HomeMy WebLinkAboutOrdinance 5859 06/16/1997 . . v ORDINANCE NO. 5859 (SPECIAL) AN ORDINANCE APPROVING AN AMENDMENT OF THE METRO PLAN, CHANGING THE PLAN DESIGNATION FROM LOW DENSITY RESIDENTIAL TO GOVERNMENT AND EDUCATION FOR PARCEL 1 AND FROM LOW DENSITY RESIDENTIAL TO PARKS AND OPEN SPACE FOR PARCEL 2 (Jo. No. 96-12-248) AND DECLARING AN EMERGENCY. THE CITY OF SPRINGFIELD FINDS THAT: 1. The proposed amendment is consistent with applicable criteria of the Springfield Development Code, Metropolitan Area Plan, and applicable state statutes and statewide goals. 2. The Springfield Planning Commission held a public hearing on June 3, 1997 and recommended approval, 6-0. 3. The Springfield City Council held a public hearing on June 16, 1997 on the proposed amendment. 4. Findings in support of the approval of this amendment to the Metro Plan diagram are set forth in "Exhibit A" attached hereto, and incorporated herein by reference. NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS: Section 1: The findings set forth above and the findings contained in "Attachment A" attached hereto are adopted, and incorporated by reference. Section 2: The diagram amendment is hereby approved, and the diagram is hereby amended in "Attachment B" attached hereto. Section 3: If any section or provision of this ordinance is found to be invalid, improperly adopted or adopted without supporting findings and evidence, such findings of invalidity shall not invalidate or otherwise affect the remaining portions of this ordinance. ATTACHMENT A STAFF REPORT AND FINDINGS Applicant School District 19 (Jo. 'No. 97-05-101 and Jo. No. 97-05-102) Request District 19 is requesting to amend the Metro Plan designation of 76.8 acres from Low Density Residential (LOR) to Parks and Open Space and Governmen.t and Education and rezone the same property from LOR to Public Lands and Open Space (PLO). Approval of this request will bring the zoning for the property into conformance with the proposed uses for a softball complex and future high school and playing fields and would be consistent with Springfield Develpment Code Article 23. Site Descriotion The subject property is located between Thurston Road and McKenzie Highway (see Exhibit 1), Tax Assessor's Map 17-02-36-2, Tax Lot 402 and Map 17-02-35 Lot 4401. The property is relatively flat with a steep slope rising to McKenzie Highway. Access to the property is currently from Thurston Road. A wetland is located over parts of the southern portion of the subject property. A ditch, wetlands and Gay Creek are all natural resources. The property is vacant except for a barn. Property on the east, west and south are zoned LOR. Property on the north is located in Lane County and is zoned for agriculture. Background The property has been partitioned into two parcels and annexed into the City. An application has been submitted for an amendment to the Metro Plan diagram to change the designation of Parcel 1 from LOR to Government and Education and Parcel 2 from LOR to Parks and Open Space (Exhibit 2). ' The proposed uses require a Metro Plan Amendment and Zone Change. The Conceptual Development Plan (Exhibit 3) for the property shows a future high school campus with playing fields on Parcel 1, and a Willamalane Park and Recreation District softball. complex on Parcel 2. The Willamalane complex replaces the park and fields formerly located at Bob Artz Park. The Zone Change to Public Lands and Open Space ( PLO) is in conformance with both proposed Metro Plan designations. SDC 23.010 states, "The PLO District is intended to implement the Metro Plan Public and Semi-Public designation, which includes Government, Education and Parks and Open Space designations ..." Review Process and Notification The proposed Metro Plan Amendment and Zone Change are being processed concurrently. All property is located within Springfield City limits, therefore the City of Eugene and Lane County do not hear or adopt the proposed amendments. As a courtesy, the amendement was forwarded to Lane County and the City of Eugene for consideration. The City ot'Eugene or Lane County may comment on this proposal during the public hearing process. All adjacent property owners and residents within 300 feet of the proposed area received notification of ,the -' . . . Ai impending changes. To date no written comments have been received from other jurisdictions or residents. Criteria of Aooroval and Findings Metro Plan Amendments In accordance with Metro Plan Policies and the Springfield Development Code (SDC) section 7.030(3), the following criteria shall be applied in approving or denying Metro Plan Amendment applications: (a) The amendment must be consistent with the relevant statewide planning goals adopted by the Land Conservation and Development Commission (LCDC) Goal 5: Open Spaces, Scenic and Historic Areas, and Natural Resources: "To conserve open space and protect natural and scenic resources.. "Programs shall be provided that will: 1) insure open space; 2) protect scenic and historic areas and natural resources for future generations, and 3) promote healthy and visually attractive environments in harmony with the natural landscape character. The location, quality and' quantity of the following resources shall be inventoried: ie...