DECLARATION OF 14-FOOT PRIVATE UTILITY EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that Alberts Development, L.L.C, is the owner of a
tract ofland located in the Northeast Quarter of Section 3, TOWNSHIP 18 SOUTH, RANGE 2
WEST OF THE WILLAMETTE MERIDIAN, Lane County Oregon, who took title by Bargain and
Sale Deed recorded March 11,2004, Reception No, 2004-017290 and also the owner of Lot 178,
MOUNTAINGATE 2ND ADDITION, as platted and recorded Ma.-A. 29.,1.no7Reception No,
Z,oD-r- :z.O~2.1 . Lane County Official Records,
FURTHER, the Owners, Heirs or Assigns of the above described tract and said LotJ.78will create
and reserve a perpetual, appurtenant easement for utility purposes across a porti'aniJr;'aid tract
described in Bargain and Sale Deed recorded March 11,2004, Reception No, 2004-017290 for the
benefit of said Lot 178, being all of that certain area designated as "OFFSITE EASEMENT No, I"
that is outside of, adjoins the plat boundary of, and is shown on said plat of MOUNT AINGA TE 2ND
ADDITION,
NOW THEREFORE, it is hereby agreed and declared that:
I, The Owners, Heirs and Assigns of the above named Tracts shall share equally in the
costs of maintenance and operation of said Easement.
2, The Owners, Heirs and Assigns of said Tracts may construct and maintain private
utilities over and across said Easement.
3, Maintenance shall be undertaken at such time as the majority of the owners, being served
by said Easement deem it desirable,
