REQUESTED:
The Council is requested to conduct a public hearing and first reading of the
following ordinance: AN ORDINANCE WITHDRAWING CERTAIN REAL PROPERTY
KNOWN AS BUI, LOCATED IN WESTERN SPRINGFIELD, EAST OF TAMARACK
STREET, SOUTH OF THE "BY GULLY" BIKEPATH, AND NORTH OF OLYMPIC
STREET INVOLVING APPROXIMA TEL Y 0.92 ACRES IDENTIFIED AS TAX LOTS 900
Tl7S R03W S27 MAP 31; PART OF 3600, Tl7S R03W S27 MAP 31; HERETOFORE
ANNEXED TO THE CITY OF SPRINGFIELD FROM THE RAINBOW WATER
DISTRICT.
ISSUE
STATEMENT:
Oregon Revised Statutes (ORS 222.520) require that territory located in theRainbow
Water District, which is annexed to the City of Springfield, be withdrawn from that
district to prevent double taxation. ORS requires withdrawal prior to March 31 sl of
each calendar year. The owner requested annexation in order to facilitate
development of a subdivision. The subject property was annexed to the City of
Springfield effective on July 28, 2006.

FINANCIAL
. IMPACT:
Once a year, the Council is asked to approve the withdrawal of all properties within
the Rainbow Water District which were annexed during the past calendar year. This
is done so that the properties are located only within the Springfield Utility Board's
assessment area. Approval of the withdrawal prevents the owner of the annexed
property from being assessed by both Rainbow Water District and SUB. The
requested action is a routine procedure which follows annexation and will have no
fiscal impact on the City.
Legal notice was published in the Register Guard as required by ORS 222.520 and
notices were posted in five public places. A second reading and adoption is
scheduled for the March 19,2007 consent calendar.

AN ORDINANCE WITHDRAWING CERTAIN REAL PROPERTY KNOWN AS BUI, LOCATED IN
WESTERN SPRINGFIELD, EAST OF TAMARACK STREET, SOUTH OF THE "BY GULLY"
BIKEPATH, AND NORTH OF OLYMPIC STREET INVOLVING APPROXIMATELY 0.92 ACRE
IDENTIFIED AS TAX LOTS 900 T17S R03W S27 MAP 31; PART OF 3600, T17S R03W
S27 MAP 31; HERETOFORE ANNEXED TO THE CITY OF SPRINGFIELD FROM THE
RAINBOW WATER DISTRICT.
WHEREAS, certain real property described below was annexed to the City of
Springfield by order of Lane County Local Government Boundary Commission under
Boundary Commission Number File EC SP 06~50, effective 07/28/06, and further described'
in Exhibits A & B, and
WHEREAS, the. property to be withdrawn is located within the boundaries of the
Rainbow Water District, and
WHEREAS, the City of Springfield Common Council held a public hearing and first
reading in the Springfield City Council Chambers on March 5, 2007, and a second reading
and adoption on March 19, 2007, in accordance with ORS 222.524, for the purpose of
hearing any objections to the withdrawal of the property from the public service district
mentioned and there having been no objections raised.
NOW THEREFORE THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS:
Section 1. The Common Council of the City of Springfield does hereby determine
that it is in the best interest of the Cityof Springfield to withdraw the real property described
in Section 2 from the Rainbow Water District in Lane County, Oregon, insofar as the
property is located therein.
Section 2. The Common Council of the City of Springfield does hereby determine
that the following described real property within the boundaries of the Rainbow Water
District is and shall be withdrawn from the Rainbow Water District in Lane County, Oregon,
said property being described as follows: Tax lots 900 T17S R03W S27 Map 31; part of
3600, T17S R03W S27 Map31 as more particularly described in Exhibit A of this ordinance,
Boundary Commission File Number EC SP 06-50.
ADOPTED by the Common Council of the City of Springfield this 19th day of March
2007, by a vote of _ for' and _ against.
APPROVED by the Mayor of the City of Springfield this 19th day of March 2007.
