ISSUE STATEMENT: Following discussions held in work session on January 23, 2017 and February 13, 2017, Council directed Library staff to proceed with Phase II of the Library Needs Assessment / Programmatic Facility Design project. This amendment to the original contract with FFA Architecture + Interiors allocates Library gift and memorial funds and city funds to pay for the execution of that work. Independent Contractor's Compliance with Tax Laws. 1. Independent Contractor must, throughout the duration of this Contract and any extensions, comply with all tax laws of this state and all applicable tax laws of any political subdivision of this state. For the purposes of this Section, 'tax laws" includes all the provisions described in Subsection B. 3. (i) through (iv) of this Contract. 2. Any violation of Subsection 1 of this Section A shall constitute a material breach of this Contract. Further, any violation of Independent Contractor's warranty, in Subsection B.3. of this Contract, that Independent Contractor has complied with the tax laws of this state and the applicable tax laws of any political subdivision of this state also shall constitute a material breach of this Contract. Any violation shall entitle City to terminate this Contract, to pursue and recover any and all damages that arise from the breach and the termination of this Contract, and to pursue any or all of the remedies available under this Contract, at law, or in equity, including but not limited to: a. Termination of this Contract, in whole or in part; b. Exercise of the right of setoff, and withholding of amounts otherwise due and owing to Independent Contractor, in an amount equal to State's setoff right, without penalty; and c. Initiation of an action or proceeding for damages, specific performance, declaratory or injunctive relief. City shall be entitled to recover any and all damages suffered as the result of Independent Contractor's breach of this Contract, including but not limited to direct, indirect, incidental and consequential damages, costs of cure, and costs incurred in securing [replacement Services/replacement Goods/ a replacement Independent Contractor]. These remedies are cumulative to the extent the remedies are not inconsistent, and City may pursue any remedy or remedies singly, collectively, successively, or in any order whatsoever. B. Independent Contractor's Representations and Warranties. Independent Contractor represents and warrants to City that: 1. Independent Contractor (to the best of Independent Contractor's knowledge, after due inquiry), for a period of no fewer than six calendar years preceding the [date of Closing of {bids/proposals}for/effective date of] this Contract, faithfully has complied with: (i) All tax laws of this state, including but not limited to ORS 305.620 and ORS chapters 316, 317, and 318; (ii) Any tax provisions imposed by a political subdivision of this state that applied to Independent Contractor, to Independent Contractor's property, operations, receipts, or income, or to Independent Contractor's performance of or compensation for any work performed by Independent Contractor; (iii) Any tax provisions imposed by a political subdivision of this state that applied to Independent Contractor, or to goods, services, or property, whether tangible or intangible, provided by Independent Contractor; and (iv) Any rules, regulations, charter provisions, or ordinances that implemented or enforced any of the foregoing tax laws or provisions. Any [Goods/Items/Equipment/Components/Hardware/Software/Intellectual Property Rights, etc.] [delivered to/granted to] City under this Contract, and Independent Contractor's Services rendered in the performance of Independent Contractor's obligations under this Contract, shall be provided to City free and clear of any and all restrictions on or conditions of use, transfer, modification, or assignment, and shall be free and clear of any and all liens, claims, mortgages, security interests, liabilities, charges, and encumbrances of any kind. Your existing facility has been a valued and highly-used resource for the community and for professional staff, however, we understand the need to address the quickly changing landscape of libraries in the 21st century with regard to increasing population, the public experience of library spaces, the need for flexible, functional, and aesthetically appealing spaces for collaboration, library programming, evolving technology, as well as staff and patron comfort and public interface. FFA has developed an expertise in library design that is unique in the region. Having worked on more than 50 libraries in the last 15 years, we combine library programming, planning, and design expertise with a strong background in urban design and planning, as well as architectural design for major new civic facilities. For your project, we are proposing a team of professionals with rich experience working alongside each other on precisely the type of work outlined in this solicitation. Along with our proposed work plan and cost proposal, we have presented each team members’ qualifications, and have provided examples of recently completed projects which illustrate our expertise in facilitating public involvement, working effectively with diverse users and stakeholders, and successfully delivering in-depth reports which provide detailed, realistic roadmaps for library organizations to follow in furthering their mission. FFA accepts all terms and conditions of the Request for Proposal (RFP), including the sample contract per attachment 4 of the RFP. FFA qualifies as a resident bidder as described in ORS279A.120 (1) (b) and is licensed to do business in