Steps in the Process: PREmSUBMITIAl REC'D
1. The Applicant Submits a Pre-Submittal Meeting Application JAN 1 g 2008
The Pre-Submittal Application IS mandatory. Please refer to the Fee Schedule for the current
application fee. The submittal package must conform to the application completeness checklist
attached to this form. Please refer to Page 4 for the Pre-Submittal requirements. Pre-
submittal meetings will be conducted every Tuesday and Friday between 10:00 a.m. and noon.
We will strive to conduct the Pre-Submittal meeting within five to seven workmg days of recelvmg
the application.
2. Applicant and the City conduct the Pre-Submittal Meeting
We strongly encourage you, the owner and design team, to attend the Pre-Submittal meeting.
The meeting will be held with representatives from Public Works Engineering and Transportation,
Community Services (Buildmg), Fire Marshall's office, and the Planning Division. The meeting will
be scheduled for 30 to 60 minutes. The Planner will provide you with a Pre-Submittal Checklist at
the end of the meeting specifying the items required to make the applIcatIon complete-if It Isn't
already complete. You will then have 180 days to make the application complete for submittal
and acceptance by the City.
3. Applicant Submits a Complete Application
When you have addressed all of the items on the Pre-Submittal Checklist, please submit a
complete application to the Survey Section located at the NW Quad of City Hall. Refer to page 5
for the submittal requirements. The plat application fee will be collected at that time if the
application has been deemed complete. After Surveying and Planning staff checks and signs the
mylars the plat may then be recorded by the applicant's surveyor at Lane County.
AFTER RECORDING:
Submit Five (5) recorded rolled paper copies of the plat along with Three (3) copies of required
documents delivered to the Development Services Department prior to the issuance of any
bUilding permits.
Owner's Signature
This application will be used for both the required Pre-Submittal Meetmg and subsequent complete
application submittal. Owner's signatures are required at both stages in the application process.
An application without the Owner's original signature will not be accepted.

common areas, dedicated areas, and easement areas that are not simple parallel offsets.
o Two (2) Copies of Title Report or Subdivision Guarantee for the parcel being
divided. The title report must be dated within 30 days of submittal at the tIme of the final
submittal. An older report is OK at the pre-submittal stage.

DATED SEPTEMBER 4, 2007
lOne street tree along the frontage of each parcel (two trees total) have been installed as
generally depicted on the tentative partition plan prior to submittal of mylars. The trees are
sufficIently removed from adjacent property lines and are of a specIes suitable for plantmg
beneath power lines.
2. The electrical and telecommunication services to the existing dwellings have been
undergrounded
3 The undergrounded electncal and telecommunicatIon services have been run (a) southerly
from the pole to the north WIthm the dedicated public right-of-way followed by an angle to
the existmg dwelling on Parcel 1 and (b) northerly from the pole to the south withm the
dedicated public right-of-way followed by an angle to the eXIsting dwelling on Parcel 2. No
additional easements are required as the conduits from the public right-of-way are pnvate
and do not cross adjoming properties.
4. The Serial Property Line Adjustment imtiated by Planning Action SOO2007 -00043 has been
recorded and a Final Notice of Approval was issued October 30, 2007.
5. The Private Temporary Maintenance and Maintenance Access Easement against Tax Lot
800 that benefits Parcel 1 WIll be recorded concurrently WIth the PartItion. Blanks on both
the partitIon and Easement document will be completed at that time. A draft copy IS
included herein.
6. The Joint Use Private Access and Private Utility Easement benefitting Parcels 1 and 2 will
be recorded concurrently with the Partition. Blanks on both the partition and Easement
document will be completed at that time A draft copy is included herein
7. Two paved off-street parktng spaces serving Parcel 2 have been constructed on said parcel.
8 A Warranty Deed for the street dedIcation will be recorded prior to submittal of partition
mylars. A draft copy is mcluded herem.
9. The joint driveway access has been configured such that the driveway approach wings do
not encroach beyond the projected private easement boundaries.
10 The applicant acknowledges that adequate clearance triangles shall be proVIded and
maintained at the corners of the site dnveway in accordance with SDC 32.070. A note to
such has been added to the partition.

