SUBJECT: Use of Public Right-of-Way by Tim 'N Tilda's Cafe, 737 Main Street
Tim 'N Tilda's Cafe propose to use an approximately 4 foot section of the side-
walk abutting the business property at the above referenced address to accomo-
date outside restaurant seating. The proposal is for 2 larger tables seating
4 each or 4 smaller tables seating 2 each. The maximum number of seating will
be 8.
Provided the City Attorneys' Office and the Risk Analyst do not find problems
with the request, this office finds no major problems relative to the Public
Works aspect of the proposal. The proposal allows ,for approximately 6' of un-
obstructed sidewalk area between the Main Street curb and the outside seating
area. City policy is to require 7' wide sidewalks in commercial areas. There-
fore, the proposal would reduce this requirement by a little over one 'foot.
The Public Works Department has special permit agreements for private use of
the public right-of-way. We will compose an agreement between the City and
Tim 'N Tilda's for approval by the City Attorney should the City City Council
approve the request. Please refer to the attached copy of a sample agreement.
