5830 (SPECIAl)
AN ORDINANCE VACATING Af:'J EASEMENT AND RIGHTOF WAY FOR 9TH STREET
LOCATED BETWEEN LOTS 1 AND 10, BLOCK 107 OF THE WASHBURNE'S SUBDIVISION
OF THE SPRINGFIELD POWER COMPANY'S ADDITION TO SPRINGFIELD, LANE COUNTY.
WHEREAS, the Springfield City Council has declared its intention to vacate an
easement and street right of way for 9th Street located in the Washburne's Subdivision of
the Springfield Power Company's Addition to Springfield located within the City of
Springfield; and
WHEREAS, such vacation is in the best interest of the City in carrying out its plans
and programs for the general development of the City; and
WHEREAS, lawful notice of the proposed vacation was published and posted; and
WHEREAS, the Springfield City Council met in Council Chambers, at 225 Fifth Street,
on Monday, the 17th day of June, 1996, at the hour of 7:00 p.m., to hear any objections to
the proposed vacation and ~ persons appeared to object;
NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS:
Section 1: The Council finds that the legal notice of the hearing was lawfully
published and posted; that ~ objections were made at the vacation hearing held; that the
public interest will not be impaired by the vacation of this public right of way and public
easement, and that vacation of said right of way and easement will be in the best interest of
the public and increase the benefit of the property involved.
Section 2: The following described portion of right of way to be vacated:
See Attachment A.
Section 3: The findings in the attached staff report (Jo. No. 96-04-88) are hereby
made part of this ordinance by reference.
Section 4: The City Recorder is directed to file the certified copies of this ordinance
with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor.
ADOPTED by the Common Council of the City of Springfield this 1 st day of July,
1996, by a vote of ~ for and ~ against.

A portion of 9th Street (60 feet in width) lying between Blocks 106 and 107 of WASHBURNE'S
SUBDIVISION OF THE SPRINGFIELD INVESTMENT COMPANY'S ADDITION TO
SPRINGFIELD, as platted and recorded in Volume 2, Page 73, Records of Lane County,
Oregon, located in Section 35, Township 17 South, Range 3 West of the Willamette Base and
Meridian, more particularly described as follows:
All of that portion of 9th Street lying Northerly of an extension of the Northerly margin of an
East-West alley way through Blocks 106 and 107 of above said Subdivision, 118 feet, more or
less, to its terminus on the Southerly boundary of Lot 21 of CLARK AND WASHBURNE'S
ADDITION TO SPRINGFIELD, as platted and recorded in Volume 2, Page 77, Records of Lane
County, Oregon, in Springfield, Lane County, Oregon.

A 14 foot wide easement (being 7 feet each side of centerline) retained in a vacation of a portion
of 8th Street, vacated by City of Springfield Ordinance 1704, Recorded April 3, 1962, Reel No,
192D, Reception No. 64920, Records of Lane County, Oregon, located in Section 35, Township
17 South, Range 3 West of the Willamette Base and Meridian, the centerline of which is more
particularly described as follows:
Beginning at a point of intersection of the centerline of the right-of -way of 8th Street, as platted
and recorded in Volume 2, Page 73, as WASHBURNE'S SUBDIVISION OF THE
SPRINGFIELD INVESTMENT COMPANY'S ADDITION TO SPRINGFIELD, with the
extention of the Northerly margin of an East-West alley way through Blocks 107 and 108 of
abovesaid Subdivision, thence Northerly along the centerline of 8th Street 118 feet, more or less,
to its terminus on the Southerly boundary of Lot 21 of CLARK AND WASHBURNE'S
ADDITION TO SPRINGFIELD, as platted and recorded in Volume 2, Page 77, Records of Lane
County, Oregon, in Springfield, Lane County, Oregon.
