Steps in the Process:
1. The Applicant Submits a Pre-Submittal Meeting Application
The Pre-Submittal Application is mandatory. Please refer to the Springfield Fee Schedule
for the Pre-Submittal Application fee. The submittal package must conform to the
application completeness checklist attached to this form. You are required to submit Nine
(9) copies of the submittal requirements packet for pre-submittal review. Pre-submittal
meetings will be conducted every Tuesday and Friday between 10:00 am and noon. We
will strive to conduct the Pre-Submittal meeting within five to seven working days of
receiving the application.
2. Applicant and the City conduct the Pre-Submittal Meeting
We strongly encourage you, the owner and design team to attend the Pre-Submittal
meeting. The meeting will be held with representatives from Public Works Engineering
and Transportation, Community Services (Building), Fire Marshall's office, and the
Planning Division. The meeting will be scheduled for 30 to 60 minutes. The Planner will
provide you with a Pre-Submittal Checklist at the end of the meeting specifying the items
required to make the application complete-if it isn't already complete. You will then have
180 days to make the application complete for submittal and acceptance by the City.
3. Applicant Submits a Complete Application
When you have addressed all of the items on the Pre-Submittal Checklist, please submit
18 copies of the complete application to the City. A fee will be collected at that time and
the 120 day calendar review period will begin. When the Planner has prepared a draft
land use decision, the draft will be mailed/faxed to the applicant/owner/design team for
their review. At the applicant's request, the planner will schedule a meeting to review the
draft with appropriate staff if certain issues need resolution before the final land use
decision is issued.

complete application submittal. Owner's signatures are required at both stages in the
application process. An application without the Owner"s signature will not be
accepted.

· The proposed 7-foot wide Public Utility Easement may need to be expanded at the
northwest corner of the site to accommodate the existing water line, power line and
power pole support wire that cross this area. ,
· The "porkchop" traffic island at the entrance on 42nd Street does not appear to be
configured so as to discourage left turns (inbound or outbound).
· No illuminated signage is to be placed on north elevation of sales office.
· Improve the pedestrian connection across entrance driveway on 42nd Street (ramps
are directed toward porkchop traffic island). A split island may be required.
· Additional information may be required by SUB Water Quality Protection in support
of the Drinking Water Protection waiver request.
· An encroachment permit or similar approval from the Public Works Department will
be required for the proposed storm sewer connection extending south of the
property frontage on 42nd Street.

This is not a decision on your application. Springfield Development Code Section 5.4-
105 and Oregon Revised Statutes 227.178 require the City take final action on a limited land
use decision within 120 days after the application is deemed complete. The 120-day .
processing period for this application begins when all the missing information is submitted or
when you request that the City proceed without the information. You must indicate by either
signing this form or by submitting a written response to the City within seven days of the
date of this form asserting your intentions regarding the provision of the missing information.
If you indicate herein or in your written response that the missing information will be
submitted, then you have 180 days from the date the application was submitted for Pre-
Submittal Review to provide the City with the missing information. If you refuse to submit
the missing information, then upon receipt of the full application packet and processing fee,
the City will deem the application complete for purposes of starting the 120-day clock and
begin processing the application. No new information may be submitted after the start of
the 120-day period unless accompanied by a request for an extension of the 120-day
processing time. Upon receipt of a request for ext~nsion, the City may extend the 120-day

GENERAL INFORMATION:
This stud; is prepared for the East & West Coast Auto site at the SE comer of the Smith
Way/42n Street intersection.
The storm sewer system for the site will be designed in conformance with EDSPM
Chapter 3 and 4. In addition, the City of Portland Stormwater Management Manual will
be used to design for water quality.
The site is 0.62 acres in size. There will be 0.47 acres of impervious area. The storm
sewer system for the site is designed to shed runoff from all impervious areas to
vegetated swales located around the perimeter of the site. The impervious areas will be
separated into two flow areas discharging into two different public storm sewer systems
at the locations shown on the plans.
Because the site discharges more than 0.5 cfs based on the rational method, a complete
drainage study is required. The site meets the requirements for a Small Site Study. The
actual runoff for a 2-year storm event is [0.47 ac. x 0.95 (runoff coe!) x 1.45 in./hr.(Tc=lO
min.] = 0.65 cfs.
Analysis of the downstream system is not required as indicated on the Stormwater
Management System Scope of Work completed by Matt Stouder. I have included a copy
for reference.
HISTORIC SITE RUNOFF:
Historically and currently the stormwater runoff from the south lh of the site drains to the
area drain along 42nd Street at the west end of tax lot 400. The north lh of the site drains
over the sidewalk on Smith Way and into the curb inlet along the south side of Smith
Way.
PROPOSED SITE RUNOFF:
Based on the Historic site runoff conditions previously discussed, the proposal for
disposal of stormwater from this subdivision is as follows:
Area "A" includes approximately 10,320 square feet of impervious area and 1,568 square
feet of roof area. Area "B" includes approximately 8,533 square feet of impervious area.
Stormwater runoff from Area "A" and Area "B" sheet flows to vegetated'swales along
the perimeter of the site. The swales are sized according to the City of Portland
Stormwater Management Manual using the "Simplified Approach" method.
There are proposed 2,125 square feet of vegetated swales and 560 square feet of grassy
swale. The City of Portland Stormwater Management Manual requires the following
square footage of vegetated swale. 0.47 acres of impervious area including room~as.R . d.

