week; At this time I am requesting the council to approve
the replacement of my destroyed septic system at 5409 Ivy Street
in Springfield, Oregon. The location of the tank will be beyond
120 feet to the end of Ivy Street.
I have enclosed a copy of the permit application for Lane

:Enclosed, please find my application' for .a.septic tank and drain-
field system on my property located'gff South 55th Place and Ivy
Streets in Springfield, Oregon. . .
,. This is a replacement system'. I am. planning on building a new
home on my 38 plus acres next spring.'. At this time I wish t.o in-
stall my septic system to replace. the..sy.st~m ,that was destroyed'
in June of this last year. The existing..system was in excellent.
-working' order and had been serving'. a mobil unit on the property..
. My ex-husband destroyed the system after,removing hismobil.
.' I checked with the city planner for..Springfield today and he
indicated they do not have jurisdiction on the systems and that
i_ the permit would be left to Lane County Lane Management. Of
" course I would want the.~ystem to ~atisfy'my new. home requirements.
.The new home is a two bedroom 1700 square 'foot residence.
. I"have enclosed copies.of the City of Springfield's septic
criteria for installing a system. .

Re: Septic System Destruction on Your Ranch
To Whom It May Concern,

.The opinion given is based onJthe 29 years I have been an
engineering contract.or. Over the years I have constructed miles.
of concrete, gunite and. related flood control projects, under-
ground utilities, i.e. water, sewer, gas, etc. Constructed miles' ..
of roads for federal, state,. county, city and the private sector.
Also my company has installed dozens and dozens of all types of
septic systems, i.e~ gravity, pump, metered, mound, high pr.ofile,
deep.section and .others. Ms..Parmenter, in.-my reviewing the site
where. the septic system was destroyed by the bulldozer using
rippers was irresponsabl~ inasmuch 'you stated that the person
operating the machinery was also resP.onsible for disconnecting
the ~ewer pipe fr.om the mobilh.ome prior t.o sinking the bull-
dozer ripper teeth into the earth at. tbe same locati.on thus rip-
ping the top off of the septic tank and allowing dirt and debris
to fill the concrete septic tank, thus rendering it useless.
Also, it appears that the entire surrounding area including a
__ _. .graveled road and the leach line area fell victims to the bull-
" dozer ripper shanks. .
I recommend that you abandon the existing destroyed septic
,
:'system even though y.oU expressed to'me you wanted to' use the
system at a future date in conjunction of building a new home
. ~on or near-the existing site. A soils engineer will have to be
~ hired to preform mantel and. perk tests near the existing site
r and then along with the test results, submit a sketch or plan
to t~e Department of Enviromental Quality Board for their review
and approvaL

Dear Ms. Parmenter-Pierce,
This letter is in response to recent telephone conversation concerning the
above mentioned property.
1. Land Status
You told me that the different tax lots ~ere created for tax purposes.
The City has no record of land divisions (final approval) for this
property. Therefore, only one dvelling unit can be constructed ~n this
tract of land at this time. If you vant to have a manufactured home
placed on the property to live in ~hile construction of your house is
occurring, you viII have to divide the property. Any land division,
including a partition, viII require, among other things, the dedication
and full improvement of Ivy Street.
2. Connection to Sanitary Se~er
City Code Section 2-10-1 (see attached) requires the connection to
sanitary sever when the property being developed within 120 feet of any
public sanitary sewer. However, Oregon Administrative Rule (OAR)
340-71~160(5) (see attached) states that the connection must occur if the
property is within 300 feet of sanitary sewer. The OAR referenced
supersedes the City Code; i.e., the 300 foot standard applies. Since your
property is considered "one tract of land" and the public sanitary sewer
is in Ivy Street, vhich abuts your property, you viII have to connect to
the City sever system.
3. BPA Easement
Since access to your property is over a BPA easement, you ~ill have to
demonstrate to the City that you have permission to cross that easement.
This permission can be in the form of a letter or a copy of a recorded
easement from BPA. If no special requirements are necessary, than a
letter from BPA stating that viII be required.

