Regular Session: Conduct a Public Hearing and Approve or Reject A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD AMENDING THE MASTER SCHEDULE OF MISCELLANEOUS FEES AND CHARGES, RATES, PERMITS AND LECENSES IN ORDER TO AMEND THE AMOUNT OF THE GARBAGE AND REFUSE RATES ISSUE STATEMENT: The City of Springfield has granted a garbage collection franchise to Sanipac Oregon, Limited, of Eugene, Oregon, under which the City establishes collection rates by ordinance. On April 07 in a letter from Sanipac' s General Manager Richard Wichmann, Sanipac requested a combined 8% increase in revenue in the hauler's portion of the solid waste collection 'rates for all categories of waste collection. ATTACHMENTS: Attachment A: Council Briefing Memorandum Attachment B: Sanipac Request Attachment C: Rate Comparison Attachment D: Council Resolution DISCUSSION: Sanipac's rates have not increased since April 2003. During that time, consumer prices, as measured by the Consumer Price Index, all Urban Consumers (Portland- Salem MSA) has increased by 15.3%. At the time of the last adjustment, staff concluded that the increase at that time would provide an appropriate rate of return for three years. Under the proposed increase, the rate for a 32-gallon container would increase to $14.35 and for a 60-gallon container it would increase to $20.80. For comparison purposes, the equivalent rates in Eugene, after allowing for the $1.50 recycling credit, which is built into Springfield rates, would be $19.70 for a 32-gallon container and $34.45 for a 60-gallon container. , CITY OF SPRINGFIELD/FINANCE DEPARTMENT COUNCIL BRIEFING MEMORANDUM Date: To: From: April 29, 2008 Gino Grimaldi Len Goodwin ~ Bob Duey ~ Sanipac Rate Increase Request Subject: ISSUE The City of Springfield has granted a garbage collection franchise to Sanipac Oregon, Limited, of Eugene, Oregon, under which the City establishes collection rates by ordinance. On April 07 in a letter from Sanipac's Chief Financial Officer Richard Wichmann, Sanipac requested a combined 80/0 increase in the hauler's portion of the solid waste collection rates for all categories of waste collection (Attachment B Page 4) BACKGROUND Sanipac last received rate increases in April 2003. In Richard Wichmann's letter to the City, the 8.00/0 increase reques~ is based upon key operating cost increases, including but not limited to: o Labor has increased 13.50/0 o Medical benefits increased 101 % o Average container prices increased 25%, drop boxes 63% and roll carts 27% o The average cost for a typical front loader (truck chassis and box) increased 280/0 o Diesel prices increased 161 % over the period DISCUSSION The City ordinance which grants Sanipac the franchise requires that the City, in its evaluation of a rate increase, may give due consideration to all relevant factors including, but not limited to, the following: ~ Rates charged by collection services in other Oregon cities ~ The most recent January Consumer Price Index (CPI-U) for Portland, Oregon. ~ The current schedule of any rates required by Lane County ~ Proposals made by Sanipac regarding the appropriate rate schedule. In addition, this analysis will give consideration to Sanipac's cost to deliver the service. ANALYSIS Comparable Rates A comparison with rates charged in comparable jurisdictions indicates that Sanipac proposed increase is within competitive range of the comparables used. This compares favorably to the requested 8.00/0. Cost to Deliver Services The cost to deliver services has been analyzed by determining an appropriate rate of return. The rate of return has been examined because the provider is a private for-profit business entity. Their cost to deliver service must include a profit at a fair rate of return. . In determining a fair rate of return, industry standards were used as a benchmark. As compiled by Robert Morris Associates and Dun and Bradstreet (Attachment Four) for the Standard Industrial Category (SIC) #4212 - in which garbage haulers are included - profit before taxes divided by total assets has the following ranges: low range mid range high range 2.7% 8.50/0 14.5% Based on financial data provided by Sanipac, the following return on assets for the entire Sanipac corporation (including Eugene) as of 6/30/07 is: Audited, FYE 6/30/07 12.4% Audited, FYE 6/30/06 10.8% Audited, FYE 6/30/05 10.60/0 Audited, FYE 6/30104 9.7% Sanipac's return on assets ratio is consistently in the middle of the mid to high ranges. Rate increases of this type are usually not planned as annual changes and firms are looking at a minimum of three years on which to base their rate adjustments. In this case Sanipac has gone 5 years on the last rate increase (from 2003 to 2008) and through the growth in customers and expenditure control has been able to meet their financial targets. As is shown in the final tables, beginning in FY08 increased costs have now outpaced the ability for growth in customers to offset the need for a rate increase to maintain industry standards. The expected return on revenue will drop from 12.98% in FY07 to an estimated 4.88% by FYI0. An 8% increase in revenue in the hauler's portion of the solid waste collection rates should allow Sanipac the ability to meet