WHEREAS:
1) Northview Investments, Inc., an Oregon Corporation, hereinafter referred to as Party One
and being the Grantor herein, is the owner of the lands that were conveyed as "Tract I" in
Exhibit "A" of that certain Senal Pro,p"iLf Line Adjustment Deed Two of Twot}tat was

the Official Records of Lane County, State of Oregon. Said lands are described in "Exhibit
I" attached hereto and made a part hereof.
2) Juan Shedrick and Joy Backer, not as tenants in common, but right of survivorship,
hereinafter referred to as Party Two and being the Grantees herein, are the owners of the
lands that were conveyed as "Tract 2" in Exhibit "B" of aforesaid Serial Property Line
Adjustment Deed Two of Two. Said lands are described in "Exhibit 2" attached hereto and
made a part hereof.
3) The parties desire to create a building maintenance and access easement across a portion of
said "Tract }" for the benefit of an existing building, that does not conform to current
building setback requirements, on said "Tract 2" so as to comply with conditions as noted
and discussed in the "Notice of Decision, Serial Property Line Adjustment-Type n", City
of Springfield Case Number SOO2007-00043 dated September 4,2007 as described below.

A) Creation of Easement: Party One hereby grants and conveys to Party Two a
temporary, non-exclusive, private, 5.00-foot wide pnvate building maintenance and
maintenance access easement for purposes of maintenance and maintenance access purposes
for said non-conformmg building that lies along the rear line of said "Tract 2" over the south
5.00 feet, by ,p",pendicular measurement, of the east 55.00 feet, by perpendicular
measurement, of said "Tract 1 ".
B) Extimrnishment of Easement: The easement created herein shall extinguish in its
entirety upon removal of said non-conforming structure on said "Tract 2".
C) Use orthe PmlJ':'l~~": The owners or occupiers of the tract affected by this easement shall
have the right to use the easement area for any purpose as long as said use does not conflict
with the easement rights granted herein. .
D) Successors in Interest: The provisions of this instrument touch and concern, and relate
to the use of said "Tract 1" and "Tract 2" and are intended to be covenants and restrictions
running with the land. All provisions of this instrument, including the benefits and burdens,
are binding and enure to the heirs, successors, assigns, transferees, and personal

WHEREAS:
1) Duane Knights and Susan Knights, husband and wife, hereinafter referred to as Party One
and being the Grantors herein, are the owners of the lands that were conveyed in that certain
Warranty Deed that was recorded April 21, 2006 at Recorder's No. 2006-027614 in the
Official Records of Lane County, State of Oregon. Said lands are described in "Exhibit I"
attached hereto and made a part hereof.
2) Northview Investments, Inc., an Oregon Corporation, hereinafter referred to as Party Two
and being the Grantee herein, is the owner of Parcel 1 of Land Partition Plat Number
20 as partitioned and recorded ,20_ in the
Land Partition Plat Records of Lane County, State of Oregon.
3) The parties desire to create a building maintenance and access easement across a portion of
said lands of Party One for the benefit of an existing building, that does not confonn to
current building setback requirements, on the lands of Party Two so as to comply with
conditions as noted and discussed in the "Type II Tentative Partition Review, Staff Report
and Decision", City of Springfield Case Number SUB2007-00039 dated September 4,2007
as described below.
THEREFOR:
A) Creation of Easement: Party One hereby grants and conveys to Party Two a
temporary, non-exclusive, private, 5.00-foot wide private building maintenance and
maintenance access easement for purposes of maintenance and maintenance access purposes
for said non-conforming building that lies adjacent to a portion of the north line of said lands
of Party Two over a 5.00-foot wide portion of the lands of Party One as said portion is
described in "Exhibit 2" attached hereto and made a part hereof.
B) Extimmishment of Easement: The easement created herein shall extinguish in its
entirety upon removal of said non-conforming structure on said lands of Party Two.
C) Use of the Pronertv: The owners or occupiers of the tract affected by this easement shall
have the right to use the easement area for any purpose as long as said use does not conflict
with the easement rights granted herein.
D) Successors in Interest: The provisions of this instrument touch and concem, and relate
to the use of said lands of Party One and Party Two and are intended to be covenants and
restrictions running with the land All provisions of this instrument, including the benefits
and burdens, are binding and enure to the heirs, successors, assigns, transferees, and personal
representatives of all owners-of any of the aforementioned tracts.
E) This easement may not be modified or nullified without \\-Titten consent and approval of the
City of Springfield Planning Department.
F) The true and actual consideration for this easement is other than monetary.
