5834
AN ORDINANCE VACATING A 14 FOOT WIDE SANITARY SEWER EASEMENT,
LANE COUNTY OREGON PLAT RECORDS; AND DECLARING AN EMERGENCY.
WHEREAS, the Springfield City Council has declared its intention to vacate a 14 foot
wide sanitary sewer easement in the City of Springfield; and
WHEREAS, such vacation is in the best interest of the City in carrying out its plans
and programs for the general development of the City; and
WHEREAS, lawful notice of the proposed vacation was published and posted; and
WHEREAS, the Springfield City Council met in Council Chambers, at 225 Fifth Street,
on Monday, the 19th day of August, 1996, at the hour of 7:00 p,m., to hear any objections
to the proposed vacation and ~ persons appeared to object;
NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS:
Section 1: The Council finds that the legal notice of the hearing was lawfully
published and posted; that ~ objections were made at the vacation hearing held; that the
public interest will not be impaired by the vacation of this sanitary sewer easement, and that
vacation of said easement will be in the best interest of the public and increase the benefit of
the property involved.
Section 2: The following described easement is hereby vacated:
(See Attachment A)
Section 3: The staff report and findings of City Planning Journal Number 96-04-75 are
hereby made part of this ordinance by reference.
Section 4: The existing sanitary sewer line will be plugged in a manner consistent
with City of Springfield Standard Construction Specifications. All use of the line shall be
discontinued.
Section 5: It is hereby, found and determined that this matter pertaining to the
vacation of the sanitary sewer easement is necessary for the immediate preservation of the
public health, safety and welfare, therefore this ordinance shall take effect immediately upon
passage by Council and approval of the Mayor.
Section 6: The City Recorder is directed to file the certified copies of this ordinance
with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor.

VACATION OF SANITARY SEWER EASEMENT
BY THE CITY OF SPRINGFIELD
SITUATED in the City of Springfield, Lane County, State of Oregon in the Southeast 1/4 of
Section 35, Township 17 South, Range 2 West of the Willamette Meridian and described as
follows:
ALL of that certain Public Utility Easement conveyed to THE CITY OF SPRINGFIELD, a
municipal corporation in Lane County as said easement was recorded June 24, 1980 in Reel
1080R at Reception Number 8031119 in Lane County Oregon Deed Records, said portion being
. more particularly described as follows:
A 14.00 foot wide Sanitary Sewer Easement being 7.00 feet on each side of the following:
described centerline: beginning at a point being South 00 04' 00" East 124~64 feet and North
820 01' 00" East 7.07 feet from the Northeast corner of Lot 8, BEANEL ACRES, as platted
and recorded in File 73, Slide 362, Lane County Oregon Plat Records; thence South 00 04' 00"
East 200.00 feet to the point of Terminus, in Lane County, Oregon.