the State of Oregon. The FFA team performed a comprehensive study for a library which would meet the needs of the City of Nampa and the surrounding communities well into the future. The planning and programming study, completed in 2012, responded to issues specific to library design as well as general building design best practices. It addressed space needs, adjacencies, collections and technology elements as well as security and local building requirements. Working in close collaboration with the City of Nampa and the Nampa Public Library staff, FFA completed this study which served as a stepping stone in the development of a high quality, state-of–the-art highly functional library. FFA was then hired to provide interior design services for new facility which opened in March 2015. The primary goals for the project included the creation of a formal space needs assessment, building area program, conceptual design and cost estimate to provide the City with a master plan for library facility expansion. A space needs document was developed based on current industry standards and best practices as well as interviews and surveys of library staff, community stakeholders, and the general public. The space needs assessment and resulting building area program established the proposed size of the upgraded and expanded library to 35,000 square feet, including 12,500 square feet of renovation space and 22,500 square feet of new construction. A series of public presentations and workshops focusing on facility requirements and preliminary design concepts was led by the design team in order to review and obtain feedback from the community and the City Council. FFA’s proposal for the preliminary design is based on the City’s preferred approach to locate all of the required expansion space on the current, central Ledding Library site. The design concept includes extensive renovation of the existing 1960’s-era building, with two story expansions to house library functions and meeting space. Assisted by Consulting Librarian Penny Hummel, and Library Technology Strategist Lance Murty, the FFA team analyzed, in detail, the goals and needs of each community and provided a comprehensive framework to address the development of new library buildings, technology, and services well into the future. FFA worked closely with FVRL management and staff to research and gather relevant data, hold key stakeholder meetings, and participate in leading several community meetings. Through this planning process, building and site planning criteria and general design considerations were gathered, while keeping in mind emerging industry trends for 21st century library planning. By gaining an understanding for, and focusing on the needs of each community, FFA developed specific planning guidelines in accordance with each location. The Pre-Design Program was completed in October 2014, and is being used by FVRL and each of the three communities to focus efforts on further developing the vision and funding strategies for their new libraries. Included in this process was a review and assessment of the existing facilities as well as cost estimates for the proposed upgrades and renovations. Planning and design concepts were centered on the over-arching vision of the new DCPL Strategic Plan and its focus on “People, Place and Platform.” Upfront goals include flexible, functional, and aesthetically appealing community spaces for collaboration and library programming, evolving technology, as well as staff and patron comfort and safety, and public interface. The historic building that is currently used for the Library’s administrative functions, was once Bend’s original public library. The library determined that the the people of Bend would be best served if the building is converted to a new children’s library. This concept allows for a completely new vision for the children’s library, while freeing up space in the main library building for public meeting and gathering spaces and a more open concept to better welcome and connect the community. The Bethany Library intends to lease new space as an anchor tenant in the proposed Plaza at Bethany Village development in order to more than double the current size to 10,000 square feet. The larger facility will accommodate library use as well as additional space for various types of seating, more books, media, computers, and programming space, as well as a public meeting room. FFA was retained to refine the preliminary programming work done by the Library and to develop space planning options and ultimately, a conceptual design an associated project cost estimate for the complete build-out of the space. The various library spaces have their own unique characters, with feature elements to express specific collections and and target demographics. The design also accommodates a wide range of self-service functions, including a high volume of self-service holds and self-checkouts. The meeting room and associated support spaces are configured to allow for secure, after-hours access, with operable walls to provide the most flexibility. The main meeting room can open to the main library for larger programs. The building design maximizes daylighting, utilizing a 25-foot-high glass curtain wall as well as a series of skylights over the main reading room. Completed: 2009 Size: 15,000 sf Cost: $3.7 million Richland Library Renovation & Expansion Richland, WA Richland’s existing 1960s-era one-story library was designed in a “bunker style” using dark finish materials and heavily tinted glass, resulting an imposing cramped, outdated facility. FFA’s renovation and expansion utilized available open space on the site, pushing