PERMIT AND AGREEMENT
THIS PERMIT AND AGREEMENT, made and entered into this ~
.day of --1IA,L(f ' 1982, by and between the CITY OF SPRINGFIELD, OREGON,
a municipal corporation, hereinafter referred to as CITY and TIM AND MATILDA
DEAS, DBA TIM 'N TILDA'S DELI, hereinafter referred to as Permittee:

FOR AND IN CONSIDERATIOr~ of the granting of a permit to use and,
encroach upon certain portions of the public right-of-way abutting the property'

known as~Main Street, Springfield, Oregon, more particularly described as
Lane County Assessor's Map #17 03 05 42, Tax Lot #7500, Permittee being the
owner of record, said public right-of-way being in the City of Springfield, and
part of the sidewalk system of the City of Springfield, Oregon, Permittee, does
hereby agree as follows:
1. It is understood and agreed that in the event that any such public
property is needed for use for street or other proper public purposes, that the
encroachment thereon, which shall consist solely of outside restaurant seating
encroaching no more than four (4) feet into the public right-of-way from the
front of the building; with no more than four (4) tables seating two (2) each
or two (2) tables seating four (4) each and which shall contain no permanent

.~tructure, must be removed without delay. In consideration of this permit granted
herein to use, Permittee does hereby promise to agree that if at any time in the "

future, use of such public right-of-way for any public purpose becomes necessar.y or
desirable in the sole and unrestricted discretion of the City, Permittee hereby

agrees to remove any and all encroachment~ within thirty (30) days after demand
for such removal by the City at Permittee's sole cost and expense. Furthermore,
if the City decides that use of said public right-of-way by Permittee becomes a
'potential hazard to public health or safety, or if Permittee uses the public right-
of-way in a manner which violates this permit and agreement, use of the above des-
cribed publ!c right-of-way may be immediately revoked.
2. Upon the foregoing conditions and agreement the City does hereby
grant unto the Permittee, the right to use the above described public right-of-way
and to encroach thereon to the extent herein set forth.'

3. The cost of the removal of any encroachment from such right-of-way
shall be born by the Permittee, and Permittee agrees to hold and to save harmless
the City from any liability which might be occasioned by Permittee's use of the
public right-of-way, if any.
