This easement is granted over and across a portion of properties owned by Grantor in Lane County Oregon; properties are described as follows: Parcel I, 2, & 3 of Land Partition Plat No. 95-P074 1 , as recorded on Lane County Plat records, Lane County, Oregon. 2. DECLARATION. Grantor does hereby grant and declare an exclusive easement over, upon, and across a portion of the above described properties for the benefit and of the following described properties: Parcels 1,2, & 3 of Land Partition Plat No. 95-P0741, as recorded on Lane County Plat records, Lane County, Oregon. 3. DESCRIPTION. The description of the easement is as follows: '* WATER LINE EASEMENT Beginning at a point on the easterly boundary of Parcel 2 of Land Partition Plat No. 95-P074 1 ,said point being South 37038'00" West 15.00 feet from the most easterly northeast corner of said Parcel 2; thence running along the easterly line of said Parcel 2 South 3r38'00" West 5.00 feet; thence leaving said easterly line and running along the arc of a 527.46 foot radius curve right (the chord of which bears North 52046'44" West 7.59 feet) a distance of 7.59 feet; thence North 52022'00" West 197.48 feet to a point on the westerly line of said Parcel 3 of said partition plat; thence along said westerly line, along an arc of a 285.92 foot radius curve right (the chord of which bears North 37030'43" East 5.00 feet) a distance of 5.00 feet; thence leaving said westerly line South 52022'00" East .:::) 197.49 feet, and along the arc of a 522.46 foot radius curve left (the chord of which bears South 52046'48" East 7.59 feet) a distance of 7.59 feet to the point of beginning, all in Lane County, Oregon. PURPOSE. The purpose of the Water line easement is for construction, maintenance, use, and repair of private water lines and any appurtenance necessary for operation of said water lines. Water lines are to serve the properties described in paragraph 2. Access to the easement, for maintenance or repair of the water line or appurtenances shall not be restricted. All necessary repairs or modifications shall be done by a licensed, bonded, contractor and the property shall be restored to the original condition. Notice shall be given to the property owners prior to initiating any work except in the case of emergency. The costs of any necessary repairs, maintenance, construction, or modification to the water lines shall be paid by the owners in proportion to their use. 5. USE OF BURDENED PROPERTY. The owners or occupiers of the property described in paragraph 1 shall have the right to use their property, including the area described as the easement, for any purpose as long as the owners or occupiers do not interfere with the use of the easement as granted by this instrument. 6. Successors in Interest. The provisions of this instrument touch and concern, and relate to the use those properties described in paragraph 1 & 2 and are intended to be covenants and restrictions running with the land.
