OR 97477 (503) 746-9621 June 12, 1992 34 ll& G(A..+e.~~ Mr. Richard Larson Attorney at Law 975 Oak street Eugene, OR 97401 FAX No. 484-0882 Re: Former ARca site Dear Richard: This letter will supplement the letter dated June 11, 1992 which you received from Al Peroutka regarding the above-referenced matter. Al Peroutka is out of the office today but he asked me to communicate with you. The last sentence of Mr. Peroutka's letter to you needs some clarification. At the time Mr. Peroutka wrote that sentence to you, he was unaware that the City of Springfield Building Division had already reviewed and approved a permit application on April 3, 1992, for work at 3488 Gateway Street. The summary of the work prepared by Building Division employee, Lorne Pleger indicates "demolition of gas station, canopy, site work, removal of 3 12,000 gallon underground tanks, closure of 2 driveways & replacement w/new sidewalks & curbs". Mr. Pleger states that the permit which he reviewed and approved for the demolition of the service station site and the associated work therewith, included the closure of the two driveways and Leplacement with new'sidewalks. In connection with the demolition permit, there is no requirement that these two driveways be closed. The permit authorizes and allows their closure but does not demand or mandate it. Thus, as to whether ARCO or its agent closes these driveways and replaces them with sidewalks, as part of the demolition permit, is entirely a private civil matter between ARCO and the owner of the property. The City is not requiring their inclusion in the demolition permit. The City, however, has no objection to the closure. Further, as a matter of information to you, in the event the city receives from British Petroleum (or any other entity) a site use encompassing the former ARCO site and the former Shell site, ~he city will require a site review for the use. As part of the s1te review, it may be that the city will require closure of one or ~ ..:" . . If you wish, Dan Brown or Al Peroutka would be happy to schedule a preapplication conference with British Petroleum (or any other entity) representatives to discuss these matters, or any other matters with which they may be concerned regarding their development of the site. You may wish to discuss this with Dan Brown or Al Peroutka. If British Petroleum (or any other entity) has a site plan already prepared, you may be able to coordinate the site plan requirements in such a way as to have ARCO or its agents effectuate during this demolition any closures which may be required by the City, or which may be desired by British Petroleum (or any other entity)' planning a use which encompasses both the former Shell site and the former ARCO site.
