SITE PlAN REVIEW DEVELOPMENT AGREEMENT
This DEVELOPMENT AGREEMENT, hereafter "~, ="... ,t, is entered into this day of , 1996
(the "Effective Date") by and betv.een the OTY OF SPRINGFIELD, hereinafter ''Oty'', and _

RECITALS
WiEREAS, on the day of , 1996, the Oty approved the Final Site Plan Application subnitted
by the Applicant for the purpose of allowing:
OTY JOURNAL NUMBER 95-11-209, Type II Site Plan requesting approval for the "Marriott', a 116-room
hotel, The property is located at the northeast intersection of Kruse Way and Hutton SIteet, south of
Beltiine (Assessor's Map #17-03-22-21, Tax Lot 803. The '"""'I-""~i is zoned Conm.mity c...".....,,;a1 and

WiEREAS, in consideration for Site Plan approval, the issuance of a Building Perrri~ and the issuance
of an Q:cupancy Perrri~ as specified in the Springfield Develv,",,,'" ,! Code Section 31.090, Applicant
agrees to ........, ,,;1 with all of the standards in the Springfield Develv,",,,'" ,( Code and the Springfield

WiEREAS, in consideration for Site Plan approval, the issuance of a Building Perrri~ and the issuance
of an Q:cupancy Perrri~ as specified in the Springfield Development Code Section 31.090, Applicant
agrees to c::orrply with the following specific ~,.c.~ons irrposed by the City as part of the Site Plan
approval:

1, The applicant shall provide three (3) copies of the final site plan within 90 days of the decision, The
plan shall show all revisions as specified in the Notire of Decision (Jo. No,95-11-209).

THEREFORE IN CONSIDERATION OF THE FOREGOING REOTALS WiICH ARE EXPRESSLY MADE
A PART OF THIS AGREEMENT, OTY AND APPLICANT AGREE />S FOLLOJ\S:
1. FINAL SITE PLAN. The Applicant has subrritted a Final Site Plan in c.~,Jance with Section 31.080

2, STANDARDS, The applicant agrees to fulfill all applicable standards specified in the Springfield
Develv~"...,,1 Code and the specific standards listed in the REOTALS prior to the occupancy, unless
certain conditions have been defc, , cU to a later date in accordance
llvith Section 31.110 of the Springfield Developrrent Code.
3. CONDlTlONS, The applicant agrees to fulfill all specific conditions of approval required by the Oty listed
in the REOTALS prior to occupancy, L01Iess certain conditions
have been deferred to a later date in accordance llvith Section 31.110 of the Springfield Develv~".... ,l Code,
4, MODIACATlONS, The Applicant agrees not to rrodify the approved Rnal Site Plan llvithout first notifying
the Oty, Modifications to the Rnal Site Plan shall be revie'Mld in accordance llvith Section 31.100 of the
Springfield Devel""'".... ,I Code, . .....
5, MAINTAINING THE USE The Applicant agrees to the following:
(a) The building and site shall be maintained in accordance llvith the provisions of the Springfield
Develvt",.... .1 Code in order to continue the use,
(b) It shall be the continuing obligation of the 10" V""" ~I ov.rer to maintain the planting required by Section
31,140 of the Springfield DeveI""",.... ,t Code in an attractive manner free of Y.eeds and other invading
\"",,,,;..~on, In addition, p1antings in the vision dearance area shall be b'inmed to meet the 2 112 foot height
standard in accordance llvith Section 32.070 of the Springfield Develv~"...." Code.
(c) Parking lots shall be maintained by the property ov.rer or tenant in a condition free of litter or dust, and

(d) Undeveloped land llvithin the developrrent area shall be maintained free of trash and stored materials
