ISSUE
The P1anmng COnllTIlSSIOn IS requested to conduct a publIc hearing for a request to vacate a 66-foot WIde by
264-foot long segment ofB Street located between 4th Street and PIOneer Parkway East. The Planmng
CommISSIOn wIll deCIde whether to adVIse the CIty CouncIl to approve, approve WIth condltlons or deny the
request.
DISCUSSION
On February 28, 2006, the Spnngfield CIty CouncIl conSIdered four SIte optlOns for the JustIce Center project.
The SIte optIOn selected by the CIty CouncIl utllIzes CIty-owned property whIch IS located between 4th Street
and PIOneer Parkway East, and which extends from A Street to the mId-block alley north ofB Street. The
selected SIte option mcorporates a one-block segment of B Street nght-of-way into the development area for use
as .:. Jecure polIce parkmg lot, and a bUl1dmg pad for an ancIllary bUlldmg servmg the Justlce Center.
The CIty CounCIl, by way of the Plannmg CommIssIon, recently adopted amendments to ArtIcle 9 (Vacatlons)
ofthe Spnngfield Development Code (Ordmance 6191, dated Apnl 2, 2007). The adopted amendments are
speCIfic to vacatlons of public nght-of-way where a greater publIc need IS demonstrated and the vacated nght-
of-way WIll remam m pubhc ownershiP. The Code amendments adopted by Ordmance 6191 were effectIve
May 2, 2007
The CIty CouncillUltIated the street vacation actlOn (Case LRP2007-00019) at the regular meetmg on May 7,
2007. The pubhc nght-of-way proposed for vacatlOn conSIsts ofa 66-foot WIde by 264-foot long segment ofB
Street extendmg from the western edge of the 4th Street nght-of-way through to the eastern edge oftl}e Pioneer
Parkway East nght-of-way. The street IS located unmedlately to the north of the pubhc and pohce vehIcle
parkmg lots servmg the CIty-owned bUl1dmgs frontmg onto A Street There are eXlstmg publIc utlhtIes wlthm
the street that are proposed to be relocated m conJunctlOn WIth constructIOn of the Justlce Center. A Lane .
TranSit Dlstnct bus stop IS located on the north SIde of the nght-of-way near the mtersectlOn with PlOneer
Parkway East.
RECOMMENDATION
Staff recommends approval ofthe yacatIon request based on the attached findmgs.
ACTION REQUESTED

REQUEST
The vacatIOn of a 66-foot wIde by 264-foot long portion of street nght-of-way.
LOCATION OF PROPERTY
The segment ofB Street right-of-way (ROW) proposed to be vacated is located west of 4th Street and east of
Pioneer Parkway East in downtown Spnngfield. The publIc nght-of-way lIes on the boundary between Tax
Map 17-03-35-24 and Tax Map 17-03-35-31.
BACKGROUND
The affected segment ofB Street was created as public nght-of-way wIth plattmg of the origmal Map of
Spnngfield m 1872. There are eight CIty-owned propertIes (Tax Map 17-03-35-24, Tax Lots 13900, 14000,
14100 and 14300; and Tax Map 17-03-35-31, Tax Lots 1500-1800) that have frontage on the nght-of-way area
proposed for vacatlon. From a functlOnal perspective, the subject nght-of-way IS part of the downtown gndded
street system and IS designated as a City collector street.
SPRINGFIELD DEVELOPMENT CODE CRITERIA
Spnngfie1d Development Code (SDC) 9.060(3) establIshes criteria for vacatlon ofnght-of-way where the
property will remain m publIc ownershIp and wIll contmue to be used for a publIc purpose. The followmg
findmgs address each of the criteria.
(a) The Vacation was initiated by the City Council pursuant to ORS 271.130(1);
Fmdmg 1: Oregon RevIsed Statutes (ORS) Sectlon 271.130(1) reads as follows: "The city goverl1lng body may
mltiate vacatwn proceedmgs authonzed by ORS 271 080 and make such vacatwn wahout a petllLOn OT consent
of property owners. Notlce shall be glven as provided by ORS 271 110, but such vacatwn shall not be made
before the date set for hearmg, nor if the owners of a majonty of the area affected, computed on the basls
provided m ORS 271 080, object in wnting thereto, nor shall any street area be vacated without the consent of
the owners of the abuttmg property if the vacatwn will substantwlly affect the market value of such property,
unless the Clty governmg body provides for paYl11g damages Proviswn for paying such damages may be made
by a local assessment, or in such other manner as the Clty charter may provlde."
Findmg 2: ORS 271 080(1) prOVIdes for vacation of". .all or part of any street, -avenue, boulevard, alley, plat,
publzc square or other pubhc place. " In accordance With ORS 271.080( I), the vacation actlOn requrres "a
descnptwn of the ground proposed to be vacated, the purpose for whlch the ground lS proposed to be used and
the reason for such vacatwn."
Fmdmg 3. The Spnngfield CIty Council inltlated the vacation actIOn at the regular meetmg on May 7,2007.
The nght-of-way proposed for vacation IS generally depicted and more specifically descnbed in Exhibit A to
thIS staff report. The purpose of the vacatlon is to retam the segment of vacated publIc nght-of-way in public
ownership, and to use the area for constructlOn of a secure police parkmg lot and ancIllary bUlldmg servmg the
Justlce Center.
Fmdmg 4. In accordance with ORS 271.130(1), the declSlon on the vacation action WIll be made at a future CIty
CouncIl meetmg, and after Public Heanngs before the Planmng CommISSIOn and CounCIl.

