DECLARATION AND GRANT OF PRIVATE EASEMENTS
FOR SETBACK, MAINTENANCE AND ACCESS:
LOT 47 , LEVI LANDING SECOND ADDITION
GRANTOR: Donald D. Parker and Jeff Bantz-
GRANTEE. City of Springfield and the Levi Landing Homeowners' Association
. RECITALS;:
1.
Declarant: The private easement for maintenance and access described herein are
declared and granted by Donald D. Parker and Jeff Bantz . to the City of
Springfield and the Levi Landing Homeowners' Association, an Oregon nonprofit
corporation ("Grantee"). .

Purpose: ThiS instrument establishes private easements for setback, maintenance and
access as shown on Exhibit "A" attached hereto.

4, Consideration: The consideration for this easement is other than monetary.
WITNESSETH:
NOW THEREFORE, in consideration of the foregoing recitals, which are expressly made a part of
this declaration, the undersigned hereby declares as follows:
1. DECLARATION AND GRANT OF EASEMENT: There is hereby declared and conveyed
from Grantor to Grantee a nonexclusive private easement for maintenance and access as
shown on Exhibit "A" and as more particularly described in attached Exhibit "B".
2. The purpose of this easement is for the maintenance of the stepped retaining wall along
the No Fill No Build line.

3. The property crossed ("burdened") by said easement is, as to each easement, that part of
Lot 41 ,Levi Landing Second Addition as platted and recorded in File 75, Slides 1152 -
1155, Lane County Oregon Plat Records in Lane County, Oregon as shown on Exhibit "A"
and described in Exhibit "B".
4. The properties served ("benefitted") by said easements are lots 34 - 113, inclusive, of LevI
Landing Second Addition as shown on Exhibit "A".
5. Said easement is perpetual, is not personal or in gross but is appurtenant to each and
every portion of the properties benefitted.
6. Said easement shall run with the property herein described and shall be binding on and
inure to the benefit of the parties hereto, their heirs, successors, or assigns.
7. Said easements are hereby granted for the purpose of resolving a dispute between the City
of Springfield and the Trustee regarding the location of dwellings and structures on the
Subject Property described In Recital 2 above The dispute involves an action filed In Lane
,County CirCUit Court by the Trustee against the City of Springfield (Case No. 16-02-18933)
which has been settled by the execution and filing of a Stipulated Judgment of Dismissal
("the Stipulation"). Pursuant to the terms of the Stipulation, Trustee declares and grants
easements, subject to the restrictions described herein, over a five-foot Wide strip of land
on the burdened properties, as shown on Exhibit "A" and described in Exhibit "B" (the
easement area"). No structure temporary or permant of any kind whatsoever, including
bUilding siding, shall be allowed Within the easement areas except that: a) any portion of a
structure may extend into the easement area so long as it IS entirely eight feet or more
above the finIsh grade of the easement area and no portion of the overhang extends over
the No Fill no BUild line; b) below grade footings for a reSidential structure may be placed
Within the easement area These easements include an affirmative duty on the part of the
owners of Lots 50 and 57-59 to construct a second riser to the stepped retaining wall in
accordance With the requirements of the profile set forth on Exhibit A. The City of
Springfield shall also have the nght and standing to secure judicial recognition and
enforcement of the rights granted by thiS Declaration, and these easements shall not be
affected or negated by title or the merger of title of the dominant and servient properties In
a common owner
8 Grantor shall at all times, and Without restriction, have the right to use the easement for
purposes not inconsistent with the easement and other applicable restnctlons of record.
9 The maintenance and repair of said easement shall be the responSibilIty of Grantor untIl
such time as responSibility therefore IS assumed by the Levi Landing Homeowners
ASSOCiation.
10 The easement created hereby shall be exercised In a manner consistent with applicable
local, state, and federal regulations and permits and With all other conditions, easements,
and restnctlons of record. Including but not limited to the conservation easement for the
Levi Landing 2nd Addition conservation and open space area and the supplemental
declaration of conditions, covenants, and restrictions for Levi Landing 2nd AddItion recorded
concurrently With thiS declaration
