Dear Mr. Cloud,
The business space located at the above address, more particularly described as Lane
County Assessor's Map & Tax Lot number 17033542-08000, violates section 201 (e) &
301 (a) of the Springfield Building Safety Code. Our records indicate that no pennits or
inspection approvals were obtained to convert the rear of the business space to a
residential living unit. During my visit to your property, you stated to me that the living
unit existed at the time you purchased the property in 1993, but that you had perfonned
some rough electrical work which included installing an additional electrical service
panel. There are no pennits on file for the work prefonned prior to your purchase of the
property, or for the electrical work you have perfonned.
The Springfield Development Code (SDC) section 18,020 (8) allows "Residential uses in
areas designed mixed use in the Metro Plan or Refinement Plans (as a special use with
the conditions listed in 18.110 (6). Section 18.110 (6) of the SDC provides "In areas of
mixed use in the Metro Plan or Refinement Plans, multiple family development shall be
required to meet development standards as specified in the local refinement plan." The
Downtown Refinement Plan reads in part: "Residential uses shall be pennitted on the
second floor and higher." Your residential living unit is on the first floor, thus not
complying with second floor or higher requirements. '
In order for something to be considered as a legal non-confonning use, the current non-
confonning use had to be a legal and pennitteduse at some point in time, As stated
earlier, research of our records reveals no prior approvals given or building pennits
obtained for the living unit modifications at this address. Subsequently, the one bedroom
living unit located on the property must be vacaied. Pennits shall be obtained within 30

days for the removal and a request for inspection approvals performed within 60 days
from the date of this notice. If you do not seek corrective action within the time frame
outlined above, the City may seek compliance with the Building Safety Codes through
legal recourse, which may include Municipal Court Proceedings.