cIrculatIOn (The Register Guard) on May 18 and 25, 2007.
Fmding 7' In accordance WIth 271.110(2), publIc notlce of the proposed nght-of-way vacatIon actlOn was
posted at two conspicuous locatIOns immedIately adJacent to right-of-way proposed for vacatlon (at the
northeastern comer adJacent to 4th Street, and at the southwestern comer adJacent to Pioneer Parkway East).
Findmg 8. In accordance WIth SDC 271.080, adJacent landowners and reSIdents/tenants within a 400-foot radIUS
of the 66-foot by 264-foot linear right-of-way proposed for vacation were notlfied by mall.
ConcluslOn: The notificatIOn proVIded for the proposed nght-of-way vacation complIes WIth Cntenon (b).
(c) Approval of the vacation would be consistent with provision of safe, convenient and reasonably direct
routes for cyclists, pedestrians and vehicles as provided in OAR 660-0012-0045(3);
Fmdmg 9: As stated m Oregon Admmistrative Rules (OAR) 660-0 1 2-0045(3)(d), "safe and convel1lent" means
bicycle and pedestrian routes, facilities and lmprovements whlch:
(A) Are reasonably free from hazards, partlcularly types or levels of automobile traffic which would
lI1teTfere WIth or dlscourage pedestnan or cycle travelfor short trips,
(B) Provlde a reasonably direct route of travel between destmations such as a transit stop and a
store, and
(C) Meet travel needs of cychsts and pedestrians conslderll1g destination and length of tnp, and
consldermg that the optimum tnp length of pedestrians lS generally % to 'l'2 mzle.
Fmdmg 10' In accordance with OAR 660-012-0045(3)(d), vacatlOn of the subJect nght-of-way and closure to
publIc travel would not mterfere WIth or dIscourage pedestnan, cycle or vehicle travel on the adJacent publIc
street system due to exceSSIve traffic or other unusual hazards. East-west traffic CIrculation can be
accommodated on adJacent local and collector streets - partIcularly A Street, whIch IS located less than 300 feet
to the south.
Fmdmg 11 In accordance WIth OAR 660-0l2-0045(3)(d), vacatlOn of the subJect nght-of-way would not result
m pedestnan, cyclIst or verucle tnps that are more than 1,4 mIle from bemg a dIrect route of travel between
destmation pomts. FIgure 1 Illustrates approxunate travel distances for all potentIal modes of travel from one
side of the vacated nght-of-way to the other. Should the segment ofB Street be vacated and closed to publIc
travel, the maxunum out-of-dlrectlOn dIstance for passage from the eastern end of the subJect nght-of-way (at 4th
Street) to the western end of the right-of-way (at PlOneer Parkway East) would be about 600 feet (<118 mIle) for
bIcycles and verucles usmg surface streets VehIcles and bIcycles have the optIOn of usmg eIther A Street or C
Street for the east-west segment of the tnp. The out-of-dlrectIon dIstance would be even less for pedestnans
usmg the publIc SIdewalk system, or bIcycles and vehIcles passmg through the mId-block alley north of B Street.
The use ofthe mId-block alley for east-west passage is not a preferred route for vehIcles, but is depicted on
Figure 1 for lllustratlve purposes.