The swales are sized for the water quality storm event per the City of Portland
Stormwater Management Manual using the "Simplified Approach" method. The swales
are more than adequate to convey a 25-year storm event based on the calculations above.

This agreement is between Louanne Bakich Koch Revocable Trust (Craig & Louanne Koch,
Trustees) and Les and Sandra Perry (Husband & Wife) and will become valid and recorded only
after the closmg of the sale of Tax Lot # 17-02-32-32-1800 also identified as Parcel 4 ("Parcel 4")
in exhibit "A"
Exclusive Easement. ThIS easement agreement is intended to run with the land and IS also
intended to be for the exclusive benefit of "Parcel 4" and Parcell, Parcel 2, Parcel 3, Parcel 5,
Parcel 6, Parcel 7, Parcel 8, and Parcel 9 ("Parcels"). This easement is not intended to be for the
benefit of any other adjoining or non-contiguous property whatsoever. "Parcel 4" and "Parcels"
are legally described in Exhibit "A" which is attached hereto and by this reference IS incorporated
herein.
Les and Sandra Perry grant to "Parcels" the use of an access easement located on the south end of
their property, being the southerly 31 feet of "Parcel 4". This is part of an existing recorded
easement. The purpose of this easement is to grant access to the above tax lots to 42nd
Street.
Louanne Bakich Koch Revocable Trust grant to Les and Sandra Perry ("Parcel 4") use of the
existing recorded easement for access to Main Street. This easement is part of the current Parcel 4
and Parcel 7 and will be part of Parcel 3, when the sale to Les and Sandra Perry is completed
There shaH not be any monetary consideration given to Les and Sandra Perry for the use of their
easement from any of the above tax lots.
eraig and Louanne Koch (Louanne Bakich Koch Revocable Trust) shall not receIve any
monetary consideratIOn from Les and Sandra Perry for the use of their easement.
Maintenance Obligation. The respectIve owners of "Parcel 4" and "Parcels" shall each be
responsible for maintenance of the easements across their respective parcels for the benefit of the
other as of the date of closing of the sale of "Parcel 4" to Les and Sandra Perry. Any required
repair shall be promptly, made by the responsible party. Repair of any damage or deterioration to
any easement created by or referred to in this Agreement, caused by any material change in use
shall be the responsibility of the party causing or allowing the material change in use. Material
change in use shall include but not be limited to any substantial increase in regular traffic or
heavy trucks, impedmg traffic flow across the easement in any manner or any other new or
unusual use pattern not'in existence on the date of closing of the sale of "Parcel 4" to Les and
Sandra Perry. Responsibility for costs of such repair due to material change in use shall be
determined by negotiation between the parties to this Agreement or their successors and assigns.
Existing Easement LocationslNo Change in Use or Location. The easements referred to or
created by this Agreement shall be the presently existing easements and uses. It is not the
intention of the parties to enlarge or change the location of the presently existing easements or
materially change the present uses. Nothing in this Agreement is intended to allow any party, or
their successors or assigns, totally free right of travel across the other party's property or to allow
any material change in use. It is intended that the easements shall continue within the present
boundaries in use and present uses in existence on the date of closing of the sale of "Parcel 4" to
Les and Sandra Perry. The sole exception to changes m use shall be that it is understood and
agreed that, due to the intended construction of improvements on "Parcel 4", Les and Sandra

Perry, or any contractor employed by them, may make temporary, limited changes 10 use 10 order
to allow construction and development of Improvements on "Parcel 4".
Successors & Assigns. This Agreement shall be binding upon not only the parties hereto, but
also upon their heirs, personal representatives, trustees, successors, and assigns.
Attorney Fees. If any suit or action is filed by any party to enforce this Agreement or otherwise
with respect to the subject matter of this Agreement, or with any ancillary agreement related to
this Agreement, the prevailing party shall be entitled to recover reasonable attorney fees incurred
in preparation or 10 prosecution or defense of such suit or action as fixed by the trial court, and if
any appeal is taken from the decision of the trial court, reasonable attorney fees as fixed by the
appellate court. Attorney fees shall IOclude all costs associated With the suit or action, including
but not limited to private investigators charges, title investigation charges, surveys, expert witness
costs, long distance telephone calls, photocopying costs, deposition and production or records
costs, bank charges for record searches, accountmg fees, and all "osts of collection incurred in
recovering any debt by the prevailing party or their attorneys.
Expenses. Each party shall bear their own eXpenses in connection with the preparation of this
Agreement and the preparation of any other agreements associated, with the entire transaction.
However, escrow costs associated with establishing closing of sale ~escrow and establishing or
servicing of any collection escrow shall be split equally between the parties
This easement agreement shall remain in effect as long as both parties have access to Main Street
and 42nd Street, or when mutually agreed by all parties involved to terminate.
Craig and Louanne Koch (Louanne Bakich Koch Revocable Trust) shall continue to receive
100% of compensation from Parcel 6 and Parcel 8 for Easement Agreement between these
parties.

See Sheet 4 of the tentative site plan drawings for existing easement details.
The right-inlright-out access to the site from 42nd Street had been previously
discussed with Gary McKinney and OK'd in the location shown on the
plans. My telephone conversation notes are dated 1-2-07. Originally, the
city thought the access should be at the south boundary of the site.
East and West Coast Auto is contacting the adjoining property owner to the
south to obtain a private easement for the construction of the storm sewer
connection to the 42nd Street system. This would eliminate the need for the
PIP.
