I. GENERAL PROJECT INFORMATION
This Development Issues Meeting request is submitted pursuant to the applicant's desire to apply
for annexation of property at 32nd and Jasper Roads under the 2008 Oregon Revised Statutes
and under the amended Springfield Development Code. The applicant originally submitted an
annexation request for the property on September 28, 2007, Springfield Journal Number
LRP2007-00029, under the Statutes and Code in place at that time.
Subiect Site
The subject site consists of five properties identified as Tax Lots 3500, 3600, 3701, 3900 and
4000 of Lane County Assessor's Map 18-02-06-24. The area so defined will be referred to in this
application as the subject site. The site is within the Urban Growth Boundary and contiguous to
the Springfield City Limits'.

II. LAND USE REQUEST
This request for a Development Issues Meeting (DIM) is submitted as a pre-requisite to a Type
IV Annexation and as an opportunity to clatify issues regarding the contemplated development.

The subject site includes approximately 12.3 acres and consists of Tax Lots 3500, 3600, 3701,

3900 and 4000, all on Lane County Assessor's Map 18-02-06-24.
The applicant submitted an annexation request September 28, 2007 (annexation application
catalogued as Springfield Journal No, LRP2007-00029). Staff now advises (February 11, 2008
communication, attached) that it is necess~ to submit a new application and to execute an
annexation agreement before the new applidtion.
It appears the annexation agreement is the critical path in terms of processing the annexation
request in a timely fashion. Therefore, in light ofthe situation, it is to the applicant's best interest
for staff to resume drafting the annexation a~reement as soon as possible.
Contingent upon approval of the requested annexation, the applicant anticipates developing the
subject site as a residential subdivision unddr the cluster subdivision regulations contained in the
Springfield Development Code.
Questions for City staff are listed in Attachment A.
The remainder of this narrative provides basic information regarding the site and the
development contemplated for the site. A list of questions is provided herewith.

III. THE SITE AND EXISTING CONDITIONS
Location
The subject site is located south of the inteisection of 32nd Street and Jasper Road and west of
Kintzley Avenue.

Ownership of the subject tax lots is as follows:
o Lots 3500 and 3600 are owned by Alta M. Mason, John L. Mason, and Seldon T.
Mason;
· Lots 3701 and 3900 are owned by Sheldon Mason and Alta M. Mason; and
. Lot 4000 is owned by John L. Mason.
Plan Designation. Zoning and Use
The adopted Eugene-Springfield Metropolitan Area General Plan (Metro Plan) Diagram
designates the development area as Low-Density Residential and within the Urban Growth
Boundary (UGB). The properties are not within the area of any neighborhood refinement plans.
All five properties are zoned LDR Low Density Residential on the Springfield Zoning Map and,
because they are within the UGB, the UF-lO Urbanizable Fringe Overlay District applies to all
five properties. Per Springfield Development Code Section 3.3.81O(B)(2), the UF-lO Overlay
District shall cease to apply after annexation to the city.
All five tax lots are vacant. Tax Lots 3600 and 3900 were previously developed with one single-
family residence on each lot. Both structures have been demolished.
Context
The north side of the subject site abuts Jasper Road with approximately 300 feet of street
frontage. Jasper Road is classified as a minor arterial on the Springfield Street Classification
Map. Jasper Road is the southern city limit at this point and the subject site is therefore
contiguous to the City of Springfield. The east side of the subject site has approximately 490 feet
of frontage on Kintzley A venue, a local access road that is outside the City limits but inside the
urban growth boundary. It is the applicant's understanding that Kintzley Avenue is subject to
mtergovernmental agreements between the City of Springfield and Lane County and is therefore
considered to be within the jurisdiction of the City of Springfield. Kintzley Avenue is partly
developed with single-family detached homes. The south side of the subject site abuts the urban
growth boundary. Properties contiguous to the southwestern side of the site are outside the city
limits but inside the urban growth boundary and primarily undeveloped. One property
contiguous to the northwestern comer of the site is owned by the City, is within the City limits
and contains a pond.

The southwestern comer ofthe subject site includes a portion ofthe Jasper Slough. The Local
and National Wetlands Inventory Maps for Springfield show this portion ofthe Slough is on the
Local Wetlands Inventory but not on the NatIonal Wetlands Inventory. It is the applicant's

understanding that the site includes areas in the 100-year and 500-year floodplains (FIRM Map
41039Cl161F). In addition, Jasper Slough is shown on the Water Quality Limited Watercourse
Map as a tributary to a Water Quality Limited Watercourse. Groundwater protection, specifically
I
Time of Travel Wellhead Protection for the 'Villamette Wellfield, is discussed in the attached
List of Questions (Attachment A).
Utilities
We have obtained existing utility data from tIe City of Springfield. Plan Sheet L2, submitted
herewith, documents utility locations. As sho1wn on Sheet L2 and as indicated by city staff and
Springfield Utility Board personnel (please refer to Springfield Journal No.'s ZON2006-00045
and LRP2007-00029), the subject site can be served by the orderly extension of key urban
servIces.
IV. PROPOSED USE
The proposed use after the desired annexatio 1 is as a low-density residential subdivision of
single-family detached homes using the Cluster Development policies contained in the

