Yes, Arron, lets get that plat in before, you have to beginrthe pre-submlttal flnal plat
process allover agaln.
Well, lets see If I can re-construct the conversatlon back in December:
Flrst off, you have the! comments recently sent to you by Clty Surveyor, Dennls Ernst on
March 2nd. In additlon I wlII run down each Tentatlve Declslon Condltlon. You fellas
have to flgure out who lS gOlng to do what.
Revlew of Condltlons Compllance:
Condltlon #1: Prlor to Flnal Plat approval, the appllcant shall determlne wlth SUB the
necessary easements, whlch lnclude those lndlcated by the appllcant on Sheet 3 of 4 and a
7' street-slde PUE along Maln Street. Easements shall be dedlcated wlth the Flnal Plat.
Condltlon #1: wlII your flnal plat show the approved SUB easement? (dlSCUSS wlth
SUB"" I recall that you reached agreement)
Condltlon #2: The appllcant shall determlne wlth SUB the necessary relocatlon of the
overhead serVlce to the eXlstlng house.
Condltlon #2: SUB, once agaln regardlng the relocatlon of eXlstlng llnes to the
eXlstlng house", thls lS between you and SUB, I ~hlnk It lS completed
Condltlon #3: Prlor to Flnal Plat approval, the appllcant shall provlde a prlvate utlllty
easement for the new wastewater llne, lncludlng connectlons between the eXlstlng manhole
and the new 6" cleanout.
Condltlon #3: Your plat must show the prlvate utlllty easements for the sewer llne
Condltlon #4: Prior to Flnal Plat approval, the appllcant shall amend the flrst 20 feet
of sOlI withln the swale wlth clay, or lnstall a llner that wlll provlde blo-swale contact
time before the commencement of lnflltratlon. One or more flow spreaders shall also be
requlred wlthln the swale system. The swale shall be planted wlth Grass Seed Mlx for
Bottom of Swale'that compIles wlth the Portland BES for frequently lnundated condltlons.
Condltlon #4: Is the swale In, and seeded? (Publlc Works Supervisor, Les Benoy @

Condltlon #5: Prior to Flnal Slte Plan approval, the appllcant shall provlde the Clty
wlth an operatlons and malntenance plan that ensures the lorig-term malntenance and
operatlon of the proposed stormwater quallty system.
Condltlon #5: Submlt 'a copy of the swale malntenance plan (talk to PW, Les,Benoy @
736-1035 If you don't have a copy)
Conditlon #6: Prlor to Flnal Slte Plan approval, the appllcant shall submit to the Publlc
Works Department a stormwater -dlscharge appllcatlon that has been approved by Oregon
Department of Transportation.
Condltlon #6: I thlnk ODOT has already glven you this approval and you a copy of
the letter In your flle.
Condltlon #7: When submltted, the bUllding plans shall meet the speclflc development
standards for slngle-famlly dwelllngs in Cluster Subdivlslons llsted In SDC 16.100(3) (g)
Condltlon #7: has to do wlth the bUlldlng plans after plat, you don't have anythlng
to submit prlor to flnal plat.
Condit lon' #8: Prlor to Flnal Plat approval, the appllcant shall execute and record the
CC&R submltted for thls subdivlsion proposal that blnd Lots 1-10 wlth 50% malntenance and
Lots #11 and #12 wlth 25% each, maintenance responsiblllty for the common area and storm
water system shared wlth the cluster subdlvislon.

Condltlon #9: Steve Joklnen was gOlng to reVlse hls lnlL~dl CC&R submlttal. You
need to take a second look at them before submlttal and make certaln the changes were
completed, such as:
Example: Item(4) (D) sald three parklng spaces per unlt?
Example: Item (5) headlng should read - Common Malntenance and BUlldlng Deslgn.
Example: Item (5) (A) should read - The roof, exterlor sldlng and exterlor trlm and
wlndows of the dwelllng shall e, wlthln such categorles, constructed of the same materlal
and be selected from colors offered. All exterlors shall be of unlform deslgn and meet
the standards set forth In Clty Code for Cluster Subdlvlsion and submltted to the Clty for
tentatlve approval.
Example: Item (5) (C ) should be corrected to read - The roof, exterlor palnt, exterlor
sldlng, exterlor trlm, common fences of dwelllng unlts shall be malntalned In good
condltlon and repalr.
Example: There appears to me a mlstake In the sequ~ntlal order, such as there lS a sklp In
labels from Item (5) (D) to (5) (F) - where lS the "E"?
Example: Item (6) explanatlon paragraph has a typo In the "arbltrator or the curt. It
should read "court".
Example: The DECLARANTs Slgnature sectlon shall be wrltten(prlnted below the slgnature
llne) with the name 'of the presldent of HFH, AND HFH should be wrltten out, not
abbrevlated HFH.
Example: The document needs to be slgned and notarlzed.
Example: under the Exhlblt A sectlon of property legal descrlptlon, you have to elther
provlde a separate copy of the cluster subdlvlslon lots 1-12 legal descrlptlon or you need
to type It In on the CC&R document.
Example: Number the pages of the CC&R document.
Condltlon #9: Prlor to Flnal Plat approval, the eXlstlng driveway along the easterly
property rlne wlth access to Maln Street shall be closed.
Condltlon #9: Have you done thls?
Condltlon #10: Prlor to Flnal Plat approval, the appllcant shall place a deed restrlctlon
on Lots #11 and #12 prohlbltlng access to North 'A' Street.
Condltlon #10: have you done thls? You wlll need to provlde documentatlon of
completlon.
Condltlon #11: Prlor to Flnal Plat approval, the appllcant ,shall execute and record a
public access easement over the paved turn-around area at the end of 'A' Street.
Note: Prlor to recordlng, the dlmenslons of thls easement shall be approved by
Transportatlon Plannlng Englneer, Gary McKenney.
Condltlon #11: Have you completed thls? Checked wlth McKenney? Does ~t have to be a
separate document or can thls be recorded on the plat?

Kltty, I stlll .need to know where we are on the other approval condltlons,
as does Roddy Toyota @ Habltat. If we get the plat taken care of by the
deadline, it wlll be a moot poin~ if the other condltlons haven't been
met.

Arron, I have been advlsed that an extenslon on the Pre-submlttal
deadllne of Aprll 27th lS not an approprlate actlon. If the pre-sub
deadllne lS mlssed, the appllcant has to re-submlt and get back lnto the
meetlng schedullng queue. The busy construction season lS openlng up
and you don't want to have to go to the back of the Ilne of all the
other appllcatlon that are comlng In.
From Ernest's assessment, It looks llke you have all the detalls worked
out and that you can reasonably submlt the necessary documents wlthin
the tlme frame allotted.
Lets make thls work and get It finlshed up.

In looklng at our records In surveYlng here's where we are on thls one:
The comments from Lane County Surveyor's offlce was sent to Aaron on
December 1, 2006.
The flrst round of Clty comment were sent December 7, 2006.
A second round of comments were sent January 26, 2007.
At thls pOlnt we are waltlng for a new paper copy of the plat to be
submltted wlth all the correctlon to date made. No request for a fleld
check has been made. Before the mylars are submltted we should have a
updated tltle report submitted to reflect any activlty affectlng the
tltle, ownershlp and' easement to date. '
I would encourage Aaron to get us a new copy as soon as he ,can as we are
pretty back logged at the moment and are working on the stack on a flrst
come first served basls. The stack of plats to be revlewed lS gettlng
pretty tall so the sooner we see thls the sooner we can get to it.
