Dear Mr. Johnson:
Our City Surveyor compared the legal description you sent us with the legal
description of Ordinance #4962, the official document enacting the zone change
request of Cochran, Hiatt and Hiatt, and found them to be identical. The request
was for a change in zone from MR Manufacturing Research to MHS Mobile Home
Subdivision. All of your property, except the 60 X 208 parcel that has KORE's
broadcast studio, was included in Ordinance #4962.
I reviewed the COChran, Hiatt and Hiatt file to determine if the original
request, or any subsequent modifications, included your property. I could find
no evidence, either in the application, staff report or pUblic hearing notice
that your property was ever included, or intended to be ,included, with this
request.
I have discussed this situation with the City Attorney and he has advised me that
the City should initiate an amendment to this Ordinance mOdifying the legal
description to correctly identify the boundaries of the Cochran, Hiatt and Hiatt
zone change request. This amendment would result in a corresponding change in
the zoning status of your property from LDR Low Density Residential to LMI Light
Medium Industrial. This change would occur only in our records because the
County' Assessor currently shows your property as having a Medium Industrial
zoning classification.

Although your prt'D~rty,will retain LMI zoning, this zoning classification is not
consistent with t\ ~roperty's Metropolitan Area General Plan designation of Low
Density Residentia\ ~ Any development of this property must conform to this
designation. A prop, i~ for an industrial use, even though the property is zoned
LMI, cannot be consioe"ed at this time.
There is a possibility that your property could be considered for an alternate
Plan designation. This could occur during the Metro Plan update process or
through the adoption of a refinement plan. The Metro Plan update is scheduled
for 1990-91. A refinement plan for this area will prObably begin the first part
of 1989 and conclude 6 to 8 monthS later. Either of these activities would
provide you with ,the opportunity to present findings in support of a Plan
designation Change for your property.