inviting new spaces for collections, lounge seating, and community meeting rooms near the edge of the site. A new two-story atrium/lobby provides a civic presence on the site and organizes new spaces for public meeting rooms, friends of the library retail, and a café. Completed: 2009 Size: 25,000 sf (new) / 33,000 sf (existing/rehab.) Cost: $10.1 million Petworth Neighborhood Library Renovation Washington D.C. In association with Franck & Lohsen Architects of Washington, DC, FFA de- veloped the program, space planning and furniture package for a complete interior renovation of this 21,000 square foot historic Georgian Revival-style library in Washington, DC. The renovation includes updating all the building systems, technology and furniture to bring the building into the 21st century of library design while maintaining most of the original woodwork and hisoric character. Completed: 2011 Size: 21,000 sf Cost: $10 million Beaverton Library at Murray-Scholls Beaverton, OR FFA was hired to plan and design the first branch in the City of Beaverton Library system within a leased retail space. The adaptive re-use developed by FFA in collaboration with the library and city staff keeps the dramatic wood structure and ceiling and the majority of open space became book stacks and reading areas for the various collections. New interior elements create special environments for children and teens, and new lighting throughout provides a bright and welcoming environment. Review Background Information: In order to be prepared to begin our assessment and planning project, it is important for the consultant team to first review all relevant background information, including any previous planning efforts that may impact the current project processes and outcomes. The Project Team can then address any basic initial questions or issues during the Project Kick-Off Meeting. 1B. Lead a Project Kick-Off Meeting with Springfield Public Library and City of Springfield Representatives: This introductory meeting will set the course for our assessment and planning project and is an important opportunity to share basic project information. The meeting will consist of the following: • We start the process by asking stakeholders to identify over-arching goals for the project, and we then synthesize those to establish a short list of goals that establishes the Overall Vision. This anchors the remainder of the project so that the project team stays on-course, always focusing on the Overall Vision when making decisions moving forward. • Establishing the planning horizon for the project: Due to the significant commitment and investment Springfield will be making to improve the Library services and facility, the planning horizon should take into account the community’s needs well into the future. • Reviewing any relevant planning criteria. • Confirming project parameters, including renovation vs. new construction, possible site(s) for a new library option as well as project budget. • Confirming Project Team roles and responsibilities. This includes the consultant team as well as representatives from Springfield Public Library, the City of Springfield and other key stakeholders directly involved with the assessment, programming, planning and design of the project. • Confirming the proposed project process, implementation plan and schedule, including project milestones and future meeting dates. • Project Team tour of the existing library facility. It is important to gain input from all stakeholders regarding the issues that are presented in the existing facility and aspirations for how services and spaces would be improved in an expanded, modified or new facility. • Project Team tour of site(s) being considered for a new construction option. 1C. Open House events are our opportunity to actively listen to a wide range of local voices and gain important insight into the community’s aspirations for an improved library facility and services early on in the process. These conversations facilitate support for the overall effort by the largest number of people as soon as is practical and serves to open up community dialogue and bring new ideas, energy, and inspiration to the forefront. 1D. Perform Data Analysis and Needs Assessment: In order to thoroughly assess current library services and the library facility to determine the Library’s strengths, weaknesses, and position to serve the community’s needs, the consultant team will reference multiple sources of information, including established professional standards, recognized best practices and base our analysis on emerging industry trends. In addition, the consultant team will learn from on-site observation of existing library functions and the patron experience. Our analysis will also include the following: • Benchmarking to illustrate how the Library compares to other Libraries serving similar communities. • Analysis of current and projected demographic data, in order to align services, collections and programs to the current and future service population. • Analysis of feedback from stakeholders and the community. • With Library Staff, City Staff and partnering agency staff (TEAM Springfield), conduct analysis to identify needs and opportunities for improved services and access to resources. • Identify gaps in current service delivery and the existing facility. State-of-the-art technology is key in providing patrons with access to critical information and education sources. The FFA consultant team will provide a current library technology and technology infrastructure review. This will become the basis for recommendations to align the updated or new facility with emerging library technology trends. 