'::.1'm writing as a follow up to our letter to you of September 8, 1982 (copy attached)
.-:. and also to our recent telephone conversation regarding the barn/stables located at
. the above referenced address. Our September 8, 1982 letter to you required removal
of the "new portion" (the portion of the barn built directly adjacent to the northerly
. 'property line) by October 8" 1982. However, further investigation by this office ren-
dered that date void. This .letter will serve to establish a new compliance'date as
well as set down specific requirements should you choose to build a new structure.
Relative to your desired method of correcting the barn, your representations to me
during our recent telephone conversation, as I understood them, are as follows:
1) You intend to apply for a building permit to erect a new barn.
2) You intend to demolish the entire existing structure in question both the new
portion as well as the non-conforming (built prior to 1965, before .City annex-
ation) portion.
3) You intend to first build the structural framing of the new barn, then demolish
the existing barn using the existing plywood siding to enclose the new barn.
If I have not presented an accurate picture of your intentions, please advise this office
immediately.
The following criteria is required in order for your new barn to comply with applicable
State and City Codes and Ordinances:
1) Structures designed to house livestock must be setback a mlnlmum of 40' from the
front property line and 20' from any interior property lines. Section 14.04 C. 2. ,
Springfield Zoning Code.
2) A residential property is allowed a maximum of two accessory buildings to any
single family residence. Section 14.02, Springfield Zoning Code.
3) The barn may not exceed 1000 square feet in floor area. Section 1102 (a), Oregon
State Structural Specialty Code and Fire and Life Safety Code (S.S.C.).

4) Construction plans are required to be submitted and approved. and a building
permit issued before construction begins. Chapter 3 of the State Structural
Specialty Code and Fire and Life Safety Code.
5) Because of the limitation on the number of permitted accessory buildings per
residential property (see 2. above), the entire existing structure in question
(both the new and non-conforming portions) must be removed.
Currently, this office's primary concern is that the existing violation be corrected
as quickly as possible. We also wish to be equitable with you given the circumstances
and time of the year. However, because we'have been dealing with this violation for
over one year, a 60 day compliance date or February 1. 1983 is the maximum dead line
we feel we can extend to you for compliance.
To clarify, if you choose to erect a new accessory building or barn, the entire
existing structure must be removed whether or not :the new barn is completed by the
above date. If you do not choose to erect a new barn, only the new portion of the
existing structure must be removed,i.e., the portion that is built on or very near
the northerly property line.