(g.) Water areas, wetlands, watersheds, and groundwater resources. · ' A drainage ditch and Gay Creek run eastlwest across the southern part of the site., Gay.Creek has been identified by the, Metropolitan Natural. Resources Special Study as S24 and is recommended for waterside protection. The intent of waterside protection is to control development to maintain and protect water quality and wildlife habitat within minimum setback areas. The creek and other wetlands in the southern portion of the site are identified on the National Wetlands Inventory, the draft Springfield Wetlands Inventory, and the Hydric Soils Map. By developing the neighboring areas with grassy ballfields instead of the impervious surfaces of a subdivision, this natural resource area can be better protected and maintained. Site plans are required for development on any of the parcels. During the site plan review process, the buffering of the natural resources and storm drainage will be examined. Finding 1.- This proposal is consistent with Goal 5 because it will allow uses that will provide open spaces and provide opportunities to protect natural resources. Goal 8: Recreational Needs: "To satisfy the recreational needs of the citizens of the state and visitors and, where appropriate, to provide for the siting of necessary recreational facilities including destination resorts. n "The requirements for meeting such needs, now and in the future, shall be planned for by governmental agencies having responsibility for recreation areas, facilities and opportunities." 2 . . . A2 Willamalane Park and Recreation District is planning to construct a community park with lighted softball fields to take the place of the park and fields formerly located at Bob Artz Park. The amount of open space included in a high school site provides recreational facilities for students as well as the community. The school campus as proposed would contain playing fields for soccer, baseball, football, and courts for tennis and basketball. Typically, school sites are also used as community centers. Finding 2. The proposal is consistent with Goal 8 because it will allow uses that provide for the siting of recreational facilities., Goal 11 : Public Facilities and Services: "To plan and develop a timely, orderly and efficient arrangement of public facilities and services to serve as a framework for urban and rural development. " Urban and rural development shall be guided and supported by types and levels of urban and rural public facilities and services appropriate for, but not limited to, the needs and requirements of the urban, urbanizable, and rural areas to be served." The proposed development of the site with recreational facilities and future school facilities is located in an area of Springfield that is zoned residential. This is an area of rapid growth for the City and the adoption of the amendment of the Metro Plan to allow the proposed uses would support the needs and requirements of current and future populations. In addition to educational and recreational facilities, the proposal includes the extension of water and electricity to the site. A septic system will serve the Willamalane ballfields until development of a school site. At that time, the sanitary sewer system will be extended to serve the site' and other properties. Finding 3. The proposal is consistent with Goal 11 because the amendment will allow public facilities to be located in a growing residential area to serve the needs of the community (b) Adoption of the amendment must not make the Metro Plan internally inconsistent. No changes in the plan text are proposed,only changes to the plan diagram. This amendment is consistent with the following plan policies: "The plan diagram is a graphic representation of: (1) the broad allocation of projected land use needs in the metropolitan area; and (2) goals, objectives and policies embodied in the text of the plan, Designation of a particular parcel is determined through consultation with the local jurisdiction. Local jurisdictions make specific interpretations of the general diagram through adoption of refinement plans and the implementation of zoning." Chapter IV of the Metro Plan states: "In order for the Metropolitan Area General Plan to serve as an effective policy device to guide change and development, it must be adaptable to the changing circumstances and needs of the community." "Changes to the Metropolitan Plan may occur: 1) as the result of the State's periodic review 3 A3 . requirements; 2) through