Dear Ms. Parmenter:
This letter is a follow up to City of Springfield staff's visit with you a few weeks ago at your
property off of Glacier Drive. At that meeting Greg Ferschweiler, Maintenance Supervisor,
and Susie Smith, Planner III, discussed with you the difficulties with the grading and
excavation that you have conducted to create an access trail/drive down to the base of your
property at the Weyerhaeuser haul road. In its current condition. the grading you have
conducted carlnot be approved and is in violation of the City Code. At the time of their visit,
staff provided..you with a copy of the City Code regulations concerning fill/removal/grading
requirements and an application form, to provide you with the opportunity to work with the
oCity to bring your.property into compliance with the City's standards for grading activity.

Chapter X, Article 5 of the City Code (provided to you earlier) describes the required
information that must accompany a grading application in order for it to be approved by the
Public Works Department. As Greg Ferschweiler indicated to you, you will need to
incorporate some means of bank stabilization and revegetation to remedy the erosion and
undercutting of the bank that has resulted from your grading activity. City staff is available
to provide you with information and suggestions in your preparation of a grading permit
application and the bank restoration that will need to occur. You can reach Greg Ferschweiler
at 726-3613, or George Walker in Engineering at 726-3674.
Please prepare and submit the appropriate application materials to George Walker, in
Engineering, by July 15, 1994. It is important that we make progress t.owards remedying this
situation. If you do not submit your application by July 15, we will have to conclude that you
are unwilling to comply with the City's grading approval requirements. If you do not comply
with the requirements desciibed in this letter. this violation will be referred to the City
Attorney's Office where appropriate civil legal action may be undertaken to compel your
compliance with the requirements of the City Code.

This letter is a follow-up t.o our site visit on May 26, StateYrea,urer
L994, in which we discussed restoration of the wetlands on
the north side .of your pr.operty (Township 18 South, Range
2 West, Secti.on 4, Tax Lot 310.)
I was ple'ased t.o learn that restorati.on and rem.oval .of
fill in your P.ond W.ould achieve b.oth .of .our g.oals. As
discussed, y.oU .or y.our c.ontract.or will be required t.o
execute the f.oII.owing by Oct.ober 1, 1994:
A) Rem.ove fill piles and gradually grade the east side
of the pond to a shallow bowl shape with slopes of
m.ore .or less 8:1 f.or the 20' x 40' secti.on at the
east end .of the pond.
B) Clean .out b.oth ends .of the culvert under y.our
r.oadway, ensuring free st.orm water fl.oW into the
wetland.

In addition, as discussed we recommend that you plant
shrubs .on the east end .of the P.ond t.o pr.ovide shade and
cover for y.our wildlife P.oPulati.ons.
Thank y.oU for your cooperati.on on this issue. When your
restorati.on is accomplished, please send me phot.ographs of
the c.ompleted w.ork and I will set up a final site
inspecti.on before closing this case.

This letter is a foll.ow up t.o .our certified letter
dated February 11, 1994, claiming Removal-Fill
jurisdicti.on .over the fill placed in a P.ond .on y.our
pr.operty in Lane County (Secti.on 4, Township 18S,
Range 2W, Tax Lot 310.)

Staff at the Divisi.on have further reviewed the
photos, soil characteristics, and hydrology of your
pond in relati.on to adjacent wetlands. The pond
shows up faintly .on the .old black and white
photographs. In addition, the pond area is mapped as
hydric soils, and the pond has a free and open
hydr.oI.ogic c.onnection t.o the forested wetlands t.o the
west .of your pr.operty. Field determinations for the
forested wetland, emergent wetlands, and P.onds in
this area .of Springfield was documented by Susan
Cunningham of David Evans & Associates on June 22,
1992, and May 25, 1993. The summary states that.this
is a moderate t.o high value wetland, with m.oderate .
plant diversity, high buffer, high c.onnectivity,
moderate water quality, high wiljlife habitat, and
m.oderate flood c.ontr.ol. The summary states that the
wetland is located at the f.o.ot .of a steep hillside,
and the probable water source is surface fl.ow and
precipi ta tion.

Dear Ms. Pannenter:
I am faxing you this letter in accordance with your request, but am also sending the
original to you by mail.
You telephoned me on June 27th to
1. inform me that, in addition to building a new home, you are dealing with
your fathe~s very serious illness right now; and,
2. request an extension on the July 15, 1994 deadline given to you in my June
20, 1994 letter to you. This deadline specified the date by which you must
submit the appropriate application materials to George Walker of the
Engineering Division in order to obtain a grading permit. This grading permit
will enable you to make the required corrections to the improper grading and
excavation which has occurred on your property.
In sympathy with the difficulties facing you and your family regarding your fathe~s
illness, I told you that the City is willing to extend the deadline but the corrective soil
stabilization and revegetation r:nyg occur by the time fall rains arrive. And, you must
submit your application in time to have a grading permit to cany out the corrective
'M:lrk. In accordance with this, I said - and you agreed - to call me in "a couple
weeks", let's say by 5:00 p.rn. on July 15, to update me on whether your family's crisis
is continuing or not.
If at any time prior to July 15th you decide to proceed with your application and need
staff assistance, feel free to contact the staff persons mentioned in my previous letter.

I called Barbara Parmenter today to inquire as to vlny she hasn't contacted us about
her grading permit application to rectify the illegal grading on her property off of
Glacier Drive.
Barbara said that her father's funeral was Monday. July 25th. She now has to settle
his estate, but hopes to be able to give the grading permit matter her attention by the
middle of August.
If she has not contacted us by August 15th, I will write her a strong letter telling her
that we are referring the matter to the City Attorney's Office for legal action.

SUBJECT: Illegal Grading of Parmenter Property
As you will recall. I sent a June 20. 1994 letter. C.oPy attached. to Ms.
Barbara Parmenter regarding illegal grading done on her property .off Glacier
Drive. The letter said that Ms. Parmenter was t.o apply to George Walker no
later than July 15. 1994 f.or a grading permit t.o remedy the grading
deficiencies.
Ms. Parmenter did not make the required application by July 15. but she did
call me on June 27. 1994 t.o request that the July 15 deadline be extended.
Subsequently. I mailed Ms. Parmenter another letter. dated July 1. 1994. C.oPy
attached. waiving the July 15 application deadline but emphasizing that the
corrective work must be done by the time that fall rains arrive. My letter
further specified that Ms. Parmenter must call me by July 15. 1994 t.o update
me on the status of the matters that underlied her request for an extension.
Ms. Parmenter did n.ot call me by the specified July 15 time to update me.
Therefore. on July 27th. I called Ms. Parmenter t.o inquire as to the status of
her personal matters that were delaying her application for the necessary
grading permit. Ms. Parmenter stated that she W.ould give this matter her
attention by mid-August. (July 27. 1994 note to file attached)
Not having heard from Ms. Parmenter since July 27th. I called her today. She
said that she is willing to meet with the appr.opriate City staff next week at
her property to seek specific direction .on what has t.o be d.one in the field.
and then will apply for the permit. In order to set. such a meeting. she asked
that a City staff pers.on call her at 74~-1461 on Tuesday. September 6. 1994.
She said that it is likely she will be able t.o meet the City staff that day.
