ORDINANCE NO. 5838
AN ORDINANCE AMENDING ORDINANCE NO. 5837, RELATING TO THE VACATION
OF CERTAIN REAL PROPERTY
WHEREAS, the Springfield City Council approved Ordinance No. 5837 on October 21,
1996, declaring its intention to vacate a 14 foot wide alley in the City of Springfield; and
WHEREAS, part of the legal description providing location of the vacation was omitted
from Ordinance No. 5837; and
WHEREAS, it is in the best interest of the City to amend Ordinance No. 5837 to provide
the correct legal description of the vacation.
NOW, THEREFORE, THE CITY COUNCIL DOES ORDAIN:

Section 2, Ordinance 5837 is amended to state as follows:
Section 2: The following described alley is hereby vacated:
The 14.0 foot wide east-west alley lying in Block 109, Washburne's Subdivision of the
Springfield Investment and Power Company's Addition to Springfield as platted and recorded in
Book 2, Page 73, Lane County Oregon Plat Records in Lane County, Oregon.
ALSO: Beginning at the Southwest corner of Lot 10, Block 108, Washburne's Subdivision of the
Springfield Investment and Power Company's Addition to Springfield as platted and recorded in
Book 2, Page 73, Lane County Oregon Plat Records in Lane County, Oregon, said point of
beginning also being on the easterly right-of-way line of Seventh Street and running thence
East along the northerly line of a 14.0 foot wide alley 1049.0 feet to the Southeast corner of Lot
2, Block 106 in said Washburne's Subdivision, said corner being on the westerly right-of-way
line of Tenth Street; thence South along the westerly right-of-way line of Tenth Street a distance
of 14.0 feet to the Northeast corner of Lot 19, Block 106 in said Washburne's Subdivision;
thence West along the southerly line of the aforementioned 14.0 foot wide alley 1049.0 feet to
the Northwest corner of Lot 11, Block 108 in said Washburne's Subdivision, said corner being
on the easterly right-of-way line of Seventh Street; thence North along the easterly right-of-way
line of Seventh Street a distance of 14.0 feet to the point of beginning in Springfield, Lane
County, Oregon.

Except as amended as set forth above, all other terms and conditions of Ordinance No.
5837 shall remain in full force and effect.

CLARIFICATION OF VACATION

On February 10, 1997, Ordinance No 5838, vacating a 14.0 foot wide alley, was recorded as Reception No
9708756, Reel 2263R, Lane County Official Records, Lane County, Oregon.
The legal description in Ordinance No. 5838 described a 14.0 foot wide strip of land as follows:
ALSO: Beginning at the Southwest corner of Lot 10, Block 108, Washburne's Subdivision of the
Springfield Investment and Power Company's Addition to Springfield as platted and recorded in
Book 2, Page 73, Lane County Oregon Plat Records in Lane County, Oregon, said point of
beginning also being on the easterly right-of-way line of Seventh Street and running thence East
along the northerly line of a 14.0 foot wide alley 1049.0 feet to the Southeast corner of Lot 2, Block
106 in said Washburne's Subdivision, said corner being on the westerly right-of-way line of Tenth
Street; thence South along the westerly right-of-way line of Tenth Street a distance of 14.0 feet to
the Northeast corner of Lot 19, Block 106 in said Washburne's Subdivision; thence West along the
southerly line of the aforementioned 14.0 foot wide alley 1049.0 feet to the Northwest corner of Lot
11, Block 108 in said Washburne's Subdivision, said corner being on the easterly right-of-way line of
Seventh Street; thence North along the easterly right-of-way line of Seventh Street a distance of
14.0 feet to the point of beginning in Springfield, Lane County, Oregon.
The legal description for this vacation ran from the easterly right-of-way line of Seventh Street to the
westerly right-of-way line of Tenth Street crossing the right-of-way of Eighth Street and Ninth Street and
included those portions of Eighth and Ninth Street lying within the bounds of the 14.0 foot wide strip
described above.
This document is being recorded to clarify that Ordinance No. 5838 included vacation of those portions of
Eighth Street and Ninth Street lying within the bounds of the 14.0 foot wide strip described above.
