Dear Mr. Alverson:
I've received your letter of May 2 to which you've attached the sampling results
from Magnum Environmental and the receipt from Best SepticsefVIce.
Your letter further requests a refund. 1 am assuming from the calculations in the
letter that you are reasserting your earlier demand for a refund of the $900 work
plan fee.
You have raised this question before, so again be advised that there is no 'provision
in law or any basis for a refund and therefore there will be no refund.
In addition, the Certificate of Fitness will not be issued Wltil the Division has
received either a money order or a certified check for $200 as the fee required Wlder
OAR 333-040-0180. Have the check made available to Department of Human
Services/Health Services and return to this address. Within 3 days of the receipt of
the fee, the Certificate will be issued. If you elect to write a personal check, we will
hold the Certificate Wltil we have assurance that the check has cleared.
A review of your file shows an ongoing history of non-compliance with Oregon law
with respect to your use of this property and unauthorized cleanup activities. Your
case is also Wlique insofar as you knew when you bought this property that it had
been declared Unfit for Use and that a cleanup was required. We have gone to
extra ordinary lengths to resolve this matter with you rather than to pursue the civil
and criminal penalties to which your actions are subject.
Be again advised that use of a property that has been declared Unfit for Use is a
Class B misdemeanor and, in addition, is subject to civil penalties up to $2,000. In
additioj1, a house that has been detemlined to be Unfit for Use is considered to be a
public nuisance and can be abated 'as such under local nuisance abafemeilt authority.
