The overall cost of the project was$I00M. 2) Councilor VanGordon attended a G Street Oasis meeting. The current head count in the program is 21 households, 74 total clients as they start the school year. They had only expected 11 households the first time The) shared a story of the first client who closed on their own home That was fantastic news b. Other Business 1) League of Oregon Cities Conference—Voting Delegate Designation. City Manager Gino Grimaldi presented this item The annual business meeting of the League of Oregon Cities will be held on Saturday, September 30, 2017, in conjunction with the League of Oregon Cities Conference, September 28-30, 2017, at the DoubleTree Portland in Portland, Oregon Each cit) is entitled to cast one vote at the business meeting Therefore a oting delegate is needed to represent Springfield. Those attending from the City of Springfield include City Councilors Wylie and Moore. IT WAS MOVED BY COUNCILOR WYLIE WITH A SECOND BY COUNCILOR VANGORDON TO APPOINT COUNCILOR MOORE TO SERVE AS THE VOTING DELEGATE FOR THE UPCOMING LEAGUE OF OREGON CITIES ANNUAL CONFERENCE, SEPTEMBER 28-30,2017. THE MOTION PASSED WITH A VOTE OF 5 FOR AND 0 AGAINST(1 ABSENT—WOODROW).