1E. Existing Building Assessment: In order to assess the viability of an expansion to the existing library facility, the FFA consultant team will review the general configuration, condition and systems of the building. Develop Design Concepts and Facility Space Planning Diagrams: Utilizing established professional library standards, recognized best practices, past experience, peer institution comparisons, as well as community and stakeholder feedback, FFA will work with you to determine an ideal facility size and develop idealized conceptual library space planning bubble diagrams. These will illustrate basic library spaces, function and adjacencies as well as compare how the existing library works, versus how it can be improved or expanded. Preliminary cost estimates for an expansion versus a new facility will be provided and will be based on a rough cost per square foot assumption. Our cost estimating consultants derive these figures by tracking current best construction practices, the bid and pricing climate as well as a basic level of design, craftsmanship and durability expected of an important civic building, such as a city’s central library facility. These cost estimates will help inform a recommendation regarding a direction in which to move forward. 1H. Coordinate Intermediate Progress Meeting #2 with Springfield Public Library and City of Springfield Representatives: This intermediate meeting is an opportunity for the FFA consultant team to propose and discuss recommendations to be included in our draft report. From this discussion, the FFA team will compile and produce a written report draft to be submitted to your team for review and comment. We propose that this intermediate meeting is accomplished via “GoToMeeting” or another virtual format proposed by the client. 1I. PHASE II: PROGRAMMATIC LIBRARY FACILITY DESIGN 2A. Review Previous Assessment Work and Review Additional Background Information: Time may have passed between project phases. Additional information may have come to light during this interval. The FFA consultant team will review all findings from the previous assessment work and any additional relevant information prior to commencing this new project phase. We will also work with City staff to facilitate a Community Advisory Committee to participate in evaluating and providing input on programmatic development and facility design. 2B. Lead a Project Kick-Off Meeting with Springfield Public Library and City of Springfield Representatives: This meeting will be an opportunity for the entire Project Team to reconnect and to review the findings from the previous assessment work and to set the course for Phase 2. Throughout this phase, The FFA consulting team will continue our collaborative approach to working with the Library and City to facilitate open and efficient communication. We will discuss the process and goals to be achieved for this phase. This is also an opportunity to reconfirm the project goals set forth previously. As per the first phase, topics will include: • Confirming project parameters, including renovation vs. new construction, possible site(s) for a new library option as well as project budget. • Confirming Project Team roles and responsibilities. Development of Library facility program and facility space planning diagrams for preferred preliminary design concept: Using the Library Needs Assessment findings, the FFA consultant team will generate a detailed Library Facility Program, which will include delineated space needs and square footage requirements as well as diagrams to illustrate required space adjacencies. We will work to align our recommendations to current library standards, best practices, and 21st century library trends, including facility size, functionality, space usage and adjacencies, library technology needs as well as general design considerations. From this exercise, we will work with you to confirm a conceptual design direction in which to proceed for either the existing site or a new facility. At this point in the project, we would communicate with your team regularly via email and conference calls or virtual meetings to review programming elements prior to beginning concept designs for a physical facility. We would also discuss identification and recommendations for range of service delivery improvements and how to provide them in the interim. Once a firm Library Facility Program has been agreed upon, we will begin to develop options for architectural design concepts for the building and site. 2D. Coordinate Intermediate Progress Meeting #1 with Springfield Public Library and City of Springfield Representatives: During this meeting the Project Team will review the draft programming documents and space planning diagrams as well as any preliminary design concepts which have been developed. The FFA consultant team will gather input from the Springfield team and incorporate your comments into a presentation for a series of outreach activities, including stakeholder or advisory focus groups and community “open house” event(s). We recommend scheduling an open house event at two points in this phase. The first would be to present our findings from the recent needs assessment work as well as to illustrate our programming process, current library trends and our specific recommendations. The other would occur later in Phase 2, where the consultant team would present designs for the preferred library concept. The project team can strategize content and format for focus group and community meetings to present the work to date. We propose that this intermediate meeting is accomplished via “GoToMeeting” or another virtual format proposed by the client. 2E.
