ORDINANCE NO. 6073

AN ORDINANCE AMENDING ARTICLE 31 - SITE PLAN REVIEW, SECTION
31.020 DESCRIPTION AND APPLICABILITY, "EXCEPTION" OF THE SPRINGFIELD
DEVELOPMENT CODE.
THE CITY COUNCIL OF THE CITY OF SPRINGFIELD FINDS THAT:
1. The Springfield Development Code (SDC) was adopted by the Springfield City Council
on May 5, 1986, and amendments thereto were subsequently adopted by Ordinance.
2. On November 4th, 2003, the Springfield Planning Commission held a public hearing on
the SDC amendment request (LRP2003-00024). The Springfield Planning Commission voted 5 to 0
with 2 absent to recommend approval of these amendments to the City Council.
3. Findings in support of adoption of these amendments to the SDC are set forth in the
Staff Report and the Recommendation to the Council (LRP2003-00024) incorporated herein by
reference.
4. Based on the above record and findings, the City Council concludes that the SDC
amendments are consistent with the criteria of approval as set forth the Staff Report and the
Recommendation to the Council (LRP2003-00024) incorporated herein by reference.
Now therefore, based on the above findings,
. THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS:
Section (2)(a) & (b) "Exception" of Section 31.020 is hereby amended to read as follows:
"Exception: Site Plan Review does not apply to certain single family and duplex dwellings on
properties zoned Medium Density Residential and High Density Residential subject to building
permit approval when:
1. the lot size allows only one such dwelling, or
2. there is an addition, remodel or replacement of an existing single-family dwelling
or duplex/or an accessory structure is proposed."
ADOPTED by the Common Council of the City of Springfield by a vote of 6 for and
