All of the Tree Felling Permit Criteria must be addressed by the applicant. In certain circumstances, It is advisable to hire a profeSSional planner or land use attorney to prepare the required findings. It has been a Non-productIve FIlbert Orchard for several years. The applicant IS proposmg removal of all except 5 trees to make way for new single family dwellIngs. The attached plan shows all contIguous property owned by the applIcant. Sectzon 38 040(]) The proposed felling IS bemg proposed to allow construction of reSIdences. Sectzon 38.040(2) The proposed tree removal is conSIstent WIth all local and state standards and applicable plans and policies 'for thIS area wIth respect to tree fellmg. The removal of the trees wIll not Impact the safety or health of the surrounding trees nor wIll It affect surface runoff volume and quality, soIl erosion, etc. The trees have not been mamtained for fruIt and have expended their productive use as an Orchard. These trees are not next to any nparian or wetland areas, drainage ways, or geologIc SItes. Sectzon 38.040(3) There IS no approved development plan for the property. The proposed plan IS attached.
