(P20347) ACTION REQUESTED: Approval or disapproval of the following motion: TO AUTHORIZE THE CITY MANAGER TO SIGN THE DECLARATION OF DEDICATION OF CITY OWNED PROPERTY TO PUBLIC RIGHT-OF WAY. ISSUE STATEMENT: For the completion of phase 1 of the 42nd Street reconst~ction project, a 15 foot wide strip along the frontage of tax lot no. 1400 on tax map no. 18-02-05-22 was required. This tax lot is owned by the City and requires that a portion of the property along the frontage be dedicated to public right-of-way. ATTACHMENTS: A. Declaration of Dedication Packet DISCUSSION/ FINANCIAL IMPACT: In finalizing documents for acceptance of phase 1 of the South 42nd Street Reconstruction Project, a portion of the City owned property located at 850 S. 42nd Street (tax map and lot number 18-02-05-22-01400) necessary for the construction of the project must be dedicated as public right-of-way. The attached packet (Attachment A) has a map which shows the 1.5 acre tax lot in question and the required 15 foot strip dedication along the frontage of South 42nd Street. This packet also includes the Declaration of Dedication and the legal description for the 0.13 acre parcel to be dedicated. This is the same parcel that the City is in the process of selling to the Relief Nursery. Development Services staff is aware of the need for the dedication of right of way and agree that the dedication needs occur prior to the transfer of the title. Staff recommends that Council authorize the City Manager to sign the Declaration of Dedication transferring the 0.13 acre parcel described in exhibit A of the attached packet from City ownership to public right-of-way.