Our conversation included a discussion of the vetlands on your property
and your previous conversations vith Susie Smith concerning this issue.
At the time you submit for a building permit the City viII submit a
iletland Land Use Notification Form to the Department of State Lands (see
attached information).

ARTICLE 10. SANITARY SEWERS
2-10-1 Sewer Connections. A person erecting or maintaining a water closet,
sink, bathtub, or drain in the city upon property within 120 feet
of any publ ic sanitary sewer shall connect the facil ity with the sewer at his
own expense, in the manner and under regulations and supervision prescribed
by the city.
2-10-2 Sewer Connections--Permits. No unauthorized person shall uncover,
make any connection with, open into, use, alter, or disturb any sanitary
sewer without first obtaining a written permit from the city to do so.
2-10-3 Sewer.Connections--Unassessed Property.
(1) Any person desiring to connect a private sanitary sewer line
to a city sanitary sewer line from property against which no assessment has
been levied shall first apply to the department of public works for a pennit
to do so. The permit shall set forth at what point ttie city sewer lihe is to.
be tapped, the distance that the connecting sewer Tine will run, the location,
the size of pipe, the type of construction and such other facts as the city
engineer may reasonably require on a fonn to be furnished for this purpose.
Upon making an appl ication as herein provided, such person shall
pay to the City an amount based upon the City's established rate per square foot
of benefited property. This rate is currently $0.17 per square foot of benefited
property, but shall be reviewed, if necessary, adjusted by the City Council in
January of each year to reflect actual sewer construction costs. Any rate
adjustment shall be determined by the previous year's sewer construction costs
and projected inflation to the next construction season. The depth of the
benefited property shall not exceed 150' from the street or 150' from the sanitary
sewer line if the sewer line is not within the street right-of-way, except by
special authorization by the Director of Public Works or his duly authorized
.agent and based upon reasonable judgment, such as 1) the location of the building
in relation to the referenced 150' line; 2) the possibility of future develop-
ment for the building sites beyond the 150' depth.' Except as provided by
1) and 2) immediately preceding, a reduced charge will be charged for that area
beyond the 150' line. The sum so paid may be deposited against any future
sanitary sewer assessment which may be made against said property. In the event
the sum paid exceeds the assessment any excess will be refunded to the property
owner.
(2) In. the event that a city sewer line is in close proximity but
~ot contiguous to an industrial, commercial or multiple housing development
desiring connection, a line of'adequate length, size and depth (as approved by the
City Engineer) shall be installed at the owner's expense to serve such property.
the charge as outlined in (1) and (2) above shall then be imposed but the owner
shall have credited upon such connection charge, that cost for excess length,
size or depth required by the city engineer.
(3) In the event that one or more single family residential property
owners desire to extend a sewer to serve their property, the method and connec-
tion charge, if any, shall be as determined by the director of public works or
his duly authorized agent, consistent with current policies.

Permit Application Proccdurcs - General
Requirements
340-71-160 (1) No person shall cnuse or allow
construction, alteration, or repair of a system, or
any part thereof, without first applying for and
obtaining a permit.
EXCEPTION: Emergency "'pai... a. oct forth in rol.
340.71.215.
(2) Applications for permits shall be made on
forms provided by the Agent and approved by the
Department. .
(3) An application is complete only when the
form, on its face\ is completed in full, is signed by
the owner 'or tne owner's le~ally authorized
representativeJ and is accompamed by all required
exhibits and Ice. Except as otherwise allowed in
OAR 340-71-400(6), the exhibits shall include:
(a) Favorable site evaluation report.
(b) Favorable land use compatibility statement
from the appropriate land use authority signifying
that the proposed land use is compatible with the
Land Conservation and Development Commission
acknowIed~ed comprehensive plan.or complies with
the stateWide planning goals.
(c) Plans and specifications for the on-site
system' proposed for installation within the area
identified in the favorable site evaluation report.
The Agent shall determine and request the
minimum level of detail necessary to insure proper
system construction.
(d) Any other information the Agent finds is
necessary to complete the permit application.
. (4) The application form shall be received by
the Agent onI'y when the form is complete, as
detailed in section (3) of this rule. .
(5) Upon receipt of a completed application the
Agent shall deny the permit if:
(a) The application contsins false information;
(b) The application was wrongfully received by
the Agent;
(cJ The proposed system would not comply with
these rules.;
(d) The proposed system, if constructed, would
violate a Commission moratorium as described in
rule 340-71-460;

