BACKGROUND
The onglnal site plan, DRC2002-05128, was approved to construct a two-phase
development Including two bUildings, parking and landscaping. Phase I has been
completed.
PROPOSED MODIFICATIONS
-
The proposal only affects Phase /I of Sports Way Busmess Park The applicant IS
proposmg the followmg modificatIOns
1. The Phase II building has been moved approximately 15' toward the northwest
main dnveway This eliminates the landscaping on the north side of the bUilding
and reduces the sidewalk to 5 feet wide
2 The area on the south side of the Phase II bUilding has been changed from a
lawn, patio and landscaped area to parking and landscaping
DECISION
Prellmmary Site Plan Modification approval as of the date of this letter
SITE INFORMATION
The subject property rnvolved rn thIS request IS Phase" of Sports Way Busmess Park,
Assessor's Map #17-03-15-32 Tax Lot s 200,300 and 400 (also Land Partition Plat
2005-P1900) The property IS located Inside the city limits between International Way
and Sports Way
CRITERIA FOR APPROVAL
1. The zoning is consistent with the Metro Plan Diagram andlor the applicable
Refinement Plan Diagram, Plan District map and Conceptual Plan.
Finding 1 The Community CommerCial (CC) zoning IS consistent with the Gateway
Refinement Plan (CC).
2. Capacity requirements of public improvements, including but not limited to,
water and electricity; sanitary sewer and stormwater management facilities;
and streets and traffic safety controls shall not be exceeded and the public

improvements shall be available to serve the site at the time of development,
unless otherwise provided for by this Code and other applicable regulations.
The Public Works Director or a utility provider shall determine capacity issues.
Finding 2. No changes have been made to the approved site plan-that would effect
this cntenon
3. The proposed development shall comply with all applicable public and private
design and construction standards contained in this Code and other
applicable regulations.
Finding 3 The proposed modifications to the onglnal site plan affect parking
standards and landscaping No other Improvements to the onglnal site plan are being
modified.
Finding 4 The onglnal site plan submitted shows the required number of parking
spaces for both phases at 172 plus 4 handicapped spaces JOint-use parking
agreements have been signed The current proposal Increases the actual number of
parking spaces from 180 to 191 plus 6 handicapped spaces
Finding 5 The required amount of Intenor parking lot landscaping IS five percent The
proposed parking lot Intenor landscaping IS 9 percent. Other required landscaping
has not been modified
Finding 6 The applicant has reduced the size of the sidewalks along the north and
south sides of the bUilding to 5 feet To conform to SDC 31 190(3), wheel bumpers
must be added to the parking spaces abutting these sidewalks
Finding 7 The onglnal site plan showed wheel bumpers for parking spaces on both
~ - _Sides of the landscaping located In the mIddle of the Phase II parking lot The
bumpers are not shown on the spaces on the west side of that parking area on the
modified plan.
Condition of Approval:
Show wheel bumpers on parking spaces abutting the sidewalks on the north and
south sides of the bUilding, and on parking spaces abutting the landscaping In the
middle of the Phase II parking lot (SDC31 190(3))
Conclusion' As conditioned, the proposed modifications to the site plan comply With
Cntenon 3
4. Parking areas and ingress-egress points have been designed to: facilitate
traffic, bicycle and pedestrian safety to avoid congestion; provide connectivity
within the development area and to adjacent residential area, transit stops,
neighborhood activity centers, and commercial, industrial and public areas;
minimize curb cuts on arterial and collector streets as specified in this Code or
other applicable regulations and comply with the ODOT access management
standards for state highways.

Finding 8 Staff has reviewed the plans and concluded the additional parking has
been designed to facilitate pedestnan and traffic safety All parking proposed IS
Internal and does not affect access to and from a public street Therefore the plans
submitted comply with cntenon 4.
5. Physical features, including but not limited to, significant clusters of trees and
shrubs, watercourses shown on the Water Quality Limited Watercourse Map
and their associated riparian areas, wetlands rock outcroppings and historic
features have been evaluated and protected as specified in this Code or other
applicable regulations.
Finding 9 This cntenon does not apply because there are no physical or hlstonc
features on the site.
DEVELOPMENT AGREEMENT In order to complete the review process, a
Development Agreement IS required to ensure that the terms and conditions of site plan
review are binding upon both the applicant and the City This agreement will be
prepared by Staff upon approval of the Final Site Plan and must be signed by the
property owner pnor to the Issuance of a bUilding permIt.
CONDITION OF APPROVAL
1 The applicant shall provide five (5) copies of the Modified Final Site plan within
90 days of the date of this Jetter Incorporating the above Condition of Approval
