HomeMy WebLinkAboutOrdinance PLANNER 3/22/2008 j ORDINANCE NO. 5261 AN ORDINANCE AMENDING ARTICLE 13, WILLAMETTE GREENWAY SUBDISTRICT AND ESTABLISHING A GREENWAY SETBACK LINE FOR A PORTION OF THE WILLAMETTE GREENWAY AND DECLARING AN H1ERGENCY THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: Section 13.04 of Article 13, Willamette Greenway, of the Comprehensive Zoning Code of the City of Springfield-1982, as amended, is hereby amended to read as follows: "13.04 SETBACK BOUNDARY A Greenway Setback Line shall be established to protect, maintain, preserve and enhance the natural, scenic, historic and recreational qualities of the Willamette Greenway. Only water-dependent or water-related uses shall be permitted between the Willamette River and the Greenway Setback Line. The location of the Setback Line shall be determined consistent with the following standards derived from Section C.3 of the Willamette River Greenway Goal #15. 1. Recreation -- Local, regional and state recreational needs shall be provided for consistent with the carrying capacity of the land; and the possibility that public recreation use might disturb adjacent property shall be considered and minimized to the greatest extent possible. . 2. Access -- Adequate public access to the river shall be provided for, with emphasis on urban and urbanizable areas. 3. Fish and wildlife habitat protected. Significant fish and wildlife habitats shall be 4. Scenic qualities and views -- Identified scenic qualities and viewpoints shall be preserved. 5. Protection and safety -- The maintenance of public safety and protection of public and private property, especially from vandalism and tresspass in both the rural and urban areas, shall be provided for to the maximum extent practicable. 6. Vegetative fringe -- The natural vegetative fringe along the river shall be enhanced anq protected to the maximum extent practicable. 7. Aggregate Extraction -- The location of known aggregate deposits shall be considered. 8. Development away from river -- Developments shall be directed away from the river to the greatest possible degree; provided, however, lands committed to urban uses shall be permitted to continue -as urban uses, including port, industrial, commercial and residential uses, uses pertaining to navigational requirements, water and land access needs and related facilities." Section 2: Section 13.05 of Article 13, Willamette Greenway of the Comprehensive Zoning Code of the City'of Springfield-1982, as amended, is hereby amended to read as foll ows: PRE-SUBMITTAL REC'D MAR .2 .2 2008 i.< ORDINANCE NO. "13.05 DEVELOPMENT STANDARDS In addition to the Conditional Use Standards listed in Section 17.05 of this Code, applications in this subdistrict must also meet the applicable standards of Section 13.04. Aggregate extraction may be permitted outside the Greenway Setback Area subject to compliance with State law and local conditions designed to minimize adverse effects on water quality, fish and wildlife, vegetation, bank stabilizaiton, stream flow, visual quality, quiet and safety, and to generate reclamation." Section 3: The Greenway Setback Line for property located by Assessor1s Map 17-03-35-33 Tax Lot 500 and currently referred to as the Borden Chemical property shall be established as follows: . Beginning at a point 145 feet West of the West line of South 2nd Street and 121 feet South of the Northeast corner of Lot "B" Amended Plat of Willamette Heights as platted and recorded in Book 4, Page 78, Lane County Plat Records, in Lane County, Oregon; thence North 17045\ West 52.5 feet; thence North 160.0 feet; West 61.1 feet; North 23002' West 355.3 feet; thence North 170041 West 211.3 feet; thence North 140171 East 56.8 feet; thence North 150251 West 90.03 feet; thence North 490411 West 43.3 feet; thence North 180291 West 63.19 feet to a point.on the bank of the Millrace and 622 feet West of the West line of South 2nd Street in SpringfJeld, Lane County, Oregon. Section 4: It is hereby found and determined that this ordinance complies with the goals and policies of the Metropolitan Area General Plan and Article 13 of the Comprehensive Zoning Code-1982, as amended. LCDC Goal #15 does not apply because there are specific related policies contained in the Metropolitan Area General Plan and Article 13 addressing the amendment. The findings attached herein support the establishment of the Greenway ~etback Line at the: proposed location. Section 5: It is hereby found and determined that matters concerning land uses within the Willamette River Greenway Setback Line are matters involving the health, safety and welfare of the City of Springfield and the City Council has therefore found and determined that an emergency exists and this Ordinance shall therefore take effect immediately upon its passage by the Council and approval by the Mayor.