street, alley and sIdewalk system. The approximate travel dIstances shown on Figure 1 assume travel around the
penmeter of each route, and short-cuttmg through parking lots or sImilar open areas IS not consIdered.
Fmdmg 13. There are eXlstmg SItuatIOns m downtown Springfield and elsewhere throughout the CIty where
portIOns of the gndded street system are not connected and out-of-dlrectIOn travel is reqUlred for cyclIsts,
pedestnans and vehicles Nearby examples include portIOns of A Street east of lth Street; A, C, D and F Street
east of 14th Street, 8th and 9th Streets north ofG Street, and G Street west of 4th Street.
Fmdmg 14' A Traffic Impact Analysis (TIA) was prepared by an mdependent traffic engineenng consultant m
support of the proposed nght-of-way vacatIOn (Sprll1gfield Justlce Center Revlsed Task 2 Report - Traffic
Impact Study, Access Engmeering, July, 2006) The TIA exammed the eXlstmg and post-vacation street system
m the viclllity of the Justlce Center and evaluated the pOSSIble impacts of the proposed nght-of-way vacatIOn to
vehicle movements and the performance of nearby mtersectIOns The TIA concluded there would be mimmal
lUlpact on the downtown transportation system WIth the proposed vacatlOn of publIc nght-of-way.
Fmdmg 15 The TIA prepared for the proposed nght-of-way vacatlon also concluded that no traffic nutigatlOn
actlOns would be required to ensure safe and efficIent flow of traffic m the vicmlty of the Justlce Center
Among the sunplest and most effectIve measures to structure traffic movements m the area wIll be strategic
placement of dIrectional signage for the Justlce Center. The TIA suggests possible measures to dIscourage
traffic from trave1mg to and from the downtown core usmg nearby residential streets, includmg placement of
STOP SIgns at key mtersectlOns and mstallmg curb extenslOns to prevent undesirable turning movements.
Fmdmg 16. Special vehIcles, such as tranSIt buses, can be accommodated on adjacent public streets (pnmanly
A Street). There IS one transIt stop for west-bound buses that is located withm the segment ofB Street plOposed
for vacatlOn. RelocatlOn of the bus stop can be done m consultatlOn With Lane TranSit Distnct.
ConcluslOn: Staff have concluded that the proposed right-of-way vacatlon WIll have no adverse effect on safety,
connectivIty or mamtaining reasonably dIrect travel routes for pedestrians, cyclIsts and velucles. As proposed,
the public nght-of-way vacatIOn complIes WIth Critenon (c)
(d) Whether a greater public benefit would be obtained from the vacation than from retaining the right-
of-way in its present status; and
Fmdmg 17: The nght-of-way presently contains a two-lane collector street with SIdewalks on both SIdes Upon
vacatlOn of the nght-of-way, the subject area would be mcorporated mto the Springfield Justlce Center and used
for secure pohce parkmg. The nght-of-way would be closed to all publIc travel The Spnngfield PolIce
Department adVises that a secure parking lot - close to the Justlce Center buildmg - protects pubhc property
(mcluding pohce vehIcles and case eVIdence stored m the anCIllary bUlldmg) and enhances emergency response
tunes as respondmg officers do not have to cross publIc streets to reach theIr verucles.

vacatIOn (Attachment 2) which reads as follows.

