" ~ ~ >- ~ > >. '" O~EN SPACE EASEMENT AGREEMENT FLOYD T. BRICKLEY and VIOLET 1. BRICKLEY, husband and wife, (Grantor's) are the owners of Lots 37, 38, 39 and 40, SECOND ADDITION TO NORTHRIDGE, as platted and recorded in File 72, Slide 198, Lane County Oregon Deed Records. There is an existing garage structure located within the Southeast corner of Lot 37. The Grantor's desire to do a Lot Line Adjustment to the Connnon line along the South line of Lots 37 and 38 and the North line of Lots 39 and 40. Upon completing this Lot Line Adjustment, the existing garage structure would not have the required rear yard setback of 10.00 feet. Therefore, the Grantor's hereby grants to the City of Springfield, a municiple corporation, in Lane County, Oregon, (Grantee) an Open Space Easement to provide the required 10.00 foot rear yard setback after completion of the Lot Line Adjustment, the said Open Space Easement is described as follows: Beginning at the Northeast corner of Lot 37, SECOND ADDITION TO NORTHRIDGE, as platted and recorded in File 72, Slide 198, Lane County Oregon Deed Records; thence along the East line of said Lot 37, South 147.05 feet to the TRUE POINT OF BEGINNING of said Easement; thence continue South 10.00 feet; thence North 890 53' 40" West 35.50 feet; thence North 10.00 feet; thence South 890 53' 40" East 35.50 feet to the TRUE POINT OF BEGINNING, in Springfield, Lane County, Oregon. The following restrictions are to be placed on the Open Space Easement. As long as the existing garage structure, as it is presently constructed and located remains, no buildings shall be placed within this Open Space Easement. If the existing garage structure is moved or destroyed, this easement shall automatically be revoked and the existing city setback requirements in force at the time shall apply for any replacement buildings.