standards over the next three years. Recommendation is to allow the 8.0% increase in Sanipac's hauler's portion of the solid waste collection rates for all categories of waste collection. Attachment A Page 3 of 3 April 7, 2008 Mr. Len Goodwin City of Springfield 225 Fifth Street Springfield, OR 97477 Dear Len: In accordance with Ordinance 6011 (special) section 16, Sanipac requests an adjustment in solid waste collection rates for all categories of waste collection effective June 1, 2008. We are making this request because of substantial increases in operating costs since February 2003, the date of our last increase. Examples of increases in some of our key operating costs are shown below: · Labor has increased 13.5% · Medical benefits increased 101 % · A verage container prices increased 25%, drop boxes 63% and roll carts 27% · The average cost for a typical front loader (truck chassis and box) increased 280/0 · Diesel prices increased 161 % over the period Sanipac also had to adjust the disposal portion of the rates due to Lane County raising its disposal fee from $45.00 per ton to $65.00 per ton effective September 1, 2007. The county-wide increase was passed through to our customers at no additional mark-up. Due to the cost increases detailed above, Sanipac requests an 8.0% increase on the rates to cover costs incurred, as well as costs into the future and to allow for a reasonable rate of return. Please see attached rate comparison. Sanipac is proud of the relationship we have built with the City of Springfield and our request comes with a commitment to continue providing safe and efficient services to the citizens of Springfield. At the same time, Sanipac will strive to keep the collection of solid waste as affordable as possible, and with the introduction of a subscription yard debris program beginning May 1, 2008 Sanipac's commitment to providing comprehensive solid waste and recycling services will continue. Attachment C RESOLUTION NO. A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD AMENDING THE MASTER SCHEDULE OF MISCELLANEOUS FEES AND CHARGES, RATES, PERMITS AND LICENSES IN ORDER TO AMEND THE AMOUNT OF THE GARBAGE AND REFUSE RATES. WHEREAS, Springfield Municipal Code 4.408(2) provides that the maximum rates for the collection of garbage and refuse for a month shall be set by resolution of the Council; and WHEREAS, the present rate for the collection of garbage and refuse consists of two parts; 1) the rate which accounts for the cost of collection of garbage and refuse by the collector of garbage (the "collection rate"), and 2) the rate which accounts for the fees imposed by Lane County for the disposal of garbage and refuse collected by the collector of garbage (the "disposal rate"); and WHEREAS, Sanipac, Inc., the collector of garbage as defmed by Springfield Municipal Code Section 4.400, has requested the maximum rates for the collection rate currently fIXed be adjusted, by increasing rates by 8%; and WHEREAS, the collector of garbage has provided certain information and material in support of its request; and WHEREAS, City staff have reviewed the request of the collector of garbage, and the additional information and material provided in support of the request; and WHEREAS, City staff, following such review have recommended that the adjustment of the maxinium rates for the collection of garbage and refuse be approved as requested; and WHEREAS, the Council has considered the request of the collector of garbage, the material and information submitted in support of such request, and the analysis and recommendations of the staff, and is fully informed as to the request and the circumstances; and WHEREAS, the opportunity for public comment at a public hearing has been provided prior to the adoption of this Resolution; and WHEREAS, except for the increase in the Garbage and Refuse rates as specified herein, the fees set forth in the Master Schedule remain unchanged and shall continue in full force and effect; NOW THEREFORE, be it resolved by the Common Council of the City of Springfield as follows: . 1. To amend the Garbage and Refuse rates as set forth in Exhibit A Attachment 1, the "Master Schedule of Miscellaneous Fees and Charges, Rates, Permits, and Licenses" attached hereto and incorporated herein by reference. Except as specifically amended by this Resolution the "Master Schedule of Miscellaneous Fees and Charges, Rates, Permits, and Licenses" shall remain unchanged and in full force and effect. 3. Future Resolutions of the Common Council may be adopted to amend, add or delete any rate, permit fee, license fee, or other fee or charge as may be necessary to compensate the City for providing the particular services set forth in the Master Schedule. 4. In the event any particular rate, permit fee, license fee, or other fee or charge set forth in the Master Schedule shall be held invalid by operation of law or any court of competent jurisdiction or the enforcement of any fee restrained by such court pending the,final determination as to its validity, the remainder of the rates, permit fees, license fees, fees and charges specified in the Master Schedule, Exhibit A, shall not be affected thereby and shall remain in full force and effect.
