ORDINANCE NO. 6091

AN ORDINANCE At-1ENDING SECTION 1. 070 "FEES" (1) OF ARTICLE 1 "GENERAL
PROVISIONS" OF THE SPRINGFIELD DEVELOPMENT CODE TO PROVIDE THE CITY
COUNCIL SHALL ESTABLISH FEES BY ORDINANCE OR RESOLUTION FOR THE
PERFORMANCE OF THE ACTIONS AND REVIEWS REQUIRED BY THE SPRINGFIELD
DEVELOPMENT CODE, AND DECLARING AN EMERGENCY.
WHEREAS, Section 1.070 "Fees" (1) of Article 1, General Provisions
of the Springfield Development Code provides that the City Council
shall establish fees by separate Ordinance for the performance of
the actions and reviews required by the Springfield Development
Code; and,
WHEREAS, the Common Council of the City of Springfield wishes to
provide that such fees may be established by separate Ordinance or
Resolution of the Common Council of the City of Springfield.
NOW THEREFORE, the City of Springfield Common Council does ordain as
follows:
Section 1: Section 1.070 "Fees" (1) of Article 1 "General
Provisions" of the Springfield Development Code is hereby amended to
read as follows:
. 1.070 Fees.
"(I) The City Council shall establish fees by separate Ordinance or
Resolution for the performance of the actions and reviews
required by this Code."
Section 2: It is hereby found and determined that matters relating
to the imposition of the fees for the performance of the actions and
reviews required by the Springfield Development Code are matters
affecting the public health, safety and welfare and that an
emergency therefor exists and this Ordinance shall take effect upon
adoption by the Council and approval by the Mayor.
Adopted by the Common Council of the City of Springfield this 21st
day of June, 2004 by a vote of 5 in favor 0 against.----
