",ON REQUIRED There is an intake screening process and a detailed completeness check: 1. An intake screening process will be conducted at the front counter at the time of submittal. Planning DIvision staff will determine whether all required items listed in the Tentative SubdiVision Submittal Requirements Checklist have been submitted. An application for submittal not having all of the required items will not be accepted. 2. A detailed completeness check will be conducted within 30 days of submittal. In this case, the assigned Planner will notify the applicant in writing concerning the completeness of the application. An application will not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. Incomplete applications will delay the application review process and may result in denial. THE APPLICATION PACKET (a) A complete application page; (b) Application fee-refer to the Development Code Fee Schedule for the appropriate fee calculation formula. A copy of the fee schedule is available at the Development Services Department; (c) A legal description of the public rights-of-way, easement or plat to be vacated prepared by an Oregon Licensed Land Surveyor or other professional approved by the Director; (d) The reason for the Vacation; (e) The proposed use of the property after Vacation; (f) For citizen initiated Vacations of public rights-of-way or Partition and SubdiVision Plats, the petition of affected property owners; (g) Fifteen (15) copies of a map prepared by an Oregon Licensed Land Surveyor or other professional approved by the Director of the area proposed to be vacated. The map shall show: 1. The date, north arrow, and standard scale; 2. The Assessor's Map and Tax Lot numbers of the affected properties and adjacent properties; 3. A Vicinity Map on the Site Plan (Vicinity Map does not need to be to scale); 4. All adjacent streets including street name, alleys, and accessways, and right-of- way and paving widths; 5/11/07 Page 2 of5 Date Received:--i;/ ~7 Planner: AL ;\' 5. All dlmension~ ...( existing public utility easements and any other areas restricting use of the parcels, such as conservation areas, slope easements, access easements, etc.; 6. Existing dimensions and square footage of the lots/parcels involved; 7. Proposed dimensions and square footage of the lots/parcels involved (applies to Vacations of undeveloped Subdivision Plats and right-of-way Vacations); 8. For public easement and right-of-way Vacations, clearly show dimensions of entire easement or right-of-way on or adjacent to the subject lots/parcels. Also clearly show dimensions of that portion proposed for Vacation, including square footage; and 9. For right-of-way Vacations, demonstrate compliance with the boundary requirements of ORS 271.080 et seq. 10. The legal description of the easement, right-of-way or Plat, or portion thereof, proposed to be vacated. (h) One additional copy of the map which has been reduced to 8 1/2" x 11" to be mailed as part of the neighboring property notification packet. (i) A separate written statement demonstrating the request satisfies ~ach of the following criteria: (a) The Vacation shall be in conformance with the Metro Plan, TransPlan, the Conceptual Local Street Map and adopted Functional Plans, and applicable Refinement Plan diagram, Plan District map, or Conceptual Development Plan; (b) The Vacation shall not conflict with the provisions of Springfield Municipal Code 1997; and this Code, including but not limited to, street connectivity standards and block lengths; and (c) There shall be no negative effects on access, traffic circulation, emergency service protection or any other benefit derived from the public right-of-way, publicly owned land or Partition or Subdivision Plat. (j) Refer to the following page for additional submittal requirements specific to the type of vacation requested. 5/11/07 Page 3 of5 Date Received: S' /,/2007 Planner: Al I I \' For Public Right-c.,..-Way Vacations: " The consent of all abutting property owners and not less than owners of two- thirds of the affected property (in area). Affected property IS: (1) The land lying on either side of the street or portion of the street proposed to be vacated and extending to the next lateral street (not to exceed 200 feet, as measured from the street nght-of-way). (2) Where a street is proposed to be partially vacated, affected property also includes land on both sides of the street for a distance of 400 feet beyond the portion of the street proposed to be vacated. (3) Where a street is proposed to be entirely vacated, the land which would be included in an extension of the street for a distance of 400 feet beyond each end will also be counted. A report from a title company will be required showing the names of all persons having an interest in the abutting and affected property. All abutting property owners and two- thirds of the affected property owners must sign Consent to Vacate Forms (see attached). The signatures must be notarized. For Plat Vacations: (1) The consent of the owner or owners of two-thirds in area of the property within the plat or part of the proposed area to be vacated. (2) A certificate showing that all city liens and taxes have been paid.