(i) For a single familr dwelling, or other
establishment with a maximum projected daily
sewage flow of not more than four hundred fifty
(450) gallons, within three hundred (300) feet;
. (ii) For a proposed subdivision or group of two
(2) to five (5) single family dwellings, or equivalent
projected daily sewage flow, not further than two
hundred (200) feet multiplied by the number of
dwellings or dwelling equivalents;
(iii) For proposed subdivisions or other
developments with more than five (5) single family
dwellings, or equivalents, the Agent shall make a
case-by-case determination of sewerage availabjlity.

(D) Legal Availability. A sewerage system shall
be deemed legally available if the s'ystem is not
under a Department connection permit
moratorium, and the sewerage system owner is
willing or obligated to Frovide sewer service.
(6) A permit shal be issued only to a person
licensed under ORS 454.695, or to the owner or
casement holder of the land on'which the system is
to be installed.
(7) No person shall construct, alter or repair n
system, or any part thereof, unless that person is
hcensed under ORS 454.695, or is the permittee.
(8) The Agent shall either issue or deny the
permit within twenty (20) days after receipt of the
. completed application.

(9) A permit issued pursuant to these rules
shall be effective for one (1) year from the date of
issuance for construction of the system. The
construction-installation pennit is not transferable.
Once a system is installed pursuant to the permit,
and a Certificate. of Satisfactory Completion has
been issued for the installation, conditions imposed
as requirements for permit issuance shall continue
in force as long as the system is in use.
(10) Renewal of a permit may be granted to the
original permittee.if an applicntion for permit
renewal is filed prior to the original permit
expiration date. Application for permit renewal
shall conform to the requirements of sections (2)
and (4) of this rule. The permit shall be issued or
. denied consistent with sections (5), (6), (8), and (9)
of this rule.

WETLAND LAND USE NOTIFICATION PROCESS

Under Senate Bill 3, cities and counties have a resP.onsibility
to notify DSL of certain devel.opment activities proposed within
wetlands .on Nati.onal wetlands Invent.ory (NWI) maps. The
specific activities requiring n.otificati.on are listed in ORS
215.418 (c.ounties) and ORS 227.350 (cities). The purp.ose is t.o
impr.ove l.ocal-state c.o.ordinati.on and pr.ovide n.otificati.on .of
wetland regulati.ons t.o land.owners and applicants. Once the
l.ocal government has received its NWI maps fr.om DSL, it sh.ould
f.oII.oW these steps each time a listed land use applicati.on is
received:
1. Examine the wetland maps and determine if the pr.oject w.ould
.occur within a mapped wetland.
2. If it appears that a wetland might be affected, fill .out a

to DSL with the attachments requested .on the form. (Be sure the
site is clearly marked on the NWI map phot.ocopy attachment.)
This form must be sent within 5 days of receiving the c.ompleted

3. Inf.orm the applicant that the site may include jurisdicti.onal
wetlands and a permit may be required by state and/.or federal
agencies. DSL has 30 days in which to resP.ond to the local
government, the landowner, and the applicant. XQQ are not
required t.o n.otify the applicant .of DSL's decisi.on.
4. After notifying DSL, finish pr.ocessing the applicati.on. Y.oU
may issue your final decision regardless of whether .or not DSL
has responded. If DSL has failed t.o resP.ond, y.oU can approve
the activity with n.o liability .on y.our part if y.oU inf.orm the
applicant tha~ a state .or federal permit may still be required.
