HomeMy WebLinkAboutResolution 04-39 08/16/2004 . . . : Resolution No. 04- ~ A RESOLUTION REFERRING TO THE ELECTORS OF THE CITY A BALLOT MEASURE AUTHORIZING THE ISSUANCE OF $28,650,000 IN GENERAL OBLIGATION BONDS TO FINANCE THE CONSTRUCTION OF A.POLICE/COURT AND MUNICIPAL JAIL FACILITY AND RELATED IMPROVEMENTS; AND AUTHORIZING OTHER MATTERS IN CONNECTION THEREWITH. As the preamble to this Resolution, the Common Council of the City of Springfield, Oregon (the "City") hereby recites the matters set forth below. To the extent any of the following recitals relates to a finding or determination which must be made by the Common Council in connection with the subject matter of this Resolution or any aspect thereof, the Common Council declares that by setting forth such recital such finding or determination is thereby made by the Common Council. The recitals, findings and determinations set forth herein constitute a part of this Resolution. (1) POLITICAL SUBDIVISION. That the City is a municipality and political subdivision organized and existing under and pursuant to the laws of the State of Oregon and the 2001 Springfield City Charter. (2) SPRINGFIELD TOMORROW COMMUNITY VISIONING PROJECT. The City has previously formed the Springfield Tomorrow Steering Committee to assist in a long-range, ongoing project designed to build community consensus about the future direction of Springfield. Its primary purpose was to discover current desires and needs of residents, along with a general blueprint of how they envision an ideal Springfield to be "tomorrow," then equitably balance their vision with fiscal responsibility. (3) NEED FOR CAPITAL PROJECT. The Police Planning Task Force completed the latest update of the police long-range strategic plan in 2002, and recommended to the City Council that a new facility be constructed to replace the existing police facility. The current facility, originally constructed in 1947, consists of approximately 24,000 square feet and because of design, presents cost prohibitive or structural prohibitions to expansion. (4) AUTHORITY TO ISSUE GENERAL OBLIGATION BONDS. Under the provisions of ORS 287.004, upon the approval of a majority of the electors of the City voting on the question, the City is authorized to borrow money and issue and sell its general obligation bonds. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD, OREGON AS FOLLOWS: SECTION 1. APPROVAL OF BALLOT MEASURE FOR BOND ISSUE. The Common Council of the City hereby directs that at the general election to be held on November 02,2004, there shall be submitted to the qualified electors of the City a measure authorizing the City to issue general obligation bonds in the principal amount of $28,650,000 in order to finance the costs of a police, court and municipal jail facility, and related improvements. SUBMISSION TO ELECTIONS OFFICER. Not later than the 6151 day before November 02,2004, the City Recorder, as the Chief Elections Officer of the City, shall submit to the County Clerk for Lane County, Oregon, as statement of the bond measure together with a certified copy of this Resolution and the Ballot Title, all in order that the bond measure may appear on the ballot for the general election to be held on November 02, 2004. The City Recorder shall submit to the County Clerk all necessary information, and shall do and perform all other acts and things necessary or appropriate, so that the bond measure shall appear on the ballot for such general election. SECTION 3. ADDITIONAL AUTHORIZATIONS. The City Manager, the City Recorder and the City Finance Director, and each of them acting individually, are hereby authorized, empowered and directed, for and on behalf on the City, to do and perform all acts and things necessary or appropriate to cause the bond measure to appear on the ballot for the November 02, 2004 general election and to otherwise carry out the purposes and intent of this Resolution. SECTION 4. EFFECTIVENESS OF RESOLUTION. This Resolution shall take effect immediately upon its adoption by the Common Council of the City and approval by the Mayor. If the bonds are approved, they will be payable from taxes on property or property ownership that are not subject to the limits of sections 11 and lib, Article XI of the Oregon Constitution. Summary: Bonds would pay for the costs of a replacement facility for police department, including patrol and investigation offices, dispatch, recordkeeping and administration. The facility would also house municipal court, city prosecutor's office and jail with approximately 100 beds. Jail beds could be rented to other jurisdictions to offset operating costs. The downtown facility would include public meeting room for Citizen's Police Academy, Neighborhood Watch, Peer Court and other public meetings. Related improvements would include public plaza. The existing building, built in 1949, would be removed and the proposed facility would utilize that property. Siting of a replacement facility may require purchase of additional adjacent property and vacation of existing street right-of-way. The Bonds would mature in no more than 25 years. Estimated Bond cost is approximately 87 cents per $1,000 of assessed value per year. A typical home with an assessed valuation of $125,000 would pay $9.06 per month totaling $108.72 in additional annual property tax. Gross annual jail operating costs estimated at $1,400,000 would not be included.