amendments initiated by anyone of the three governing bodies; 3) as the result of major updates; 4) as the result of citizen-initiated amendment requests." Metro PI~n - Residential land Use and Housing Element The goal of the Residential Land Use and Housing Element is to "provide vi~!:>le residential communities so all residents can choose sound, affordable housing that meets individual needs. " Objective 3. "Locate residential development in relation to the availability of employment, commercial services, public utilities and facilities, and transportation modes." (1I1-A-4) Policy 1. "Coordinate new residential development with the provision of an adequate level of services and facilities, such as sewers, water, transportation facilities, schools and parks." (111- A-4) . The 1991 Supply and Demand Analysis from the Residential Land Study for the Eugene- Springfield Metropolitan area concluded that the "amount of buildable low density residential land exceeds the amount demanded by 24 percent." (Page 103). The estimated buildable LOR land was 8,204 acres. A residential land study is currently taking place. The 1997 draft report is currently under review by the Eugene-Springfield Metropolitan Residential Lands and Housing Citizen Advisory Committee. The draft report states that there are 5,158 acres of buildable LOR property after 30% is subtracted for auxiliary uses, such as streets, schools, parks and other public facilities as provided for in the Metro Plan (II-E-2). This is 29% greater than the expected demand in the metropolitan area from 1992 to 2015. The redesignation of 76.8 acres of LOR land (all of which is not buildable) would remove 0.01% of LOR designated property from the metropolitan supply. Finding 4. The redesignation of the subject LOR land would not significantly effect the supply of LOR land available for residential use. Finding 5. The placement of a community park and high school campus on the subject property meets the goal of the Residential Land Use and'Housing Element. Metro Plan - Public Utilities, Services, and Facilities Element The goal of the Public Utilities, Services, and Facilities Element is to provide the same in an orderly and efficient manner. This element considers the provision of water, sewers, power, education and public safety. "As the metropolitan area grows in population and area, the demand for these services will increase substantially, requiring careful and coordinated planning and management. The public's investment in and scheduling of these public facilities and programs should be viewed as one of the major means of implementing the General Plan." (1I1-G-1) . The change of designations to POS and Government and Education will allow development of 4 :.. . . . A4 the parcels as ballfields and a high school. Initial development of the property as ballfields will provide for the extension of power and water to the site. The extension of the water line east on McKenzie Highway by the School District will put water service within reach of South 79th Street. The school site will accommodate the rapidly urbanizing area of east Springfield. Finding 6. " The orderly and efficient provision of public utilities, services, and facilities is consistent with the redesignation of the property. Metro Plan - Parks and Recreation Facilities Element The goal of the Parks and Recreation Element is to provide a variety of parks and recreation facilities to serve the diverse needs of the community's citizens. "A parks and recreation program with sufficient diversity to meet the needs of the citizenry is an essential ingredient to enhancing the livability of a community. The Eugene-Springfield metropolitan area has a long history of supporting parks and recreation programs, and this plan further strengthens that commitment." <"I-H-1) . The redesignation of the two parcels will allow the development of a community park. The Springfield School District, the City of Springfield and Willamalane Park and Recreation District conducted research and analysis of the Springfield area to find the best site for a park and ballfields to replace the Bob Artz Park. The amount of open space included ina high school , site provides recreational facilities for students as well as the community. The school campus as proposed would contain playing fields for soccer, baseball,football, and courts for tennis and basketball. : Finding 7. The redesignations will allow the site to be used to provide a variety of parks and recreation facilities to serve the diverse needs of the community's citizens Finding 8. Overall, the adoption of this diagram change will not make the Metro Plan internally inconsistent because the proposed changes are consistent with the Metro Plan text. Conclusion and Recommendation for the Metro Plan Amendment This request is consistent with the criteria of SDC7.070, State Goals and Metro Plan policies.