Fmdmg 19. As described m the statement from the PolIce ChIef, the vacated right-of-way will be used for
secure polIce parkmg and IS also desIgned to prOVIde a fenced-m area that is large enough for evacuatIOn of Jail
prisoners m the event of an emergency ProvlSlon of a secure muster area for evacuated pnsoners provides a
dIrect benefit to the Jail staff, polIce personnel, and the publIc.
Fmdmg 20. As noted m the PolIce ChIefs statement, ensunng respondmg police officers do not have to cross a
publIc street m order to reach their vehIcles enhances safety for both Police Department personnel and publIc
users of the street system.
Fmdmg 21: Passage of the PublIc Safety ballot measure in 2005 that secured publIc fundmg for the Justice
Center proJect demonstrates Spnngfie1d reSIdents' commItment to the proJect. Comparatively few people wlthm
the CIty regularly use the segment ofB Street proposed for vacation. However, all Spnngfie1d reSIdents (and
viSItors) benefit from a strong polIce presence within the commumty.
ConcluslOn. Staff have concluded that the proposed nght-of-way vacatIOn serves a greater benefit to the public
than retammg the one-block segment of right-of-way m ItS present status The proposed vacatlOn also proVIdes
direct benefits to the CIty'S PolIce Department, whIch u1tlmate1y benefits Spnngfield residents As proposed,
the nght-of-way vacation complIes WIth Cntenon (d).
(e) Whether provisions have been made to ensure that the vacated property will remain in public
ownership.
Fmdmg 22: The vacated nght-of-way IS to be incorporated mto the Justlce Center development, whIch IS a
publIcly-funded proJect OwnershIp ofthe Justlce Center bUl1dmg and the land on whIch It IS to reSIde (whIch
mcludes the portIOn ofnght-of-way proposed for vacatIOn), IS to remain WIth the City of Spnngfield.
Fmdmg 23: Upon vacatlOn of the nght-of-way, the land ownershIp automatically reverts to the CIty as It owns
the abutting property. Because the ownersrup of the vacated nght-of-way does not pass through a trurd party
(wluch could occur If there were pnvately-owned parcels frontmg onto the nght-of-way), remaming m publIc
ownership is assured.
Conclusion The proposed right-of-way vacation complIes with Cntenon (e).

SUBJECT: Importance ofB Street Closing to the Justice FacilIty Project
The purpose of thIS memo is to summarize for the Planning Commission the importance closmg
B Street as part of the Justice Center proJect. As designed, the area currently occupied by B
Street would become part of a fenced and secured parking area.
. Closing B Street is necessary for the security of portIOns ofthe facility: The planned
JustIce facility includes an ancillary building that will be a repository for evidence m
criminal cases; storage for police and court records; and storage for specialized police
equipment and weaponry. Closing B Street will allow the entIre ancillary bUIlding and
parkmg lot to be fenced m, significantly improving the security ofthese records and
eVIdentiary Items. Without the security fencing in place, the ancillary building as
designed does not prOVIde sufficient secunty for these items.
. C10smg B Street will provide secure fleet and employee parking: To date, Department
vehicles and employee parking has not been secured by fencing. While this does not
cause significant issues during normal working hours, the Department has experienced
damage to fleet vehicles, and employees have suffered damage to their personal vehicles,
during late evenmg and early mornmg hours. Damage has ranged from pamt scratches to
slashed tires and broken windows.
. Closmg B Street will improve the safety of police officers and citizens: The street
closure WIll allow officers responding to emergency calls from inside the building to
access theIr vehicles without crossing a public right of way, thereby reducmg the risk of
an accident dunng an emergency response.
. Closing B Street will provide a secure area for evacuation of municipal jail pnsoners:
The fenced area WIll serve as an outdoor holding area for municipal jail prisoners m the
event that the jail must be evacuated. Without the street closure and fencing, there wIll
not be an area outside the municipal jail adequate and accessible for holding prisoners.
Instead, an evacuation event would necessitate the uncontrolled release of all municipal
jail prisoners.

2 The applIcation was imtlated in accordance with SectIOn 3 050 of the Spnngfield Development Code
Timely and sufficient notice of publIc heanng, pursuant to SectIOns 14030 and 9.050 of the Springfield
Development Code, has been provided