Springfield Development Code at SDC 3.2.2BO and the subdivision standards at SDC Section
5.12.100.
V. APPLICABLE CRITERIA AND FINDINGS
It is the applicant's understanding that the ap )licable criteria for the contemplated development

DIM Ouestions
1. New Rules for the Annexation Process. The applicant applied to annex the subject site in
September 2007 (LRP2007 -00029) and City staff held a Development Review Committee
meeting (October 23rd, 2007), but the city was not able to process the application forward to the
Lane County Local Government Boundary Commission before the commission stopped
receiving applications at the end of 2007. Previously, the Boundary CommIssion coordinated
with the city to process Extra-territorial Extensions. Under the new rules for the annexation
process, what is the mechanism for extra-territorial extension of urban services in Kintzley
Avenue? How else will changes to the process affect this annexation?
2. Timely Processing. Considering the applicant submitted the application to annex the subject
site (LRP2007 -00029), along with the required application fees, in good faith more than six
months ago, and considering nothing about the applicant's submittal caused or resulted in either
the delay or the requirement to repeat the entire process, what consideration can the city provide
in order to process the applicant's annexation agreement in a timely fashion? Is it possible to
process it before processing other annexation applications received after September 28,20077
3. Annexation Agreement. Many issues affecting the subject site were already discussed among
city staff, Springfield Utility Board (SUB) staff, Willamalane Park & Recreation District staff
and the applicant and project team. Issues mclude:
· Riparian areas and a portion of Jasper Slough in the propeIiy's southwestern comer
· Issues regarding urban service extension and Kintzley Avenue
· The proximity to the city stormwater system in Jasper Road, the city's interest in
conveying stonnwater from areas east of the subject site via the applicant's property to
Jasper Slough, and SUB's attention to the proximity of the Willanlette Wellfield.
It appears the annexation agreement process will be complex but will provide opportunities for
the parties to reach mutually beneficial agreements. What is the normal scope of an annexation
agreement, what issues specific to this site must the annexation agreement address, and how can
we move the process forward so city staff can draft the annexation agreement in a timely manner
geared toward amicable and fair resolution of issues? Date Received:

4. Potential System Development Charge (SDC) Credits. Considering the open-space
potential of the southwestern portion of the plroperty, the city's interest in conveying stormwater
from off-site areas via the applicant's prope+y, and the issues regarding off-site improvements,
please review these issues and discuss availability of SDC credits to off-set fees involved with
the annexation.
5. Permit process after Annexation Agreement. Please discuss the permit process after the
annexation agreement has been signed and cbnfirm the suite of permits required to develop the
site as a residential subdivision (as discrlssed in the written statement and the attached
Conceptual Subdivision Plan, Sheet L3). AI~o, please discuss timing of these submittals under
the new annexation process. For example, tnder the new process, can the applicant apply for
tentative subdivision during review of the am exation application?

the Lane County Boundary Commission Because the City IS now processing annexation requests as land use
decIsions, all applicants are required to go through a new Development Issues Meeting (DIM) - even If one was
held In the past (In this case on October 5, 2006) It IS standard practice to schedule the DIM on a first-come,
first-served basIs upon receipt of a completed application Mr Mason can choose to submit questIons similar to
the ones addressed In the 2006 DIM, or perhaps revised questions In light of the new annexation procedure and a
change of development Intent (Ie there are no Immediate development plans In the works) At the DIM, staff will
explain the updated annexation procedure, including new Annexation Agreement provIsions and application
requirements Additionally, fees that would have been paid to the Boundary Commission are now collected by the
City so, among other things, a new check will be required for the revised annexation application (when It IS
submitted) I would note that the annexation fees have not changed so It will be simply a matter of substituting

After two renditions, changes of ownershlp, appllcant delays and bringlng Satre in, the
Mason annexatlon team dld not flnlsh an annexatlon agreement wlth PW before the Dec 31st
LCBC deadline and subsequently turned into a pumpkln. Seriously, they fell lnto the never
never land of starting under the bc ordlnance and having to flnlsh under our new ordlnance
consistent with ORS 222 (process stlll under constructlon). The new DIM lS free for those
half dozen applicants caught in the never never land and is designed to advise them of the
new process, provlde new forms, ask for a new check cut to the city (instead of the BC, no
new fees or increases, just new reclplent) and Jumpstart their AA because it is now a
condition of re-submittal. When we have the AA and revised paperwork we will deem It
complete under the new ordinance and start a 120 and move this to DRC and CC agenda.
No apologies necessary here, just responding to a new statute and ordinance.

five-year tune-of-travel zones for the W1l1amette Wellfie1d Smce StOID1 water from tms SIte WIll go mto
the Jasper Slough, It IS critical to understand that water entenng the slough and Spnngfield MIll Race IS
dIverted through the Gory Creek Headgates mto the WIllamette Wellfield TIus water becomes a drrect
recharge to the aqUIfer used for the pubhc dnnkmg water supply. Once water from the slough enters the
Spnngfield MIll Race, the tIme-of-travel to the wellfield can be a matter of mmutes rather than years, as
the tIme-of-travel zones would mdIcate
Storm water management for the project SIte IS cnhcal for dnnkmg water protectIOn and Spnngfield
UtIlIty Board staff WIll work closely WIth the CIty of Spnngfield and the developer to protect both surface
water and groundwater recharge qualIty.
