1. Lots 08000, 07900 and 02100 all front 19th Street and are all owned separately by three
different owners. Presently there are two driveways on lot 08000 and one on lot 02100.
Our plan shows repositioning one of the driveways from lot 08000 to lot 07900, thus no
new driveway access are created. We want to retain separate access to 19th Street from
each of these three lots that front 19th Street. The plan shows three joint driveway
accesses serving two lots each, what problems, if any, does this plan present as to street
access for the six lots accessing 19th Street?
2. Lots 16 and 17 total 10,125 sq. ft. on a piece of ground 75' by 135'. Our plan is to create
two lots using a 20' irrevocable joint use/access easement to service the two lots. Use of a
panhandle for lot 17 would result III not meeting the footage requirement of 5,000 sq. ft.
for lot 16 on a North-South street. The SDC allows for use of an irrevocable Joint
use/access easement in some specific cases, i.e., 16.030 (6) (b) 6. a. Will the Director
waive the requirement that a buildable lot have frontage on a publIc street by use of an
irrevocable joint use/access easement to gain an additional lot thereby getting a greater
density than'would normally be allowed?
3. Lots 4 -7 are shown as attached housing - a duplex style of housing WIth each unit with a
two car, 16 foot wide, garage door Each side of the structure unit is 30 feet wide. Thus
the garage door is 53% of the unit's frontage. Per prior discussions with planner, Sarah
Summers, I've been advised such duplex designs would be acceptable under SDC 16,100
(3) (g) (3) a. (page 16-18) even though the 40% rule is not met because of the various
architectural designs and volume of each side of the structure in relation to the garage
door. Is this acceptable? The duplex plans for this development are attached for your
reVIew.
4. Building height transition rule - SDA 16.100 (3) (f) 2. (SDC page 16-18). Could you
please explain the building height limitation on new construction in a Cluster
Development If a neighboring house is only 16 feet hIgh? Does that mean maximum
height of a new structure would be 21 feet (16 feet plus 5 feet) within 25' of the common
property line? How do you measure the heIght of a structure, is it the medium of the
lowest and highest point on the structure? Can a minor variance (30%) be used to gain
additional height, if needed, and if so, how many would be needed for this development?
Why is the standard for Cluster Development more restrictive than the conventional
subdivision development? Aren't the rules for Cluster Development to be more flexible
III order to gain greater density, innovative deSIgn and open space?
5. Annexation - What wIll be the approXImate cost to annex thIS development (city &
county fees)? Will the county boundary commission handle thIS annexatIOn or IS the CIty
now handlIng all annexation matters? What is the timing of submitting an annexation
application and filing a tentatIve subdivision application at the same time? Please explain
the coordination of annexing property to the City and completing a tentatit1cfflf~~~~ d:
