To date, although certifiable infDrmation has yet to be provided
regarding the exact location of the east property line, it has
,been repDrted to me by a licensed engineer and the current
property owner that the structures as located fail to provide the
required ten foot rear yard setback.
Section 16.050 of the Springfield Development Code (SDC) provides
in, part:
In all
setbacks
otherwise
residential, districts, each lot
of not less than the fDllowing
provided for in this Code:
shall have
sizes' unless
(1) Front yard, street side yard and rear yard
setbacks 10 feet
Section 2.020 of the SDC provides in part:
CERTIFICATE OF OCCUPANCY. A document issued by the
Building Official allowing the occupancy or use of a
structure and demonstrating that the structure or use
has been constructed in compliance with all applicable
City codes and ordinances.

On the basis of this requirement and the information provided to
me by the two individuals previously mentioned, it is my opinion
that a Certificate of Occupancy cannot be issued until the setback
question is resolved in an appropriate manner.
