Ordinance No. 6070 AN ORDINANCE REQUIRING THAT AN OPPORTUNITY TO RECYCLE BE OFFERED TO RESIDENTS OF RENTAL HOUSING BY THE OWNER AND BY THE COLLECTOR OF GARBAGE, ADDING SECTION 7.346 TO THE SPRINGFIELD MUNICIPAL CODE, AMENDING SECTION 4.410(7) OF THE SPRINGFIELD MUNICIPAL CODE AND ESTABLISHING AN EFFECTIVE DATE. THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1. Title 7 of the Springfield Municipal Code is amended by the addition of a new section to be Section 7.346 to read as follows: 7.346 Recycling Containers. Every person establishing, maintaining or operating a rental shall provide a location for the placement of recycling containers, complying with Section 16.110(4)(d) of the Springfield Development Code. Section 2. Title 4 of the Springfield Municipal Code, Section 4.410 Receptacles. (7) is amended to read as follows (material in italics added): . (7) Licensee shall provide the opportunity to recycle to all customers which shall at all times comply with the requirements ofORS 459A.005-459A.085 (former ORS 459.165-459.200) and ORS 459.250, including utilization ofthe required elements contained in ORS 459A.OI0(2)(a), (b), (c), and (h), and the provision of at least one recycling container to each owner or operator of a rental as defined in Section 7.340 of this Code, together with all applicable rules and regulations promulgated thereunder by the Oregon Department of Environmental Quality. Section 3. This Ordinance shall become effective on December 1, 2003. Adopted by the Common Council of the City of Springfield this December , 2003 by a vote of 6 in favor 0 1st day of against.
