CONVEYANCE OF EASEMENT
THIS INDENTURE WITNESSETH, That the City of Eugene acting by and through
EUGENE WATER & ELEcl KIC BOARD, GRAl\TTOR, does hereby give and grant unto
DAREN ENGEL and BILLIE ENGEL, it's successors and assigns, GRANTEE, a perpetual
easement for roadway purposes, upon and across the follo'~ring ckscribed real property, to-
wit:
A parcel of land lying in the Northeast one-quarter of SectIon 26, Township 17 South,
Range 3 West of the Wlllamette Meridian, in Springfield. Lane County, Oregon. Said
parcel being 40 feet in width and being mort particularly descri~ed as follows:
Beginning at the Brass Cap monument marking the Soulheast corner of the
Jacob Halstead DonatlOn Land Claim No. 47, Towr..ship 17 South, Range 3
\Vest of the Willamette Meridian; thence North 00' 14' 20" East 147.44 feet
to the projected position of the Southwest corner of the WIlliam C. Spencer
Donation Land Claim No. 50 in said Township a:1d Ra.Jge; thence North
1486.53 feet; thence Ea~t 485.71 feet to a point marke:~ by a rallroad rall
driven in the ground to mark the NOl'therly Right-of. \Vay Ene of the Eugene
Water & Electnc Board [EWEB] Right-of-Way, said rall being 30 feet from,
when measured at right angles to, EWEB's Engineer's Centerline Station
200 + 33.58; thence North 79' 48' 50" E.iS~ 61.00 feet along the Northerly line
of said EWEB's Right-of-Way to the TRUE POIN'f OF BEGINNING; thence
continuing along said Northerly Rigr.t-of-Way Nonh 79' 48' 50" East 40.64
feet to a point; thence South 60.96 feer of a point on the Southerly Right-
of- Way; thence SGlth 79' 48' 50" West 40.64 feet along said Southerly Right-
of- Way to a poii!t; thence North 60.96 feet to the TRUE POINT OF

The location of the above descnbed easement area is shO\JI' on lhe attached Drawing "A-
12629-1", as EXHIBIT "A".
GRANTEE, its contractors, subcontractors, agents or emplc.yees, shall have the right to go
upon said real property for the purpose of constructing and maintaining said roadway; and
said roadway shall be so constructed so as to do no damagt' to said real property and those
improvements owned and maintained by GRANTOR, amI after the construction of the
facilities, the easement area shall be left in as good condition as before the construction of
said facih tIes.
GRANTOR, its agents aId employees, shall retain the right "0 permanently construct,
reconstruct, and maintain its faCIlities over, under, upon, and across said easement area.
